3	14		1 AN ACT concerning regulation.
4	15		2 Be it enacted by the People of the State of Illinois,
5	16		3 represented in the General Assembly:
6	17		4 Section 5. The Illinois Funeral or Burial Funds Act is
7	18		5 amended by changing Sections 1, 1a, and 10 and by adding
8	19		6 Section 2c as follows:

10	21		8 Sec. 1. Payment under pre-need contract. Except as
11	22		9 otherwise provided in this Section, all sales proceeds paid to
12	23		10 any person, partnership, association or corporation with
13	24		11 respect to merchandise or services covered by this Act, upon
14	25		12 any agreement or contract, or any series or combination of
15	26		13 agreements or contracts, which has for a purpose the
16	27		14 furnishing or performance of funeral services, or the
17	28		15 furnishing or delivery of any personal property, merchandise,
18	29		16 or services of any nature in connection with the final
19	30		17 disposition of a dead human body, including, but not limited
20	31		18 to, outer burial containers, urns, combination casket-vault
21	32		19 units, caskets and clothing, for future delivery use at a time
22	33		20 determinable by the death of the person or persons whose body
23	34		21 or bodies are to be so disposed of, shall be held to be trust
24	35		22 funds, and shall be placed in trust in accordance with
25	36		23 Sections 1b and 2, or shall be used to purchase life insurance

34	77		1 or annuities in accordance with Section 2a. The person,
35	78		2 partnership, association or corporation receiving said
36	79		3 payments under a pre-need contract is hereby declared to be a
37	80		4 trustee thereof until deposits of funds are made in accordance
38	81		5 with Section 1b or 2a of this Act.
39	82		6 Nothing in this Act shall be construed to prohibit the
40	83		7 inclusion of outer burial containers in sales contracts under
41	84		8 the Illinois Pre-Need Cemetery Sales Act.

44	87		11 Sec. 1a. For the purposes of this Act, the following terms
45	88		12 shall have the meanings specified, unless the context clearly
46	89		13 requires another meaning:
47	90		14 "Beneficiary" means the person specified in the pre-need
48	91		15 contract upon whose death funeral services or merchandise
49	92		16 shall be provided or delivered.
50	93		17 "Licensee" means a seller of a pre-need contract who has
51	94		18 been licensed by the Comptroller under this Act.
52	95		19 "Outer burial container" means any container made of
53	96		20 concrete, steel, wood, fiberglass or similar material, used
54	97		21 solely at the interment site, and designed and used
55	98		22 exclusively to surround or enclose a separate casket and to
56	99		23 support the earth above such casket, commonly known as a
57	100		24 burial vault, grave box or grave liner, but not including a
58	101		25 lawn crypt as defined in the Illinois Pre-need Cemetery Sales

70	113		2 "Parent company" means a corporation owning more than 12
71	114		3 cemeteries or funeral homes in more than one state.
72	115		4 "Person" means any person, partnership, association,
73	116		5 corporation, or other entity.
74	117		6 "Pre-need contract" means any agreement or contract, or
75	118		7 any series or combination of agreements or contracts, whether
76	119		8 funded by trust deposits or life insurance policies or
77	120		9 annuities, which has for a purpose the furnishing or
78	121		10 performance of funeral services or the furnishing or delivery
79	122		11 of any personal property, merchandise, or services of any
80	123		12 nature in connection with the final disposition of a dead
81	124		13 human body. Nothing in this Act is intended to regulate the
82	125		14 content of a life insurance policy or a tax-deferred annuity.
83	126		15 "Provider" means a person who is obligated for furnishing
84	127		16 or performing funeral services or the furnishing or delivery
85	128		17 of any personal property, merchandise, or services of any
86	129		18 nature in connection with the final disposition of a dead
87	130		19 human body.
88	131		20 "Purchaser" means the person who originally paid the money
89	132		21 under or in connection with a pre-need contract.
90	133		22 "Sales proceeds" means the entire amount paid to a seller,
91	134		23 exclusive of sales taxes paid by the seller, finance charges
92	135		24 paid by the purchaser, and credit life, accident or disability
93	136		25 insurance premiums, upon any agreement or contract, or series
94	137		26 or combination of agreements or contracts, for the purpose of

105	148		1 performing funeral services or furnishing personal property,
106	149		2 merchandise, or services of any nature in connection with the
107	150		3 final disposition of a dead human body, including, but not
108	151		4 limited to, the retail price paid for such services and
109	152		5 personal property and merchandise.
110	153		6 "Purchase price" means sales proceeds less finance charges
111	154		7 on retail installment contracts.
112	155		8 "Seller" means the person who sells or offers to sell the
113	156		9 pre-need contract to a purchaser, whether funded by a trust
114	157		10 agreement, life insurance policy, or tax-deferred annuity.
115	158		11 "Transportation protection agreement" means an agreement
116	159		12 that primarily provides or arranges for services related to
117	160		13 the preparation for the purpose of transportation and
118	161		14 subsequent transportation of human remains or cremated
119	162		15 remains.
120	163		16 "Trustee" means a person authorized to hold funds under
121	164		17 this Act.
