Prohibits a service business from discriminating on the basis of gender. Defines "service business" as a commercial enterprise that focuses on providing various services to customers and has no tangible, physical characteristics or products. This includes, but is not limited to, hairstylists, barbers, tailors, dry cleaners, and laundries. Provides that nothing in the Act prohibits price differences based specifically upon the amount of time, difficulty, or cost of providing the services. 12	12	1 AN ACT concerning civil law.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 1. Short title. This Act may be cited as the
16	16	5 Prevention of Gender-Based Discrimination in Service
17	17	6 Industries Act.
18	18	7 Section 5. Definitions. In this Act:
19	19	8 "Service business" means a commercial enterprise that
20	20	9 focuses on providing various services to the customers and has
21	21	10 no tangible, physical characteristics or products. This
22	22	11 includes, but is not limited to, hairstylists, barbers,
23	23	12 tailors, dry cleaners, and laundries.
24	24	13 "Standard service" means the 15 most frequently requested
25	25	14 services provided by a service business.
26	26	15 Section 10. Prohibited discrimination. A service business
27	27	16 may not discriminate, with respect to the price charged for
28	28	17 services of similar or like kind, against a person because of
29	29	18 the person's gender. Nothing in this Act prohibits price
30	30	19 differences based specifically upon the amount of time,
31	31	20 difficulty, or cost of providing the services.

69	69	1 (a) The following service businesses must clearly and
70	70	2 conspicuously disclose to the public in writing the pricing
71	71	3 for each standard service provided:
72	72	4 (1) tailors or businesses providing aftermarket clothing
73	73	5 alterations;
74	74	6 (2) barbershops or hair salons; or
75	75	7 (3) dry cleaners and laundries providing services to
76	76	8 individuals.
77	77	9 (b) The price list shall be posted in an area conspicuous
78	78	10 to customers. Posted price lists shall be in no less than
79	79	11 14-point boldface type and clearly and completely display
80	80	12 pricing for every standard service offered by the business.
81	81	13 (c) The service business shall provide the customer with a
82	82	14 complete written price list upon request.
83	83	15 (f) The service business shall display in a conspicuous
84	84	16 place at least one clearly visible sign, printed in no less
85	85	17 than 24-point boldface type, which reads: "ILLINOIS LAW
86	86	18 PROHIBITS ANY SERVICE BUSINESS FROM DISCRIMINATING, WITH
87	87	19 RESPECT TO THE PRICE CHARGED FOR SERVICES OF SIMILAR OR LIKE
88	88	20 KIND, AGAINST A PERSON BECAUSE OF THE PERSON'S GENDER. A
89	89	21 COMPLETE PRICE LIST IS AVAILABLE UPON REQUEST."
90	90	22 (g) A service business that fails to correct a violation
91	91	23 of this Section within 30 days of receiving written notice of
92	92	24 the violation by the governmental entity that issued its
93	93	25 business license is liable for a civil penalty of $1,000.

105	105	1 Act, a municipality or county that issues business licenses
106	106	2 shall provide a business, at the time the business is issued
107	107	3 the license or when the license is renewed, written notice of
108	108	4 these provisions in English, Spanish, Chinese, Tagalog,
109	109	5 Polish, and Arabic. A municipality or county that issues
110	110	6 business licenses may increase the fee for that license in an
111	111	7 amount not to exceed the reasonable costs of providing this
112	112	8 written notice.
113	113	9 Section 20. Violation. A business service that violates
114	114	10 this Act, other than the requirements for a public notice in
115	115	11 Section 15, commits a civil rights violation within the
116	116	12 meaning of the Illinois Human Rights Act.
117	117	13 Section 90. The Illinois Human Rights Act is amended by
118	118	14 changing Section 6-102 as follows:

120	120	16 Sec. 6-102. Violations of other Acts. A person who
121	121	17 violates the Prevention of Gender-Based Discrimination in
122	122	18 Service Industries Act (except as otherwise specified in that
123	123	19 Act), Section 11-117-12.2 of the Illinois Municipal Code,
124	124	20 Section 224.05 of the Illinois Insurance Code, Section 8-201.5
125	125	21 of the Public Utilities Act, Sections 2-1401.1, 9-107.10,
126	126	22 9-107.11, and 15-1501.6 of the Code of Civil Procedure,
