312 1 AN ACT concerning education.
413 2 Be it enacted by the People of the State of Illinois,
514 3 represented in the General Assembly:
6-4 Section 5. Findings. The General Assembly finds that, to
7-5 address the increasing mental health and behavioral health
8-6 needs of students in our schools, a new social work associate
9-7 endorsement on an Educator License with Stipulations is needed
10-8 to expand the availability of qualified social workers to work
11-9 within school settings. The new endorsement created under this
12-10 Act is designed for Master of Social Work professionals who
13-11 hold current licenses issued by the Department of Financial
14-12 and Professional Regulation under the Clinical Social Work and
15-13 Social Work Practice Act as either a licensed clinical social
16-14 worker or a licensed social worker. The intent of this Act is
17-15 to expand the availability of qualified social workers in our
18-16 schools, not to replace or supplant professional educator
19-17 license holders or to fill professional educator license
20-18 vacancies. This Act is also intended to encourage social work
21-19 associates to pursue a Professional Educator License with a
22-20 school support personnel endorsement in the area of school
23-21 social work.
24-22 Section 10. The School Code is amended by changing
25-23 Sections 21B-20, 21B-30, and 21B-40 as follows:
15+4 Section 5. Findings. The General Assembly finds that to
16+5 address the evolving needs of our mental health in schools a
17+6 new pathway to educator licensure is needed. The specialized
18+7 license created under this Act is designed for licensed Master
19+8 of Social Work professionals, allowing qualified professionals
20+9 to work within school settings without the requirement of a
21+10 Professional Educator License with a school support personnel
22+11 endorsement in the area of school social worker. This
23+12 innovative approach recognizes the diverse skills and
24+13 expertise that Master of Social Work professionals bring to
25+14 the field while ensuring a pathway for additional
26+15 specialization beyond obtaining a Professional Educator
27+16 License with a school support personnel endorsement in the
28+17 area of school social worker.
29+18 Section 10. The School Code is amended by changing
30+19 Sections 21B-20 and 21B-40 as follows:

35-2 Sec. 21B-20. Types of licenses. The State Board of
36-3 Education shall implement a system of educator licensure,
37-4 whereby individuals employed in school districts who are
38-5 required to be licensed must have one of the following
39-6 licenses: (i) a professional educator license; (ii) an
40-7 educator license with stipulations; (iii) a substitute
41-8 teaching license; or (iv) until June 30, 2028, a short-term
42-9 substitute teaching license. References in law regarding
43-10 individuals certified or certificated or required to be
44-11 certified or certificated under Article 21 of this Code shall
45-12 also include individuals licensed or required to be licensed
46-13 under this Article. The first year of all licenses ends on June
47-14 30 following one full year of the license being issued.
48-15 The State Board of Education, in consultation with the
49-16 State Educator Preparation and Licensure Board, may adopt such
50-17 rules as may be necessary to govern the requirements for
51-18 licenses and endorsements under this Section.
52-19 (1) Professional Educator License. Persons who (i)
53-20 have successfully completed an approved educator
54-21 preparation program and are recommended for licensure by
55-22 the Illinois institution offering the educator preparation
56-23 program, (ii) have successfully completed the required
57-24 testing under Section 21B-30 of this Code, (iii) have
58-25 successfully completed coursework on the psychology of,

69-1 the identification of, and the methods of instruction for
70-2 the exceptional child, including, without limitation,
71-3 children with learning disabilities, (iv) have
72-4 successfully completed coursework in methods of reading
73-5 and reading in the content area, and (v) have met all other
74-6 criteria established by rule of the State Board of
75-7 Education shall be issued a Professional Educator License.
76-8 All Professional Educator Licenses are valid until June 30
77-9 immediately following 5 years of the license being issued.
78-10 The Professional Educator License shall be endorsed with
79-11 specific areas and grade levels in which the individual is
80-12 eligible to practice. For an early childhood education
81-13 endorsement, an individual may satisfy the student
82-14 teaching requirement of his or her early childhood teacher
83-15 preparation program through placement in a setting with
84-16 children from birth through grade 2, and the individual
85-17 may be paid and receive credit while student teaching. The
86-18 student teaching experience must meet the requirements of
87-19 and be approved by the individual's early childhood
88-20 teacher preparation program.
89-21 Individuals can receive subsequent endorsements on the
90-22 Professional Educator License. Subsequent endorsements
91-23 shall require a minimum of 24 semester hours of coursework
92-24 in the endorsement area and passage of the applicable
93-25 content area test, unless otherwise specified by rule.

147-7 holder to serve only as a superintendent or assistant
148-8 superintendent in a school district's central office.
149-9 This endorsement may only be issued to an applicant
150-10 who, at the time of applying for the endorsement, has
151-11 done all of the following:
152-12 (i) Graduated from a regionally accredited
153-13 college or university with a minimum of a master's
154-14 degree in a management field other than education.
155-15 (ii) Been employed for a period of at least 5

159-19 of an alternative route to superintendent
160-20 endorsement program, as provided in Section 21B-55

164-24 The endorsement is valid for 2 fiscal years in
165-25 order to complete one full year of serving as a

178-2 (E) Career and technical educator. A career and
179-3 technical educator endorsement on an Educator License
180-4 with Stipulations may be issued to an applicant who
181-5 has a minimum of 60 semester hours of coursework from a
182-6 regionally accredited institution of higher education
183-7 or an accredited trade and technical institution and
184-8 has a minimum of 2,000 hours of experience outside of
185-9 education in each area to be taught.
186-10 The career and technical educator endorsement on
187-11 an Educator License with Stipulations is valid until
188-12 June 30 immediately following 5 years of the
189-13 endorsement being issued and may be renewed.
190-14 An individual who holds a valid career and
191-15 technical educator endorsement on an Educator License
192-16 with Stipulations but does not hold a bachelor's
193-17 degree may substitute teach in career and technical
194-18 education classrooms.
195-19 (F) (Blank).
196-20 (G) Transitional bilingual educator. A
197-21 transitional bilingual educator endorsement on an
198-22 Educator License with Stipulations may be issued for
199-23 the purpose of providing instruction in accordance
200-24 with Article 14C of this Code to an applicant who

213-1 (i) Possesses adequate speaking, reading, and
214-2 writing ability in the language other than English
215-3 in which transitional bilingual education is
216-4 offered.
217-5 (ii) Has the ability to successfully
218-6 communicate in English.
219-7 (iii) Either possessed, within 5 years
220-8 previous to his or her applying for a transitional
221-9 bilingual educator endorsement, a valid and
222-10 comparable teaching certificate or comparable
223-11 authorization issued by a foreign country or holds
224-12 a degree from an institution of higher learning in
225-13 a foreign country that the State Educator
226-14 Preparation and Licensure Board determines to be

230-18 A transitional bilingual educator endorsement
231-19 shall be valid for prekindergarten through grade 12,
232-20 is valid until June 30 immediately following 5 years
233-21 of the endorsement being issued, and shall not be

235-23 Persons holding a transitional bilingual educator
236-24 endorsement shall not be employed to replace any
237-25 presently employed teacher who otherwise would not be
238-26 replaced for any reason.

249-1 (H) Language endorsement. In an effort to
250-2 alleviate the shortage of teachers speaking a language
251-3 other than English in the public schools, an
252-4 individual who holds an Educator License with
253-5 Stipulations may also apply for a language
254-6 endorsement, provided that the applicant provides
255-7 satisfactory evidence that he or she meets all of the
256-8 following requirements:
257-9 (i) Holds a transitional bilingual
258-10 endorsement.
259-11 (ii) Has demonstrated proficiency in the
260-12 language for which the endorsement is to be issued
261-13 by passing the applicable language content test
262-14 required by the State Board of Education.
263-15 (iii) Holds a bachelor's degree or higher from
264-16 a regionally accredited institution of higher
265-17 education or, for individuals educated in a
266-18 country other than the United States, holds a
267-19 degree from an institution of higher learning in a
268-20 foreign country that the State Educator
269-21 Preparation and Licensure Board determines to be
270-22 the equivalent of a bachelor's degree from a

526-26 (3) Substitute Teaching License. A Substitute Teaching

553-17 A substitute teacher may only teach in the place of a

555-19 board. If, however, there is no licensed teacher under
556-20 contract because of an emergency situation, then a
557-21 district may employ a substitute teacher for no longer
558-22 than 30 calendar days per each vacant position in the
559-23 district if the district notifies the appropriate regional
560-24 office of education within 5 business days after the

687-8 examinations and indicators must be based on national and
688-9 State professional teaching standards, as determined by the

656+11 social work roles, with the exception of direct work with
657+12 students with disabilities, including, but not limited to,
658+13 a student with an individualized education program.
659+14 A School Social Work Associate License may be issued
660+15 to an applicant who (i) holds a degree from a graduate
661+16 program of social work that has been approved by the
662+17 Council on Social Work Education and (ii) has an active
663+18 license though the Department of Financial and
664+19 Professional Regulation under the Clinical Social Work and
665+20 Social Work Practice Act as either a licensed clinical
666+21 social worker or licensed social worker. If the applicant
667+22 is a licensed social worker under the Clinical Social Work

735-20 language and literacy subscore can be determined. The State
736-21 Board shall base its rules concerning the passing subscore on
737-22 the language and literacy portion of the test on the
738-23 recommended cut-score determined in the formal
739-24 standard-setting process. Candidates need not achieve a
740-25 particular subscore in the area of language and literacy. The

764-13 1, 2025, all candidates completing teacher preparation
765-14 programs in this State and all candidates subject to Section
766-15 21B-35 of this Code are required to pass a teacher performance
767-16 assessment approved by the State Board of Education, in
768-17 consultation with the State Educator Preparation and Licensure
769-18 Board. A candidate may not be required to submit test
770-19 materials by video submission. Subject to appropriation, an
771-20 individual who holds a Professional Educator License and is
772-21 employed for a minimum of one school year by a school district
773-22 designated as Tier 1 under Section 18-8.15 may, after
774-23 application to the State Board, receive from the State Board a
775-24 refund for any costs associated with completing the teacher
776-25 performance assessment under this subsection.

932-1 performance assessment shall be the tests that from time to
933-2 time are designated by the State Board of Education, in
934-3 consultation with the State Educator Preparation and Licensure
935-4 Board, and may be tests prepared by an educational testing
936-5 organization or tests designed by the State Board of
937-6 Education, in consultation with the State Educator Preparation
938-7 and Licensure Board. The test of content area knowledge shall
939-8 assess content knowledge in a specific subject field. The
940-9 tests must be designed to be racially neutral to ensure that no
941-10 person taking the tests is discriminated against on the basis
942-11 of race, color, national origin, or other factors unrelated to
943-12 the person's ability to perform as a licensed employee. The
944-13 score required to pass the tests shall be fixed by the State
945-14 Board of Education, in consultation with the State Educator
946-15 Preparation and Licensure Board. The tests shall be
947-16 administered not fewer than 3 times a year at such time and
948-17 place as may be designated by the State Board of Education, in
949-18 consultation with the State Educator Preparation and Licensure
950-19 Board.
951-20 The State Board shall implement a test or tests to assess
952-21 the speaking, reading, writing, and grammar skills of
953-22 applicants for an endorsement or a license issued under
954-23 subdivision (G) of paragraph (2) of Section 21B-20 of this
955-24 Code in the English language and in the language of the
956-25 transitional bilingual education program requested by the
957-26 applicant.

968-1 (h) Except as provided in Section 34-6 of this Code, the
969-2 provisions of this Section shall apply equally in any school

971-4 (i) The rules developed to implement and enforce the
972-5 testing requirements under this Section shall include, without
973-6 limitation, provisions governing test selection, test
974-7 validation, and determination of a passing score,
975-8 administration of the tests, frequency of administration,
976-9 applicant fees, frequency of applicants taking the tests, the
977-10 years for which a score is valid, and appropriate special
978-11 accommodations. The State Board of Education shall develop
979-12 such rules as may be needed to ensure uniformity from year to
980-13 year in the level of difficulty for each form of an assessment.

985-18 (a) Beginning with the start of the new licensure system
986-19 established pursuant to this Article, the following fees shall

1013-11 in this State, but does not require a registration fee.
1014-12 The licensee may apply for a refund of the application fee
1015-13 within 18 months of issuance of the new license and shall
1016-14 be issued that refund by the State Board of Education if
1017-15 the licensee provides evidence to the State Board of
1018-16 Education that the licensee has taught pursuant to the
1019-17 Short-Term Substitute Teaching License at least 10 full
1020-18 school days within one year of issuance. The application
1021-19 fee for a Short-Term Substitute Teaching License shall be
1022-20 waived when the Governor has declared a disaster due to a
1023-21 public health emergency pursuant to Section 7 of the
1024-22 Illinois Emergency Management Agency Act.
1025-23 (2) A $150 application fee for individuals who have
1026-24 not been entitled by an Illinois-approved educator
1027-25 preparation program at an Illinois institution of higher
1028-26 education and are seeking any of the licenses set forth in

1039-1 subdivision (1) of this subsection (a) or for a social
1040-2 work associate endorsement on an Educator License with
1041-3 Stipulations.
1042-4 (3) A $50 application fee for each endorsement or
1043-5 approval.
1044-6 (4) A $10 per year registration fee for the course of
1045-7 the validity cycle to register the license, which shall be
1046-8 paid to the regional office of education having
1047-9 supervision and control over the school in which the
1048-10 individual holding the license is to be employed. If the
1049-11 individual holding the license is not yet employed, then
1050-12 the license may be registered in any county in this State.
1051-13 The registration fee must be paid in its entirety the
1052-14 first time the individual registers the license for a
1053-15 particular validity period in a single region. No
1054-16 additional fee may be charged for that validity period
1055-17 should the individual subsequently register the license in
1056-18 additional regions. An individual must register the
1057-19 license (i) immediately after initial issuance of the
1058-20 license and (ii) at the beginning of each renewal cycle if
1059-21 the individual has satisfied the renewal requirements
1060-22 required under this Code.
1061-23 Beginning on July 1, 2017, at the beginning of each
1062-24 renewal cycle, individuals who hold a Substitute Teaching
1063-25 License may apply for a reimbursement of the registration
1064-26 fee within 18 months of renewal and shall be issued that
