1212 1 AN ACT concerning fees.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Fish and Aquatic Life Code is amended by
1616 5 changing Section 20-45 as follows:

1919 8 Sec. 20-45. License fees for residents. Fees for licenses
2020 9 for residents of the State of Illinois shall be as follows:
2121 10 (a) Except as otherwise provided in this Section, for
2222 11 sport fishing devices as defined in Section 10-95 or
2323 12 spearing devices as defined in Section 10-110, the fee is
2424 13 $14.50 for individuals 16 to 64 years old, one-half of the
2525 14 current fishing license fee for individuals age 65 or
2626 15 older, and, commencing with the 2012 license year,
2727 16 one-half of the current fishing license fee for resident
2828 17 veterans of the United States Armed Forces after returning
2929 18 from service abroad or mobilization by the President of
3030 19 the United States as an active duty member of the United
3131 20 States Armed Forces, the Illinois National Guard, or the
3232 21 Reserves of the United States Armed Forces. Veterans must

7171 1 rule the procedure by which such verification of service

7474 4 (a-5) The fee for all sport fishing licenses shall be

7676 6 (b) All residents before using any commercial fishing
7777 7 device shall obtain a commercial fishing license, the fee
7878 8 for which shall be $60 and a resident fishing license, the
7979 9 fee for which is $14.50. Each and every commercial device
8080 10 used shall be licensed by a resident commercial fisherman
8181 11 as follows:
8282 12 (1) For each 100 lineal yards, or fraction
8383 13 thereof, of seine the fee is $18. For each minnow
8484 14 seine, minnow trap, or net for commercial purposes the
8585 15 fee is $20.
8686 16 (2) For each device to fish with a 100 hook trot
8787 17 line device, basket trap, hoop net, or dip net the fee
8888 18 is $3.
8989 19 (3) When used in the waters of Lake Michigan, for
9090 20 the first 2000 lineal feet, or fraction thereof, of
9191 21 gill net the fee is $10; and for each 1000 additional
9292 22 lineal feet, or fraction thereof, the fee is $10.
9393 23 These fees shall apply to all gill nets in use in the
9494 24 water or on drying reels on the shore.
9595 25 (4) For each 100 lineal yards, or fraction
9696 26 thereof, of gill net or trammel net the fee is $18.

118118 12 older, the fee is one-half of the fee charged for a
119119 13 sportsmen's combination license. For resident veterans of
120120 14 the United States Armed Forces after returning from
121121 15 service abroad or mobilization by the President of the
122122 16 United States as an active duty member of the United
123123 17 States Armed Forces, the Illinois National Guard, or the
124124 18 Reserves of the United States Armed Forces, the fee,
125125 19 commencing with the 2012 license year, is one-half of the
126126 20 fee charged for a sportsmen's combination license.
127127 21 Veterans must provide to the Department acceptable
128128 22 verification of their service. The Department shall

144144 2 (d) For 24 hours of fishing by sport fishing devices
145145 3 as defined in Section 10-95 or by spearing devices as
146146 4 defined in Section 10-110 the fee is $5. This license does
147147 5 not exempt the licensee from the requirement for a salmon
148148 6 or inland trout stamp. The licenses provided for by this
149149 7 subsection are not required for residents of the State of
150150 8 Illinois who have obtained the license provided for in
151151 9 subsection (a) of this Section.
152152 10 (e) All residents before using any commercial mussel
153153 11 device shall obtain a commercial mussel license, the fee
154154 12 for which shall be $50.
155155 13 (f) Residents of this State, upon establishing
156156 14 residency as required by the Department, may obtain a
157157 15 lifetime hunting or fishing license or lifetime
158158 16 sportsmen's combination license which shall entitle the
159159 17 holder to the same non-commercial fishing privileges as
160160 18 residents holding a license as described in paragraph (a)
161161 19 of this Section and to the same hunting privileges as
162162 20 residents holding a license to hunt all species as
163163 21 described in Section 3.1 of the Wildlife Code. No lifetime
164164 22 sportsmen's combination license shall be issued to or
165165 23 retained by any individual who would be ineligible for
166166 24 either the fishing or hunting license separately, either
167167 25 upon issuance, or in any year a violation would subject an
168168 26 individual to have either or both fishing or hunting

179179 1 privileges rescinded. The lifetime hunting and fishing
180180 2 license fees shall be as follows:
181181 3 (1) Lifetime fishing: 30 x the current fishing
182182 4 license fee.
183183 5 (2) Lifetime hunting: 30 x the current hunting
184184 6 license fee.
185185 7 (3) Lifetime sportsmen's combination license: 30 x
186186 8 the current sportsmen's combination license fee.
187187 9 Lifetime licenses shall not be refundable. A $10 fee shall
188188 10 be charged for reissuing any lifetime license. The Department
189189 11 may establish rules and regulations for the issuance and use
190190 12 of lifetime licenses and may suspend or revoke any lifetime
191191 13 license issued under this Section for violations of those
192192 14 rules or regulations or other provisions under this Code or
193193 15 the Wildlife Code, or a violation of the United States Code
194194 16 that involves the taking, possessing, killing, harvesting,
195195 17 transportation, selling, exporting, or importing any fish or
196196 18 aquatic life protected by this Code or the taking, possessing,
197197 19 killing, harvesting, transportation, selling, exporting, or
198198 20 importing any fauna protected by the Wildlife Code when any
199199 21 part of the United States Code violation occurred in Illinois.
200200 22 Individuals under 16 years of age who possess a lifetime
201201 23 hunting or sportsmen's combination license shall have in their
202202 24 possession, while in the field, a certificate of competency as
203203 25 required under Section 3.2 of the Wildlife Code. Any lifetime
204204 26 license issued under this Section shall not exempt individuals

215215 1 from obtaining additional stamps or permits required under the
216216 2 provisions of this Code or the Wildlife Code. Individuals
217217 3 required to purchase additional stamps shall sign the stamps
218218 4 and have them in their possession while fishing or hunting
219219 5 with a lifetime license. All fees received from the issuance
220220 6 of lifetime licenses shall be deposited in the Fish and
221221 7 Wildlife Endowment Fund.
222222 8 Except for licenses issued under subsection (e) of this
223223 9 Section, all licenses provided for in this Section shall
224224 10 expire on March 31 of each year, except that the license
225225 11 provided for in subsection (d) of this Section shall expire 24
226226 12 hours after the effective date and time listed on the face of
227227 13 the license.
228228 14 All individuals required to have and failing to have the
229229 15 license provided for in subsection (a) or (d) of this Section
230230 16 shall be fined according to the provisions of Section 20-35 of
231231 17 this Code.
232232 18 All individuals required to have and failing to have the
233233 19 licenses provided for in subsections (b) and (e) of this
234234 20 Section shall be guilty of a Class B misdemeanor.
235235 21 (g) For the purposes of this Section, "acceptable
236236 22 verification" means official documentation from the Department
237237 23 of Defense or the appropriate Major Command showing
238238 24 mobilization dates or service abroad dates, including: (i) a
239239 25 DD-214, (ii) a letter from the Illinois Department of Military
240240 26 Affairs for members of the Illinois National Guard, (iii) a

251251 1 letter from the Regional Reserve Command for members of the
252252 2 Armed Forces Reserve, (iv) a letter from the Major Command
253253 3 covering Illinois for active duty members, (v) personnel
254254 4 records for mobilized State employees, and (vi) any other
255255 5 documentation that the Department, by administrative rule,
256256 6 deems acceptable to establish dates of mobilization or service
257257 7 abroad.
258258 8 For the purposes of this Section, the term "service
259259 9 abroad" means active duty service outside of the 50 United
260260 10 States and the District of Columbia, and includes all active
261261 11 duty service in territories and possessions of the United
262262 12 States.

486486 21 license issued under this Section shall not exempt individuals

488488 23 provisions of this Code or the Wildlife Code. Individuals
489489 24 required to purchase additional stamps shall sign the stamps

974974 8 covering Illinois for active duty members, (v) personnel

977977 11 deems acceptable to establish dates of mobilization or service

979979 13 For the purposes of this Section, the term "service
980980 14 abroad" means active duty service outside of the 50 United
981981 15 States and the District of Columbia, and includes all active
982982 16 duty service in territories and possessions of the United
