Lilian Jimnez SYNOPSIS AS INTRODUCED: New Act775 ILCS 5/6-102 Creates the Prevention of Gender-Based Discrimination in Service Industries Act. Prohibits a service business from discriminating on the basis of gender. Defines "service business" as a commercial enterprise that focuses on providing various services to customers and has no tangible, physical characteristics or products. This includes, but is not limited to, hairstylists, barbers, tailors, dry cleaners, and laundries. Provides that nothing in the Act prohibits price differences based specifically upon the amount of time, difficulty, or cost of providing the services. Requires these service businesses (tailors or businesses providing aftermarket clothing alterations, barbershops or hair salons, dry cleaners and laundries providing services to individuals) to post a notice that states they don't discriminate on prices charged for services of similar or like kind on the basis of the person's gender and that a complete price list is available upon request. Amends the Illinois Human Rights Act to provide that a person who violates the Prevention of Gender-Based Discrimination in Service Industries Act commits a civil rights violation within the meaning of the Illinois Human Rights Act, except as otherwise specified. 1212 1 AN ACT concerning civil law.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 1. Short title. This Act may be cited as the
1616 5 Prevention of Gender-Based Discrimination in Service
1717 6 Industries Act.
1818 7 Section 5. Definitions. In this Act:
1919 8 "Service business" means a commercial enterprise that
2020 9 focuses on providing various services to the customers and has
2121 10 no tangible, physical characteristics or products. This
2222 11 includes, but is not limited to, hairstylists, barbers,
2323 12 tailors, dry cleaners, and laundries.
2424 13 "Standard service" means the 15 most frequently requested
2525 14 services provided by a service business.
2626 15 Section 10. Prohibited discrimination. A service business
2727 16 may not discriminate, with respect to the price charged for
2828 17 services of similar or like kind, against a person because of
2929 18 the person's gender. Nothing in this Act prohibits price
3030 19 differences based specifically upon the amount of time,
3131 20 difficulty, or cost of providing the services.

6969 1 (a) The following service businesses must clearly and
7070 2 conspicuously disclose to the public in writing the pricing
7171 3 for each standard service provided:
7272 4 (1) tailors or businesses providing aftermarket clothing
7373 5 alterations;
7474 6 (2) barbershops or hair salons; or
7575 7 (3) dry cleaners and laundries providing services to
7676 8 individuals.
7777 9 (b) The price list shall be posted in an area conspicuous
7878 10 to customers. Posted price lists shall be in no less than
7979 11 14-point boldface type and clearly and completely display
8080 12 pricing for every standard service offered by the business.
8181 13 (c) The service business shall provide the customer with a
8282 14 complete written price list upon request.
8383 15 (f) The service business shall display in a conspicuous
8484 16 place at least one clearly visible sign, printed in no less
8585 17 than 24-point boldface type, which reads: "ILLINOIS LAW
8686 18 PROHIBITS ANY SERVICE BUSINESS FROM DISCRIMINATING, WITH
8787 19 RESPECT TO THE PRICE CHARGED FOR SERVICES OF SIMILAR OR LIKE
8888 20 KIND, AGAINST A PERSON BECAUSE OF THE PERSON'S GENDER. A
8989 21 COMPLETE PRICE LIST IS AVAILABLE UPON REQUEST."
9090 22 (g) A service business that fails to correct a violation
9191 23 of this Section within 30 days of receiving written notice of
9292 24 the violation by the governmental entity that issued its
9393 25 business license is liable for a civil penalty of $1,000.
9494 26 (h) Commencing 6 months after the effective date of this

105105 1 Act, a municipality or county that issues business licenses
106106 2 shall provide a business, at the time the business is issued
107107 3 the license or when the license is renewed, written notice of
108108 4 these provisions in English, Spanish, Chinese, Tagalog,
109109 5 Polish, and Arabic. A municipality or county that issues
110110 6 business licenses may increase the fee for that license in an
111111 7 amount not to exceed the reasonable costs of providing this
112112 8 written notice.
113113 9 Section 20. Violation. A business service that violates
114114 10 this Act, other than the requirements for a public notice in
115115 11 Section 15, commits a civil rights violation within the
116116 12 meaning of the Illinois Human Rights Act.
117117 13 Section 90. The Illinois Human Rights Act is amended by
118118 14 changing Section 6-102 as follows:

120120 16 Sec. 6-102. Violations of other Acts. A person who
121121 17 violates the Prevention of Gender-Based Discrimination in
122122 18 Service Industries Act (except as otherwise specified in that
123123 19 Act), Section 11-117-12.2 of the Illinois Municipal Code,
124124 20 Section 224.05 of the Illinois Insurance Code, Section 8-201.5
125125 21 of the Public Utilities Act, Sections 2-1401.1, 9-107.10,
126126 22 9-107.11, and 15-1501.6 of the Code of Civil Procedure,
