66 4 the Rules of the House of Representatives of the 103rd General
77 5 Assembly are amended by changing Rules 10 and 18 as follows:
88 6 (House Rule 10)
99 7 10. Committees.
1010 8 (a) The committees of the House are: (i) the standing
1111 9 committees listed in Rule 11; (ii) the special committees
1212 10 created under Rule 13; (iii) any subcommittees created under
1313 11 these Rules; (iv) the Rules Committee created under Rule 15;
1414 12 (v) any committees created under Article X or Article XII; and
1515 13 (vi) any Committee of the Whole. Committees of the Whole shall
1616 14 consist of all Representatives.
1717 15 (b) Except as otherwise provided in this Rule and subject
1818 16 to Rules 12 and 13, all committees shall have a Chairperson and
1919 17 Minority Spokesperson, who may be of the same political party.
2020 18 A Minority Spokesperson may not be appointed until after a
2121 19 Chairperson has been appointed. Standing committees that have
2222 20 Co-Chairpersons from different political parties shall not
2323 21 have a Minority Spokesperson. Special committees that have
2424 22 Co-Chairpersons from different political parties shall not
2525 23 have a Minority Spokesperson. No member may be appointed to

3434 1 serve as a Chairperson, Minority Spokesperson, or
3535 2 Co-Chairperson of any committee unless the member is serving
3636 3 in at least his or her third term as a member of the General
3737 4 Assembly, including any terms in which the member was
3838 5 appointed to fill a vacancy in the office of Representative or
3939 6 Senator. Each committee may have a Vice-Chairperson appointed
4040 7 by the Speaker. The number of majority caucus members and
4141 8 minority caucus members of all committees, except the Rules
4242 9 Committee created under Rule 15 and as otherwise provided by
4343 10 these Rules, shall be determined by the Speaker. The Speaker
4444 11 shall file a notice with the Clerk setting forth the number of
4545 12 majority caucus and minority caucus members of each committee,
4646 13 which shall be journalized. A member may be temporarily
4747 14 replaced on a committee if the member is otherwise
4848 15 unavailable. The appointment of a member as a temporary
4949 16 replacement shall remain in effect until (i) the permanent
5050 17 member who was replaced is in attendance at the hearing and has
5151 18 been added to the committee roll, (ii) the appointing
5252 19 authority withdraws the temporary replacement appointment or
5353 20 appoints a different member to serve as the temporary
5454 21 replacement, or (iii) the hearing is adjourned or the
5555 22 authority has expired for a re-convened hearing following a
5656 23 recess of the committee, whichever occurs first. All leaders
5757 24 are non-voting ex-officio members of each standing committee
5858 25 and each special committee, except that the leaders may also
5959 26 be appointed to standing committees or special committees as

7070 1 voting members. The Speaker may also appoint any member of the
7171 2 majority caucus, and the Minority Leader may appoint any
7272 3 member of the minority caucus, as a non-voting member of any
7373 4 standing committee or special committee.
7474 5 (c) The Chairperson of a committee has the authority to
7575 6 call the committee to order, designate which legislative
7676 7 measures and subject matters posted for hearing shall be taken
7777 8 up and in what order, order a record vote to be taken on each
7878 9 legislative measure called for a vote, preserve order and
7979 10 decorum during committee meetings, establish procedural rules
8080 11 (subject to approval by the Speaker) governing the
8181 12 presentation and consideration of legislative measures and
8282 13 subject matters, and generally supervise the affairs of the
8383 14 committee. Any such procedural rules must be filed with the
8484 15 Clerk and copies provided to all members of the committee. The
8585 16 Vice-Chairperson of a committee or other member of the
8686 17 committee from the majority caucus may preside over its
8787 18 meetings in the absence or at the direction of the
8888 19 Chairperson. In the case of standing or special committees
8989 20 with Co-Chairpersons from different political parties, the
9090 21 "Chairperson" for purposes of this Rule is the Co-Chairperson
9191 22 from the majority caucus.
9292 23 (c-5) Notwithstanding any other provision of these Rules,
9393 24 the Chairperson of a committee shall order a hearing to be held
9494 25 and a record vote to be taken on each bill that is referred to
9595 26 the committee as a member-sponsored initiative under Rule 18.

106106 1 This subsection (c-5) may not be suspended.
107107 2 (d) A vacancy on a committee, or in the position of
108108 3 Chairperson, Co-Chairperson, Vice-Chairperson, or Minority
109109 4 Spokesperson on a committee, exists when a member resigns from
110110 5 the position, ceases to be a Representative, or changes
111111 6 political party affiliation. Resignations and notices of a
112112 7 change in political party affiliation shall be made in writing
113113 8 to the Clerk, who shall promptly notify the Speaker and
114114 9 Minority Leader. Replacement members shall be of the same
115115 10 political party as that of the member who resigns, and shall be
116116 11 appointed in the same manner as the original appointment,
117117 12 except that in the case of a vacancy in the position of
118118 13 Chairperson or Co-Chairperson, the replacement member need not
119119 14 be from the same political party. The Speaker or Minority
120120 15 Leader may appoint a temporary replacement to fill a vacancy
121121 16 until such time as a permanent member has been appointed. In
122122 17 the case of vacancies on subcommittees, the parent committee
123123 18 shall fill the vacancy in the same manner as the original
124124 19 appointment.
125125 20 (e) The Chairperson of a committee has the authority to
126126 21 call meetings of that committee, subject to the approval of
127127 22 the Speaker. In the case of standing or special committees
128128 23 with Co-Chairpersons from different political parties, the
129129 24 Co-Chairperson from the majority caucus has the authority to
130130 25 call meetings of the special committee, subject to the

149149 8 18. Referrals to Committees.
150150 9 (a) All House bills and Senate bills, after being
151151 10 initially read by the Clerk, are automatically referred to the
152152 11 Rules Committee.
153153 12 (b) The Rules Committee may refer any such bill before it
154154 13 to a standing committee or a special committee. During
155155 14 even-numbered years, the Rules Committee shall refer to a
156156 15 standing committee or a special committee only appropriation
157157 16 bills implementing the budget and bills deemed by the Rules
158158 17 Committee, by the affirmative vote of a majority of those
159159 18 appointed, to be of an emergency nature or to be of substantial
160160 19 importance to the operation of government. This subsection (b)
161161 20 applies equally to House Bills and Senate Bills introduced
162162 21 into or received by the House.
163163 22 (b-5) Notwithstanding subsection (b), the Rules Committee
164164 23 may refer any legislative measure to a joint committee of the
165165 24 House and Senate created by joint resolution. That joint

176176 1 committee shall report back to the Rules Committee any
177177 2 recommendation for action made by that joint committee. The
178178 3 Rules Committee may, at any time, however, refer the
179179 4 legislative measure to a standing or special committee of the
180180 5 House.
181181 6 (c) The Chairperson of a standing committee or a special
182182 7 committee may refer a subject matter or a legislative measure
183183 8 pending in that committee to a subcommittee of that committee,
184184 9 regardless of whether the subject matter or legislative
185185 10 measure has been posted for hearing.
186186 11 (d) All legislative measures favorably reported by a
187187 12 standing committee or a special committee, or discharged from
188188 13 a standing committee or a special committee under Rule 58,
189189 14 shall be referred to the House and placed on the appropriate
190190 15 order of business, which shall appear on the Daily Calendar.
191191 16 (e) All committee amendments, floor amendments, joint
192192 17 action motions for final action, conference committee reports,
193193 18 and motions to table committee amendments, upon filing with
194194 19 the Clerk, are automatically referred to the Rules Committee.
195195 20 The Rules Committee may refer any committee amendment to the
196196 21 standing committee or the special committee to which the bill
197197 22 or resolution it amends has been referred for its review and
198198 23 consideration. The Rules Committee may refer any floor
199199 24 amendment, joint action motion for final action, conference
200200 25 committee report, or motion to table a committee amendment to
201201 26 the House or to a standing committee or a special committee for

212212 1 its review and consideration. Any floor amendment, joint
213213 2 action motion for final action, conference committee report,
214214 3 or motion to table a committee amendment that is not referred
215215 4 to the House by, or discharged from, the Rules Committee is out
216216 5 of order, except that any floor amendment, joint action motion
217217 6 for final action, conference committee report, or motion to
218218 7 table a committee amendment favorably reported by, or
219219 8 discharged from, a standing committee or a special committee
220220 9 is deemed referred to the House by the Rules Committee for
221221 10 purposes of this Rule.
222222 11 (f) The Rules Committee may at any time refer or re-refer a
223223 12 legislative measure from a committee to a Committee of the
224224 13 Whole or to any other committee. If a bill or resolution is
225225 14 re-referred from a standing or special committee to a
226226 15 Committee of the Whole or to any other committee pursuant to
227227 16 this Rule, any committee amendments pending in the standing or
228228 17 special committee shall be automatically re-referred with the
229229 18 bill or resolution.
230230 19 (g) Notwithstanding any other provision of these Rules,
231231 20 any bill pending before the Rules Committee shall be
232232 21 immediately discharged and referred to a standing committee,
233233 22 special committee, or order of the Daily Calendar, as provided
234234 23 in this Rule, if the Principal Sponsor of the bill files a
235235 24 motion that is signed by no less than three-fifths of the
236236 25 members of both the majority and minority caucuses, provided
237237 26 each member signing the motion is a sponsor of the underlying

248248 1 bill subject to the motion and the motion specifies the
249249 2 appropriate standing committee, special committee, or order on
250250 3 the Daily Calendar to which the bill shall be referred. Such a
251251 4 motion shall be filed, in writing, with the Clerk. All other
252252 5 legislative measures may be discharged from the Rules
253253 6 Committee only by unanimous consent of the House. A bill or
254254 7 resolution discharged from the Rules Committee shall be
255255 8 referred as follows: (i) a bill or resolution that was not
256256 9 previously referred shall be referred to the standing
257257 10 committee or special committee designated on the motion,
258258 11 subject to the notice requirement of Rule 21; (ii) a bill or
259259 12 resolution re-referred to the Rules Committee from a standing
260260 13 committee or special committee shall be re-referred to that
261261 14 committee, subject to the notice requirement of Rule 21; and
262262 15 (iii) a bill or resolution re-referred to the Rules Committee
263263 16 from an order of business on the Daily Calendar shall be
264264 17 re-referred to the same order of business, provided the bill
265265 18 or resolution shall be carried on the Daily Calendar for at
266266 19 least one legislative day prior to consideration by the House.
267267 20 Legislative measures, other than bills or resolutions, that
268268 21 are discharged from the Rules Committee shall be referred as
269269 22 follows: (i) an amendment, joint action motion for final
270270 23 action, or conference committee report shall be referred to
271271 24 the committee that considered the underlying bill or
272272 25 resolution and (ii) any other legislative measure shall be
