4	4	2 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
5	5	3 HUNDRED THIRD GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
6	6	4 the Rules of the House of Representatives of the 103rd General
7	7	5 Assembly are amended by changing Rules 10 and 18 as follows:
8	8	6 (House Rule 10)
9	9	7 10. Committees.
10	10	8 (a) The committees of the House are: (i) the standing
11	11	9 committees listed in Rule 11; (ii) the special committees
12	12	10 created under Rule 13; (iii) any subcommittees created under
13	13	11 these Rules; (iv) the Rules Committee created under Rule 15;
14	14	12 (v) any committees created under Article X or Article XII; and
15	15	13 (vi) any Committee of the Whole. Committees of the Whole shall
16	16	14 consist of all Representatives.
17	17	15 (b) Except as otherwise provided in this Rule and subject
18	18	16 to Rules 12 and 13, all committees shall have a Chairperson and
19	19	17 Minority Spokesperson, who may be of the same political party.
20	20	18 A Minority Spokesperson may not be appointed until after a
21	21	19 Chairperson has been appointed. Standing committees that have
22	22	20 Co-Chairpersons from different political parties shall not
23	23	21 have a Minority Spokesperson. Special committees that have
24	24	22 Co-Chairpersons from different political parties shall not
25	25	23 have a Minority Spokesperson. No member may be appointed to

34	34	1 serve as a Chairperson, Minority Spokesperson, or
35	35	2 Co-Chairperson of any committee unless the member is serving
36	36	3 in at least his or her third term as a member of the General
37	37	4 Assembly, including any terms in which the member was
38	38	5 appointed to fill a vacancy in the office of Representative or
39	39	6 Senator. Each committee may have a Vice-Chairperson appointed
40	40	7 by the Speaker. The number of majority caucus members and
41	41	8 minority caucus members of all committees, except the Rules
42	42	9 Committee created under Rule 15 and as otherwise provided by
43	43	10 these Rules, shall be determined by the Speaker. The Speaker
44	44	11 shall file a notice with the Clerk setting forth the number of
45	45	12 majority caucus and minority caucus members of each committee,
46	46	13 which shall be journalized. A member may be temporarily
47	47	14 replaced on a committee if the member is otherwise
48	48	15 unavailable. The appointment of a member as a temporary
49	49	16 replacement shall remain in effect until (i) the permanent
50	50	17 member who was replaced is in attendance at the hearing and has
51	51	18 been added to the committee roll, (ii) the appointing
52	52	19 authority withdraws the temporary replacement appointment or
53	53	20 appoints a different member to serve as the temporary
54	54	21 replacement, or (iii) the hearing is adjourned or the
55	55	22 authority has expired for a re-convened hearing following a
56	56	23 recess of the committee, whichever occurs first. All leaders
57	57	24 are non-voting ex-officio members of each standing committee
58	58	25 and each special committee, except that the leaders may also
59	59	26 be appointed to standing committees or special committees as

70	70	1 voting members. The Speaker may also appoint any member of the
71	71	2 majority caucus, and the Minority Leader may appoint any
72	72	3 member of the minority caucus, as a non-voting member of any
73	73	4 standing committee or special committee.
74	74	5 (c) The Chairperson of a committee has the authority to
75	75	6 call the committee to order, designate which legislative
76	76	7 measures and subject matters posted for hearing shall be taken
77	77	8 up and in what order, order a record vote to be taken on each
78	78	9 legislative measure called for a vote, preserve order and
79	79	10 decorum during committee meetings, establish procedural rules
80	80	11 (subject to approval by the Speaker) governing the
81	81	12 presentation and consideration of legislative measures and
82	82	13 subject matters, and generally supervise the affairs of the
83	83	14 committee. Any such procedural rules must be filed with the
84	84	15 Clerk and copies provided to all members of the committee. The
85	85	16 Vice-Chairperson of a committee or other member of the
86	86	17 committee from the majority caucus may preside over its
87	87	18 meetings in the absence or at the direction of the
88	88	19 Chairperson. In the case of standing or special committees
89	89	20 with Co-Chairpersons from different political parties, the
90	90	21 "Chairperson" for purposes of this Rule is the Co-Chairperson
91	91	22 from the majority caucus.
92	92	23 (c-5) Notwithstanding any other provision of these Rules,
93	93	24 the Chairperson of a committee shall order a hearing to be held
94	94	25 and a record vote to be taken on each bill that is referred to
95	95	26 the committee as a member-sponsored initiative under Rule 18.

107	107	2 (d) A vacancy on a committee, or in the position of
108	108	3 Chairperson, Co-Chairperson, Vice-Chairperson, or Minority
109	109	4 Spokesperson on a committee, exists when a member resigns from
110	110	5 the position, ceases to be a Representative, or changes
111	111	6 political party affiliation. Resignations and notices of a
112	112	7 change in political party affiliation shall be made in writing
113	113	8 to the Clerk, who shall promptly notify the Speaker and
114	114	9 Minority Leader. Replacement members shall be of the same
115	115	10 political party as that of the member who resigns, and shall be
116	116	11 appointed in the same manner as the original appointment,
117	117	12 except that in the case of a vacancy in the position of
118	118	13 Chairperson or Co-Chairperson, the replacement member need not
119	119	14 be from the same political party. The Speaker or Minority
120	120	15 Leader may appoint a temporary replacement to fill a vacancy
121	121	16 until such time as a permanent member has been appointed. In
122	122	17 the case of vacancies on subcommittees, the parent committee
123	123	18 shall fill the vacancy in the same manner as the original
124	124	19 appointment.
125	125	20 (e) The Chairperson of a committee has the authority to
126	126	21 call meetings of that committee, subject to the approval of
127	127	22 the Speaker. In the case of standing or special committees
128	128	23 with Co-Chairpersons from different political parties, the
129	129	24 Co-Chairperson from the majority caucus has the authority to
130	130	25 call meetings of the special committee, subject to the
131	131	26 approval of the Speaker. Except as otherwise provided by these

144	144	3 (f) Except for those provisions that may not be suspended,

149	149	8 18. Referrals to Committees.
150	150	9 (a) All House bills and Senate bills, after being
151	151	10 initially read by the Clerk, are automatically referred to the
152	152	11 Rules Committee.
153	153	12 (b) The Rules Committee may refer any such bill before it
154	154	13 to a standing committee or a special committee. During
155	155	14 even-numbered years, the Rules Committee shall refer to a
156	156	15 standing committee or a special committee only appropriation
157	157	16 bills implementing the budget and bills deemed by the Rules
158	158	17 Committee, by the affirmative vote of a majority of those
159	159	18 appointed, to be of an emergency nature or to be of substantial
160	160	19 importance to the operation of government. This subsection (b)
161	161	20 applies equally to House Bills and Senate Bills introduced
162	162	21 into or received by the House.
163	163	22 (b-5) Notwithstanding subsection (b), the Rules Committee
164	164	23 may refer any legislative measure to a joint committee of the
165	165	24 House and Senate created by joint resolution. That joint

176	176	1 committee shall report back to the Rules Committee any
177	177	2 recommendation for action made by that joint committee. The
178	178	3 Rules Committee may, at any time, however, refer the
179	179	4 legislative measure to a standing or special committee of the
180	180	5 House.
181	181	6 (c) The Chairperson of a standing committee or a special
182	182	7 committee may refer a subject matter or a legislative measure
183	183	8 pending in that committee to a subcommittee of that committee,
184	184	9 regardless of whether the subject matter or legislative
185	185	10 measure has been posted for hearing.
186	186	11 (d) All legislative measures favorably reported by a
187	187	12 standing committee or a special committee, or discharged from
188	188	13 a standing committee or a special committee under Rule 58,
189	189	14 shall be referred to the House and placed on the appropriate
190	190	15 order of business, which shall appear on the Daily Calendar.
191	191	16 (e) All committee amendments, floor amendments, joint
192	192	17 action motions for final action, conference committee reports,
193	193	18 and motions to table committee amendments, upon filing with
194	194	19 the Clerk, are automatically referred to the Rules Committee.
195	195	20 The Rules Committee may refer any committee amendment to the
196	196	21 standing committee or the special committee to which the bill
197	197	22 or resolution it amends has been referred for its review and
198	198	23 consideration. The Rules Committee may refer any floor
199	199	24 amendment, joint action motion for final action, conference
200	200	25 committee report, or motion to table a committee amendment to
201	201	26 the House or to a standing committee or a special committee for

212	212	1 its review and consideration. Any floor amendment, joint
213	213	2 action motion for final action, conference committee report,
214	214	3 or motion to table a committee amendment that is not referred
215	215	4 to the House by, or discharged from, the Rules Committee is out
216	216	5 of order, except that any floor amendment, joint action motion
217	217	6 for final action, conference committee report, or motion to
218	218	7 table a committee amendment favorably reported by, or
219	219	8 discharged from, a standing committee or a special committee
220	220	9 is deemed referred to the House by the Rules Committee for
221	221	10 purposes of this Rule.
222	222	11 (f) The Rules Committee may at any time refer or re-refer a
223	223	12 legislative measure from a committee to a Committee of the
224	224	13 Whole or to any other committee. If a bill or resolution is
225	225	14 re-referred from a standing or special committee to a
226	226	15 Committee of the Whole or to any other committee pursuant to
227	227	16 this Rule, any committee amendments pending in the standing or
228	228	17 special committee shall be automatically re-referred with the
229	229	18 bill or resolution.
230	230	19 (g) Notwithstanding any other provision of these Rules,
231	231	20 any bill pending before the Rules Committee shall be
232	232	21 immediately discharged and referred to a standing committee,
233	233	22 special committee, or order of the Daily Calendar, as provided
234	234	23 in this Rule, if the Principal Sponsor of the bill files a
235	235	24 motion that is signed by no less than three-fifths of the
236	236	25 members of both the majority and minority caucuses, provided
237	237	26 each member signing the motion is a sponsor of the underlying

248	248	1 bill subject to the motion and the motion specifies the
249	249	2 appropriate standing committee, special committee, or order on
250	250	3 the Daily Calendar to which the bill shall be referred. Such a
251	251	4 motion shall be filed, in writing, with the Clerk. All other
252	252	5 legislative measures may be discharged from the Rules
253	253	6 Committee only by unanimous consent of the House. A bill or
254	254	7 resolution discharged from the Rules Committee shall be
255	255	8 referred as follows: (i) a bill or resolution that was not
256	256	9 previously referred shall be referred to the standing
257	257	10 committee or special committee designated on the motion,
258	258	11 subject to the notice requirement of Rule 21; (ii) a bill or
259	259	12 resolution re-referred to the Rules Committee from a standing
260	260	13 committee or special committee shall be re-referred to that
261	261	14 committee, subject to the notice requirement of Rule 21; and
262	262	15 (iii) a bill or resolution re-referred to the Rules Committee
263	263	16 from an order of business on the Daily Calendar shall be
264	264	17 re-referred to the same order of business, provided the bill
265	265	18 or resolution shall be carried on the Daily Calendar for at
266	266	19 least one legislative day prior to consideration by the House.
267	267	20 Legislative measures, other than bills or resolutions, that
268	268	21 are discharged from the Rules Committee shall be referred as
269	269	22 follows: (i) an amendment, joint action motion for final
270	270	23 action, or conference committee report shall be referred to
271	271	24 the committee that considered the underlying bill or
272	272	25 resolution and (ii) any other legislative measure shall be
