13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The Fish and Aquatic Life Code is amended by
16	16	5 changing Section 20-45 as follows:

19	19	8 Sec. 20-45. License fees for residents. Fees for licenses
20	20	9 for residents of the State of Illinois shall be as follows:
21	21	10 (a) Except as otherwise provided in this Section, for
22	22	11 sport fishing devices as defined in Section 10-95 or
23	23	12 spearing devices as defined in Section 10-110, the fee is
24	24	13 $14.50 for individuals 16 to 64 years old, one-half of the
25	25	14 current fishing license fee for individuals age 65 or
26	26	15 older, and, commencing with the 2012 license year,
27	27	16 one-half of the current fishing license fee for resident
28	28	17 veterans of the United States Armed Forces after returning
29	29	18 from service abroad or mobilization by the President of

72	72	2 shall be made to the Department for the purpose of issuing
73	73	3 fishing licenses to resident veterans at a reduced fee.
74	74	4 (a-5) The fee for all sport fishing licenses shall be
75	75	5 $1 for residents over 75 years of age.
76	76	6 (b) All residents before using any commercial fishing
77	77	7 device shall obtain a commercial fishing license, the fee
78	78	8 for which shall be $60 and a resident fishing license, the
79	79	9 fee for which is $14.50. Each and every commercial device
80	80	10 used shall be licensed by a resident commercial fisherman
81	81	11 as follows:
82	82	12 (1) For each 100 lineal yards, or fraction
83	83	13 thereof, of seine the fee is $18. For each minnow
84	84	14 seine, minnow trap, or net for commercial purposes the
85	85	15 fee is $20.
86	86	16 (2) For each device to fish with a 100 hook trot
87	87	17 line device, basket trap, hoop net, or dip net the fee
88	88	18 is $3.
89	89	19 (3) When used in the waters of Lake Michigan, for
90	90	20 the first 2000 lineal feet, or fraction thereof, of
91	91	21 gill net the fee is $10; and for each 1000 additional
92	92	22 lineal feet, or fraction thereof, the fee is $10.
93	93	23 These fees shall apply to all gill nets in use in the
94	94	24 water or on drying reels on the shore.
95	95	25 (4) For each 100 lineal yards, or fraction
96	96	26 thereof, of gill net or trammel net the fee is $18.

107	107	1 (c) Residents of the State of Illinois may obtain a
108	108	2 sportsmen's combination license that shall entitle the
109	109	3 holder to the same non-commercial fishing privileges as
110	110	4 residents holding a license as described in subsection (a)
111	111	5 of this Section and to the same hunting privileges as
112	112	6 residents holding a license to hunt all species as
113	113	7 described in Section 3.1 of the Wildlife Code. No
114	114	8 sportsmen's combination license shall be issued to any
115	115	9 individual who would be ineligible for either the fishing
116	116	10 or hunting license separately. The sportsmen's combination
117	117	11 license fee shall be $25.50. For residents age 65 or
118	118	12 older, the fee is one-half of the fee charged for a
119	119	13 sportsmen's combination license. For resident veterans of
120	120	14 the United States Armed Forces after returning from
121	121	15 service abroad or mobilization by the President of the
122	122	16 United States as an active duty member of the United
123	123	17 States Armed Forces, the Illinois National Guard, or the
124	124	18 Reserves of the United States Armed Forces, the fee,
125	125	19 commencing with the 2012 license year, is one-half of the
126	126	20 fee charged for a sportsmen's combination license.

144	144	2 (d) For 24 hours of fishing by sport fishing devices
145	145	3 as defined in Section 10-95 or by spearing devices as
146	146	4 defined in Section 10-110 the fee is $5. This license does
147	147	5 not exempt the licensee from the requirement for a salmon
148	148	6 or inland trout stamp. The licenses provided for by this
149	149	7 subsection are not required for residents of the State of
150	150	8 Illinois who have obtained the license provided for in
151	151	9 subsection (a) of this Section.
152	152	10 (e) All residents before using any commercial mussel
153	153	11 device shall obtain a commercial mussel license, the fee
154	154	12 for which shall be $50.
155	155	13 (f) Residents of this State, upon establishing
156	156	14 residency as required by the Department, may obtain a
157	157	15 lifetime hunting or fishing license or lifetime
158	158	16 sportsmen's combination license which shall entitle the
159	159	17 holder to the same non-commercial fishing privileges as
160	160	18 residents holding a license as described in paragraph (a)
161	161	19 of this Section and to the same hunting privileges as
162	162	20 residents holding a license to hunt all species as
163	163	21 described in Section 3.1 of the Wildlife Code. No lifetime
164	164	22 sportsmen's combination license shall be issued to or
165	165	23 retained by any individual who would be ineligible for
166	166	24 either the fishing or hunting license separately, either
167	167	25 upon issuance, or in any year a violation would subject an
168	168	26 individual to have either or both fishing or hunting

179	179	1 privileges rescinded. The lifetime hunting and fishing
180	180	2 license fees shall be as follows:
181	181	3 (1) Lifetime fishing: 30 x the current fishing
182	182	4 license fee.
183	183	5 (2) Lifetime hunting: 30 x the current hunting
184	184	6 license fee.
185	185	7 (3) Lifetime sportsmen's combination license: 30 x
186	186	8 the current sportsmen's combination license fee.
187	187	9 Lifetime licenses shall not be refundable. A $10 fee shall
188	188	10 be charged for reissuing any lifetime license. The Department
189	189	11 may establish rules and regulations for the issuance and use
190	190	12 of lifetime licenses and may suspend or revoke any lifetime
191	191	13 license issued under this Section for violations of those
192	192	14 rules or regulations or other provisions under this Code or
193	193	15 the Wildlife Code, or a violation of the United States Code
194	194	16 that involves the taking, possessing, killing, harvesting,
195	195	17 transportation, selling, exporting, or importing any fish or
196	196	18 aquatic life protected by this Code or the taking, possessing,
197	197	19 killing, harvesting, transportation, selling, exporting, or
198	198	20 importing any fauna protected by the Wildlife Code when any
199	199	21 part of the United States Code violation occurred in Illinois.
200	200	22 Individuals under 16 years of age who possess a lifetime
201	201	23 hunting or sportsmen's combination license shall have in their
202	202	24 possession, while in the field, a certificate of competency as
203	203	25 required under Section 3.2 of the Wildlife Code. Any lifetime
204	204	26 license issued under this Section shall not exempt individuals

215	215	1 from obtaining additional stamps or permits required under the
216	216	2 provisions of this Code or the Wildlife Code. Individuals
217	217	3 required to purchase additional stamps shall sign the stamps
218	218	4 and have them in their possession while fishing or hunting
219	219	5 with a lifetime license. All fees received from the issuance
220	220	6 of lifetime licenses shall be deposited in the Fish and
221	221	7 Wildlife Endowment Fund.
222	222	8 Except for licenses issued under subsection (e) of this
223	223	9 Section, all licenses provided for in this Section shall
224	224	10 expire on March 31 of each year, except that the license
225	225	11 provided for in subsection (d) of this Section shall expire 24
226	226	12 hours after the effective date and time listed on the face of
227	227	13 the license.
228	228	14 All individuals required to have and failing to have the
229	229	15 license provided for in subsection (a) or (d) of this Section
230	230	16 shall be fined according to the provisions of Section 20-35 of
231	231	17 this Code.
232	232	18 All individuals required to have and failing to have the
233	233	19 licenses provided for in subsections (b) and (e) of this
234	234	20 Section shall be guilty of a Class B misdemeanor.
235	235	21 (g) For the purposes of this Section, "acceptable
236	236	22 verification" means official documentation from the Department
237	237	23 of Defense or the appropriate Major Command showing
238	238	24 mobilization dates or service abroad dates, including: (i) a
239	239	25 DD-214, (ii) a letter from the Illinois Department of Military
240	240	26 Affairs for members of the Illinois National Guard, (iii) a

252	252	2 Armed Forces Reserve, (iv) a letter from the Major Command

255	255	5 documentation that the Department, by administrative rule,
256	256	6 deems acceptable to establish dates of mobilization or service
257	257	7 abroad.
258	258	8 For the purposes of this Section, the term "service
259	259	9 abroad" means active duty service outside of the 50 United
260	260	10 States and the District of Columbia, and includes all active
261	261	11 duty service in territories and possessions of the United
262	262	12 States.

481	481	16 part of the United States Code violation occurred in Illinois.
482	482	17 Individuals under 16 years of age who possess a lifetime
483	483	18 hunting or sportsmen's combination license shall have in their
484	484	19 possession, while in the field, a certificate of competency as
485	485	20 required under Section 3.2 of the Wildlife Code. Any lifetime
486	486	21 license issued under this Section shall not exempt individuals
487	487	22 from obtaining additional stamps or permits required under the
488	488	23 provisions of this Code or the Wildlife Code. Individuals
489	489	24 required to purchase additional stamps shall sign the stamps

517	517	16 Section shall be fined according to the provisions of Section
518	518	17 20-35 of this Code.

520	520	19 licenses provided for in subsections (b) and (e) of this
521	521	20 Section shall be guilty of a Class B misdemeanor.
522	522	21 (g) For the purposes of this Section, "acceptable
523	523	22 verification" means official documentation from the Department
524	524	23 of Defense or the appropriate Major Command showing
525	525	24 mobilization dates or service abroad dates, including: (i) a
526	526	25 DD-214, (ii) a letter from the Illinois Department of Military

916	916	22 shall receive a stamp. The fee for a State Habitat Stamp shall

919	919	25 Code, the stamp shall be signed by the person or affixed to his

932	932	2 Nothing in this Section shall be construed as to require
933	933	3 the purchase of more than one State Habitat Stamp by any person
934	934	4 in any one license year.
935	935	5 The fees for State Pheasant Stamps and State Furbearer
936	936	6 Stamps shall be waived for residents over 75 years of age.
937	937	7 The Department shall furnish the holders of hunting
938	938	8 licenses and stamps with an insignia as evidence of possession
939	939	9 of license, or license and stamp, as the Department may
940	940	10 consider advisable. The insignia shall be exhibited and used
941	941	11 as the Department may order.
942	942	12 All other hunting licenses and all State stamps shall
943	943	13 expire upon March 31 of each year. Three-year hunting licenses
944	944	14 shall expire on March 31 of the 2nd year after the year in
945	945	15 which the license is issued.
946	946	16 Every person holding any license, permit, or stamp issued
947	947	17 under the provisions of this Act shall have it in his
948	948	18 possession for immediate presentation for inspection to the
949	949	19 officers and authorized employees of the Department, any
950	950	20 sheriff, deputy sheriff, or any other peace officer making a
951	951	21 demand for it. This provision shall not apply to Department
952	952	22 owned or managed sites where it is required that all hunters
953	953	23 deposit their license, permit, or Firearm Owner's
954	954	24 Identification Card at the check station upon entering the
955	955	25 hunting areas.
956	956	26 For the purposes of this Section, "acceptable

972	972	6 letter from the Regional Reserve Command for members of the
973	973	7 Armed Forces Reserve, (iv) a letter from the Major Command
974	974	8 covering Illinois for active duty members, (v) personnel

976	976	10 documentation that the Department, by administrative rule,
977	977	11 deems acceptable to establish dates of mobilization or service
978	978	12 abroad.
979	979	13 For the purposes of this Section, the term "service
980	980	14 abroad" means active duty service outside of the 50 United
981	981	15 States and the District of Columbia, and includes all active
982	982	16 duty service in territories and possessions of the United
983	983	17 States.
