322 1 AN ACT concerning regulation.
423 2 Be it enacted by the People of the State of Illinois,
524 3 represented in the General Assembly:
625 4 Section 5. The Highway Advertising Control Act of 1971 is
726 5 amended by changing Sections 3.07, 3.08, and 8 and by adding
827 6 Section 3.21 as follows:

1029 8 Sec. 3.07. "Sign" means any outdoor sign, display, device,
1130 9 notice, figure painting, drawing, message, placard, poster,
12-10 billboard, or other thing, which is designed designated,

14-12 of the existing or intended advertising or informative
15-13 contents is or will be visible from any place on the
16-14 main-traveled way of a controlled any portion of an Interstate
17-15 or primary highway, and which is within 660 feet of the nearest
18-16 edge of the right-of-way of such highway, and which is
19-17 operated or owned by a person or entity earning remuneration
20-18 directly or indirectly for the existence or placement of the
21-19 outdoor sign or for the placement of the message on the outdoor
22-20 sign.

39106 6 Sec. 3.08. "Erect" means to construct, build, raise,
40107 7 assemble, place, affix, attach, create, paint, draw or in any
41108 8 other way bring into being or establish; but does not include
42109 9 any of the foregoing activities when performed as an incident
43110 10 to the change of advertising message or normal maintenance or
44111 11 repair of a sign or sign structure. For the purposes of this
45112 12 definition, the following shall not constitute normal
46113 13 maintenance or repair of a sign or sign structure: replacing
47114 14 more than 60% of the uprights, in whole or in part, of a wooden
48115 15 sign structure; replacing more than 30% of the length above
49116 16 ground of each broken, bent, or twisted support of a metal sign
50117 17 structure; raising the height above ground of a sign or sign
51118 18 structure; making a sign bigger; adding lighting; or similar
52119 19 activities that substantially change a sign or make a sign
53-20 more valuable. "Erect" does not include the attachment of a
54-21 vinyl substrate to a sign that was permitted or registered to
55-22 display, in another medium, advertising or other information
56-23 and that does not cause a substantial change or modification
57-24 that would terminate nonconforming rights.
58-25 The Department shall accord lawful status to a previously
120+20 more valuable. For purposes of this definition, attaching a
121+21 vinyl substrate medium to a sign structure or wall surface,
122+22 which may contain advertising or other information, shall
123+23 constitute normal maintenance or repair of a sign or sign

70-2 wall or wall surface (but not a separate wall structure) of a
71-3 building and that lost its lawful status because a court of
72-4 competent jurisdiction through a final and non-appealable
73-5 order determined that the attachment of a vinyl substrate to
74-6 the wall or wall surface constituted the erection of a new sign
75-7 and not normal maintenance under this Section. The Department
76-8 shall also allow for the continued usage of that sign by the
77-9 owner of the building or its authorized agent without
78-10 requiring a new permit or registration.

139-1 In determining the appropriateness of issuing a permit for
140-2 a municipal network sign, the Department shall waive any
141-3 provision or requirement of this Act or administrative rule
142-4 adopted under the authority of this Act to the extent that the
143-5 waiver does not contravene the federal Highway Beautification
144-6 Act of 1965, 23 U.S.C. 131, and the regulations promulgated
145-7 under that Act by the Secretary of the United States
146-8 Department of Transportation. Any municipal network sign
147-9 applications pending on May 1, 2013 that are not affected by
148-10 compliance with the federal Highway Beautification Act of 1965
149-11 shall be issued within 10 days after the effective date of this
150-12 amendatory Act of the 98th General Assembly. The determination
151-13 of the balance of pending municipal network sign applications
152-14 and issuance of approved permits shall be completed within 30
153-15 days after the effective date of this amendatory Act of the
154-16 98th General Assembly. To the extent that the Secretary of the
155-17 United States Department of Transportation or any court finds
156-18 any permit granted pursuant to such a waiver to be
157-19 inconsistent with or preempted by the federal Highway
158-20 Beautification Act of 1965, 23 U.S.C. 131, and the regulations
159-21 promulgated under that Act, that permit shall be void.
160-22 Upon change of sign ownership the new owner of the sign
161-23 shall notify the Department and supply the necessary
162-24 information to renew the permit for such sign at no cost within
163-25 60 days after the change of ownership. Any permit not so
164-26 renewed shall become void.

206+1 compliance with the federal Highway Beautification Act of 1965
207+2 shall be issued within 10 days after the effective date of this
208+3 amendatory Act of the 98th General Assembly. The determination
209+4 of the balance of pending municipal network sign applications
210+5 and issuance of approved permits shall be completed within 30
211+6 days after the effective date of this amendatory Act of the
212+7 98th General Assembly. To the extent that the Secretary of the
213+8 United States Department of Transportation or any court finds
214+9 any permit granted pursuant to such a waiver to be
215+10 inconsistent with or preempted by the federal Highway
216+11 Beautification Act of 1965, 23 U.S.C. 131, and the regulations
217+12 promulgated under that Act, that permit shall be void.
218+13 Upon change of sign ownership the new owner of the sign
219+14 shall notify the Department and supply the necessary
220+15 information to renew the permit for such sign at no cost within
221+16 60 days after the change of ownership. Any permit not so
222+17 renewed shall become void.
223+18 Owners of registered signs shall be issued an identifying
224+19 tag, which must remain securely affixed to the front face of
225+20 the sign or sign structure in a conspicuous position by the
226+21 owner within 60 days after receipt of the tag; owners of signs
227+22 erected by permit shall be issued an identifying tag which
228+23 must remain securely affixed to the front face of the sign or
229+24 sign structure in a conspicuous position by the owner upon
230+25 completion of the sign erection or within 10 days after
231+26 receipt of the tag, whichever is the later.
