12	12	1 AN ACT concerning safety.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The Illinois Pesticide Act is amended by
16	16	5 changing Section 4 and by adding Section 14.1 as follows:
17	17	6 (415 ILCS 60/4) (from Ch. 5, par. 804)
18	18	7 Sec. 4. Definitions. As used in this Act:
19	19	8 1. "Director" means Director of the Illinois Department of
20	20	9 Agriculture or his authorized representative.
21	21	10 2. "Active Ingredient" means any ingredient which will
22	22	11 prevent, destroy, repel, control or mitigate a pest or which
23	23	12 will act as a plant regulator, defoliant or desiccant.
24	24	13 3. "Adulterated" shall apply to any pesticide if the
25	25	14 strength or purity is not within the standard of quality
26	26	15 expressed on the labeling under which it is sold, distributed
27	27	16 or used, including any substance which has been substituted
28	28	17 wholly or in part for the pesticide as specified on the
29	29	18 labeling under which it is sold, distributed or used, or if any
30	30	19 valuable constituent of the pesticide has been wholly or in
31	31	20 part abstracted.
32	32	21 4. "Agricultural Commodity" means produce of the land,
33	33	22 including, but not limited to, plants and plant parts,

71	71	1 seeds, sod, shrubs and other products of agricultural origin
72	72	2 including the premises necessary to and used directly in
73	73	3 agricultural production. Agricultural commodity also includes
74	74	4 aquatic products, including any aquatic plants and animals or
75	75	5 their by-products that are produced, grown, managed, harvested
76	76	6 and marketed on an annual, semi-annual, biennial or short-term
77	77	7 basis, in permitted aquaculture facilities.
78	78	8 5. "Animal" means all vertebrate and invertebrate species
79	79	9 including, but not limited to, man and other mammals, bird,
80	80	10 fish, and shellfish.
81	81	11 5.5. "Barrier mosquitocide" means a pesticide that is
82	82	12 formulated to kill adult mosquitoes and that is applied so as
83	83	13 to leave a residual mosquitocidal coating on natural or
84	84	14 manmade surfaces. "Barrier mosquitocide" does not include a
85	85	15 product that is exempt from registration under the Federal
86	86	16 Insecticide, Fungicide, and Rodenticide Act, or rules adopted
87	87	17 pursuant to that Act.
88	88	18 5.6. "Barrier mosquitocide treatment" means application of
89	89	19 a barrier mosquitocide to a natural or manmade surface.
90	90	20 6. "Beneficial Insects" means those insects which during
91	91	21 their life cycle are effective pollinators of plants,
92	92	22 predators of pests or are otherwise beneficial.
93	93	23 7. "Certified applicator".
94	94	24 A. "Certified applicator" means any individual who is
95	95	25 certified under this Act to purchase, use, or supervise
96	96	26 the use of pesticides which are classified for restricted

108	108	2 B. "Private applicator" means a certified applicator
109	109	3 who purchases, uses, or supervises the use of any
110	110	4 pesticide classified for restricted use, for the purpose
111	111	5 of producing any agricultural commodity on property owned,
112	112	6 rented, or otherwise controlled by him or his employer, or
113	113	7 applied to other property if done without compensation
114	114	8 other than trading of personal services between no more
115	115	9 than 2 producers of agricultural commodities.
116	116	10 C. "Licensed Commercial Applicator" means a certified
117	117	11 applicator, whether or not he is a private applicator with
118	118	12 respect to some uses, who owns or manages a business that
119	119	13 is engaged in applying pesticides, whether classified for
120	120	14 general or restricted use, for hire. The term also applies
121	121	15 to a certified applicator who uses or supervises the use
122	122	16 of pesticides, whether classified for general or
123	123	17 restricted use, for any purpose or on property of others
124	124	18 excluding those specified by subparagraphs 7 (B), (D), (E)
125	125	19 of Section 4 of this Act.
126	126	20 D. "Commercial Not For Hire Applicator" means a
127	127	21 certified applicator who uses or supervises the use of
128	128	22 pesticides classified for general or restricted use for
129	129	23 any purpose on property of an employer when such activity
130	130	24 is a requirement of the terms of employment and such
131	131	25 application of pesticides under this certification is
132	132	26 limited to property under the control of the employer only

143	143	1 and includes, but is not limited to, the use or
144	144	2 supervision of the use of pesticides in a greenhouse
145	145	3 setting. "Commercial Not For Hire Applicator" also
146	146	4 includes a certified applicator who uses or supervises the
147	147	5 use of pesticides classified for general or restricted use
148	148	6 as an employee of a state agency, municipality, or other
149	149	7 duly constituted governmental agency or unit.
150	150	8 8. "Defoliant" means any substance or combination of
151	151	9 substances which cause leaves or foliage to drop from a plant
152	152	10 with or without causing abscission.
153	153	11 9. "Desiccant" means any substance or combination of
154	154	12 substances intended for artificially accelerating the drying
155	155	13 of plant tissue.
156	156	14 10. "Device" means any instrument or contrivance, other
157	157	15 than a firearm or equipment for application of pesticides when
158	158	16 sold separately from pesticides, which is intended for
159	159	17 trapping, repelling, destroying, or mitigating any pest, other
160	160	18 than bacteria, virus, or other microorganisms on or living in
161	161	19 man or other living animals.
162	162	20 11. "Distribute" means offer or hold for sale, sell,
163	163	21 barter, ship, deliver for shipment, receive and then deliver,
164	164	22 or offer to deliver pesticides, within the State.
165	165	23 12. "Environment" includes water, air, land, and all
166	166	24 plants and animals including man, living therein and the
167	167	25 interrelationships which exist among these.
168	168	26 13. "Equipment" means any type of instruments and

179	179	1 contrivances using motorized, mechanical or pressure power
180	180	2 which is used to apply any pesticide, excluding pressurized
181	181	3 hand-size household apparatus containing dilute ready to apply
182	182	4 pesticide or used to apply household pesticides.
183	183	5 14. "FIFRA" means the Federal Insecticide, Fungicide, and
184	184	6 Rodenticide Act, as amended.
185	185	7 15. "Fungi" means any non-chlorophyll bearing
186	186	8 thallophytes, any non-chlorophyll bearing plant of a lower
187	187	9 order than mosses or liverworts, as for example rust, smut,
188	188	10 mildew, mold, yeast and bacteria, except those on or in living
189	189	11 animals including man and those on or in processed foods,
190	190	12 beverages or pharmaceuticals.
191	191	13 16. "Household Substance" means any pesticide customarily
192	192	14 produced and distributed for use by individuals in or about
193	193	15 the household.
194	194	16 17. "Imminent Hazard" means a situation which exists when
195	195	17 continued use of a pesticide would likely result in
196	196	18 unreasonable adverse effects effect on the environment or will
197	197	19 involve unreasonable hazard to the survival of a species
198	198	20 declared endangered by the U.S. Secretary of the Interior or
199	199	21 to species declared to be protected by the Illinois Department
200	200	22 of Natural Resources.
201	201	23 18. "Inert Ingredient" means an ingredient which is not an
202	202	24 active ingredient.
203	203	25 19. "Ingredient Statement" means a statement of the name
204	204	26 and percentage of each active ingredient together with the

215	215	1 total percentage of inert ingredients in a pesticide and for
216	216	2 pesticides containing arsenic in any form, the ingredient
217	217	3 statement shall include percentage of total and water soluble
218	218	4 arsenic, each calculated as elemental arsenic. In the case of
219	219	5 spray adjuvants the ingredient statement need contain only the
220	220	6 names of the functioning agents and the total percent of those
221	221	7 constituents ineffective as spray adjuvants.
222	222	8 20. "Insect" means any of the numerous small invertebrate
223	223	9 animals generally having the body more or less obviously
224	224	10 segmented for the most part belonging to the class Insects,
225	225	11 comprised of six-legged, usually winged forms, as for example
226	226	12 beetles, caterpillars, and flies. This definition encompasses
227	227	13 other allied classes of arthropods whose members are wingless
228	228	14 and usually have more than 6 legs as for example spiders,
229	229	15 mites, ticks, centipedes, and millipedes.
230	230	16 21. "Label" means the written, printed or graphic matter
231	231	17 on or attached to the pesticide or device or any of its
232	232	18 containers or wrappings.
233	233	19 22. "Labeling" means the label and all other written,
234	234	20 printed or graphic matter: (a) on the pesticide or device or
235	235	21 any of its containers or wrappings, (b) accompanying the
236	236	22 pesticide or device or referring to it in any other media used
237	237	23 to disseminate information to the public, (c) to which
238	238	24 reference is made to the pesticide or device except when
239	239	25 references are made to current official publications of the U.

251	251	1 Agriculture, Health, Education and Welfare or other Federal
252	252	2 Government institutions, the state experiment station or
253	253	3 colleges of agriculture or other similar state institution
254	254	4 authorized to conduct research in the field of pesticides.
255	255	5 23. "Land" means all land and water area including
256	256	6 airspace, and all plants, animals, structures, buildings,
257	257	7 contrivances, and machinery appurtenant thereto or situated
258	258	8 thereon, fixed or mobile, including any used for
259	259	9 transportation.
260	260	10 24. "Licensed Operator" means a person employed to apply
261	261	11 pesticides to the lands of others under the direction of a
262	262	12 "licensed commercial applicator" or a "licensed commercial
263	263	13 not-for-hire applicator".
264	264	14 25. "Nematode" means invertebrate animals of the phylum
265	265	15 nemathelminthes and class nematoda, also referred to as nemas
266	266	16 or eelworms, which are unsegmented roundworms with elongated
267	267	17 fusiform or sac-like bodies covered with cuticle and
268	268	18 inhabiting soil, water, plants or plant parts.
269	269	19 26. "Permit" means a written statement issued by the
270	270	20 Director or his authorized agent, authorizing certain acts of
271	271	21 pesticide purchase or of pesticide use or application on an
272	272	22 interim basis prior to normal certification, registration, or
273	273	23 licensing.
274	274	24 27. "Person" means any individual, partnership,
275	275	25 association, fiduciary, corporation, or any organized group of
276	276	26 persons whether incorporated or not.

287	287	1 28. "Pest" means (a) any insect, rodent, nematode, fungus,
288	288	2 weed, or (b) any other form of terrestrial or aquatic plant or
289	289	3 animal life or virus, bacteria, or other microorganism,
290	290	4 excluding virus, bacteria, or other microorganism on or in
291	291	5 living animals including man, which the Director declares to
292	292	6 be a pest.
293	293	7 29. "Pesticide" means any substance or mixture of
294	294	8 substances intended for preventing, destroying, repelling, or
295	295	9 mitigating any pest or any substance or mixture of substances
296	296	10 intended for use as a plant regulator, defoliant or desiccant.
297	297	11 30. "Pesticide Dealer" means any person who distributes
298	298	12 registered pesticides to the user.
299	299	13 31. "Plant Regulator" means any substance or mixture of
300	300	14 substances intended through physiological action to affect the
301	301	15 rate of growth or maturation or otherwise alter the behavior
302	302	16 of ornamental or crop plants or the produce thereof. This does
303	303	17 not include substances which are not intended as plant
304	304	18 nutrient trace elements, nutritional chemicals, plant or seed
305	305	19 inoculants or soil conditioners or amendments.
306	306	20 32. "Protect Health and Environment" means to guard
307	307	21 against any unreasonable adverse effects on the environment.
308	308	22 33. "Registrant" means person who has registered any
309	309	23 pesticide pursuant to the provision of FIFRA and this Act.
310	310	24 34. "Restricted Use Pesticide" means (i) any pesticide
311	311	25 with one or more of its uses classified as restricted by order
312	312	26 of the Administrator of USEPA or the Director or (ii) any

327	327	5 35. "SLN Registration" means registration of a pesticide
328	328	6 for use under conditions of special local need as defined by
329	329	7 FIFRA.
330	330	8 36. "State Restricted Pesticide Use" means any pesticide
331	331	9 use which the Director determines, subsequent to public
332	332	10 hearing, that an additional restriction for that use is needed
333	333	11 to prevent unreasonable adverse effects.
334	334	12 37. "Structural Pest" means any pests which attack and
335	335	13 destroy buildings and other structures or which attack
336	336	14 clothing, stored food, commodities stored at food
337	337	15 manufacturing and processing facilities or manufactured and
338	338	16 processed goods.
339	339	17 38. "Unreasonable Adverse Effects on the Environment"
340	340	18 means the unreasonable risk to the environment, including man,
341	341	19 from the use of any pesticide, when taking into account
342	342	20 accrued benefits of as well as the economic, social, and
343	343	21 environmental costs of its use.
344	344	22 39. "USEPA" means United States Environmental Protection
345	345	23 Agency.
346	346	24 40. "Use inconsistent with the label" means to use a
347	347	25 pesticide in a manner not consistent with the label
348	348	26 instruction, the definition adopted in FIFRA as interpreted by

360	360	2 41. "Weed" means any plant growing in a place where it is
361	361	3 not wanted.
362	362	4 42. "Wildlife" means all living things, not human,

364	364	6 43. "Bulk pesticide" means any registered pesticide which
365	365	7 is transported or held in an individual container in undivided
366	366	8 quantities of greater than 55 U.S. gallons liquid measure or
367	367	9 100 pounds net dry weight.
368	368	10 44. "Bulk repackaging" means the transfer of a registered
369	369	11 pesticide from one bulk container (containing undivided
370	370	12 quantities of greater than 100 U.S. gallons liquid measure or
371	371	13 100 pounds net dry weight) to another bulk container
372	372	14 (containing undivided quantities of greater than 100 U.S.
373	373	15 gallons liquid measure or 100 pounds net dry weight) in an
374	374	16 unaltered state in preparation for sale or distribution to
375	375	17 another person.
376	376	18 45. "Business" means any individual, partnership,
377	377	19 corporation or association engaged in a business operation for
378	378	20 the purpose of selling or distributing pesticides or providing
379	379	21 the service of application of pesticides in this State.
380	380	22 46. "Facility" means any building or structure and all
381	381	23 real property contiguous thereto, including all equipment
382	382	24 fixed thereon used for the operation of the business.
383	383	25 47. "Chemigation" means the application of a pesticide
384	384	26 through the systems or equipment employed for the primary

396	396	2 48. "Use" means any activity covered by the pesticide
397	397	3 label, including, but not limited to, application of
398	398	4 pesticide, mixing and loading, storage of pesticides or
399	399	5 pesticide containers, disposal of pesticides and pesticide
400	400	6 containers and reentry into treated sites or areas.
401	401	7 49. "Neonicotinoid" means any pesticide, excluding any
402	402	8 wood preservative pesticide, that contains clothianidin,
403	403	9 imidacloprid, thiamethoxam, dinotefuran, acetamiprid,
404	404	10 thiacloprid, nithiazine, nitenpyram, or any other
405	405	11 neonicotinoid as may be identified by rules adopted by the
406	406	12 Department of Agriculture.

410	410	16 Sec. 14.1. Neonicotinoids.
411	411	17 (a) On and after January 1, 2024, no pesticide containing
412	412	18 a neonicotinoid may be used outdoors on any land owned or
413	413	19 maintained by the State, except, in accordance with subsection
414	414	20 (b), for:
415	415	21 (1) structural pest control; or
416	416	22 (2) abatement of non-native insect borers, such as
417	417	23 Agrilus planipennis or related or similar insect pests.
418	418	24 (b) On and after January 1, 2024, no pesticide containing
419	419	25 a neonicotinoid may be used outdoors on any land owned or

430	430	1 maintained by the State for structural pest control or
431	431	2 abatement of non-native insect borers, unless:
432	432	3 (1) abatement application is restricted to:
433	433	4 (A) basal bark spray;
434	434	5 (B) basal drench solely at the base of a tree;
435	435	6 (C) soil injection solely at the base of a tree; or
436	436	7 (D) systemic root flare or trunk injection;
437	437	8 (2) no broadcast soil treatment, foliar spraying, or
438	438	9 dusting is used; and
439	439	10 (3) abatement application made to a zoophilous species
440	440	11 occurs after the blooming period has passed and early
441	441	12 enough to ensure that chemical decomposition occurs before
442	442	13 the following bloom season.
443	443	14 (c) This Section does not prohibit:
444	444	15 (1) the use of seeds that are pretreated with
445	445	16 neonicotinoids on public lands owned or maintained by the
446	446	17 State;
447	447	18 (2) the use of neonicotinoids on property belonging to
448	448	19 a public institution of higher education; or
449	449	20 (3) the use of neonicotinoids for wood preservation.
450	450	21 (d) For purposes of this Section, "zoophilous species"
451	451	22 means plants pollinated by insects, birds, or bats.
452	452	23 Section 99. Effective date. This Act takes effect upon
453	453	24 becoming law.
