1818 1 AN ACT concerning health.
1919 2 Be it enacted by the People of the State of Illinois,
2020 3 represented in the General Assembly:
2121 4 Section 5. The Compassionate Use of Medical Cannabis
2222 5 Program Act is amended by changing Sections 10, 85, 95, 100,
2323 6 105, 115, and 120 as follows:

2525 8 Sec. 10. Definitions. The following terms, as used in this
2626 9 Act, shall have the meanings set forth in this Section:
2727 10 (a) "Adequate supply" means:
2828 11 (1) 2.5 ounces of usable cannabis during a period of
2929 12 14 days and that is derived solely from an intrastate
3030 13 source.
3131 14 (2) Subject to the rules of the Department of Public
3232 15 Health, a patient may apply for a waiver where a
3333 16 certifying health care professional provides a substantial
3434 17 medical basis in a signed, written statement asserting
3535 18 that, based on the patient's medical history, in the
3636 19 certifying health care professional's professional
3737 20 judgment, 2.5 ounces is an insufficient adequate supply
3838 21 for a 14-day period to properly alleviate the patient's
3939 22 debilitating medical condition or symptoms associated with
4040 23 the debilitating medical condition.

8989 1 (3) This subsection may not be construed to authorize
9090 2 the possession of more than 2.5 ounces at any time without
9191 3 authority from the Department of Public Health.
9292 4 (4) The pre-mixed weight of medical cannabis used in
9393 5 making a cannabis infused product shall apply toward the
9494 6 limit on the total amount of medical cannabis a registered
9595 7 qualifying patient may possess at any one time.
9696 8 (a-5) "Advanced practice registered nurse" means a person
9797 9 who is licensed under the Nurse Practice Act as an advanced
9898 10 practice registered nurse and has a controlled substances
9999 11 license under Article III of the Illinois Controlled
100100 12 Substances Act.
101101 13 (b) "Cannabis" has the meaning given that term in Section
102102 14 3 of the Cannabis Control Act.
103103 15 (c) "Cannabis plant monitoring system" means a system that
104104 16 includes, but is not limited to, testing and data collection
105105 17 established and maintained by the registered cultivation
106106 18 center and available to the Department for the purposes of
107107 19 documenting each cannabis plant and for monitoring plant
108108 20 development throughout the life cycle of a cannabis plant
109109 21 cultivated for the intended use by a qualifying patient from
110110 22 seed planting to final packaging.
111111 23 (d) "Cardholder" means a qualifying patient or a
112112 24 designated caregiver who has been issued and possesses a valid
113113 25 registry identification card by the Department of Public

125125 1 (d-5) "Certifying health care professional" means a
126126 2 physician, an advanced practice registered nurse, or a
127127 3 physician assistant.
128128 4 (e) "Cultivation center" means a facility operated by an
129129 5 organization or business that is registered by the Department
130130 6 of Agriculture to perform necessary activities to provide only
131131 7 registered medical cannabis dispensing organizations with
132132 8 usable medical cannabis.
133133 9 (f) "Cultivation center agent" means a principal officer,
134134 10 board member, employee, or agent of a registered cultivation
135135 11 center who is 21 years of age or older and has not been
136136 12 convicted of an excluded offense.
137137 13 (g) "Cultivation center agent identification card" means a
138138 14 document issued by the Department of Agriculture that
139139 15 identifies a person as a cultivation center agent.
140140 16 (h) "Debilitating medical condition" means one or more of
141141 17 the following:
142142 18 (1) cancer, glaucoma, positive status for human
143143 19 immunodeficiency virus, acquired immune deficiency
144144 20 syndrome, hepatitis C, amyotrophic lateral sclerosis,
145145 21 Crohn's disease (including, but not limited to, ulcerative
146146 22 colitis), agitation of Alzheimer's disease,
147147 23 cachexia/wasting syndrome, muscular dystrophy, severe
148148 24 fibromyalgia, spinal cord disease, including but not
149149 25 limited to arachnoiditis, Tarlov cysts, hydromyelia,
150150 26 syringomyelia, Rheumatoid arthritis, fibrous dysplasia,

171171 11 syndrome, residual limb pain, seizures (including those
172172 12 characteristic of epilepsy), post-traumatic stress
173173 13 disorder (PTSD), autism, chronic pain, irritable bowel
174174 14 syndrome, migraines, osteoarthritis, anorexia nervosa,
175175 15 Ehlers-Danlos Syndrome, Neuro-Behcet's Autoimmune
176176 16 Disease, neuropathy, polycystic kidney disease, superior
177177 17 canal dehiscence syndrome, or the treatment of these
178178 18 conditions;
179179 19 (1.5) terminal illness with a diagnosis of 6 months or
180180 20 less; if the terminal illness is not one of the qualifying
181181 21 debilitating medical conditions, then the certifying
182182 22 health care professional shall on the certification form
183183 23 identify the cause of the terminal illness; or
184184 24 (2) any other debilitating medical condition or its
185185 25 treatment that is added by the Department of Public Health
186186 26 by rule as provided in Section 45.

197197 1 (i) "Designated caregiver" means a person who: (1) is at
198198 2 least 21 years of age; (2) has agreed to assist with a
199199 3 patient's medical use of cannabis; (3) has not been convicted
200200 4 of an excluded offense; and (3) (4) assists no more than one
201201 5 registered qualifying patient with his or her medical use of
202202 6 cannabis.
203203 7 (j) "Dispensing organization agent identification card"
204204 8 means a document issued by the Department of Financial and
205205 9 Professional Regulation that identifies a person as a medical
206206 10 cannabis dispensing organization agent.
207207 11 (k) "Enclosed, locked facility" means a room, greenhouse,
208208 12 building, or other enclosed area equipped with locks or other
209209 13 security devices that permit access only by a cultivation
210210 14 center's agents or a dispensing organization's agent working
211211 15 for the registered cultivation center or the registered
212212 16 dispensing organization to cultivate, store, and distribute
213213 17 cannabis for registered qualifying patients.
214214 18 (l) (Blank). "Excluded offense" for cultivation center
215215 19 agents and dispensing organizations means:
216216 20 (1) a violent crime defined in Section 3 of the Rights
217217 21 of Crime Victims and Witnesses Act or a substantially
218218 22 similar offense that was classified as a felony in the
219219 23 jurisdiction where the person was convicted; or
220220 24 (2) a violation of a state or federal controlled
221221 25 substance law, the Cannabis Control Act, or the
222222 26 Methamphetamine Control and Community Protection Act that

233233 1 was classified as a felony in the jurisdiction where the
234234 2 person was convicted, except that the registering
235235 3 Department may waive this restriction if the person
236236 4 demonstrates to the registering Department's satisfaction
237237 5 that his or her conviction was for the possession,
238238 6 cultivation, transfer, or delivery of a reasonable amount
239239 7 of cannabis intended for medical use. This exception does
240240 8 not apply if the conviction was under state law and
241241 9 involved a violation of an existing medical cannabis law.
242242 10 For purposes of this subsection, the Department of Public
243243 11 Health shall determine by emergency rule within 30 days after
244244 12 the effective date of this amendatory Act of the 99th General
245245 13 Assembly what constitutes a "reasonable amount".

247247 15 (l-10) "Illinois Cannabis Tracking System" means a
248248 16 web-based system established and maintained by the Department
249249 17 of Public Health that is available to the Department of
250250 18 Agriculture, the Department of Financial and Professional
251251 19 Regulation, the Illinois State Police, and registered medical
252252 20 cannabis dispensing organizations on a 24-hour basis to upload
253253 21 written certifications for Opioid Alternative Pilot Program
254254 22 participants, to verify Opioid Alternative Pilot Program
255255 23 participants, to verify Opioid Alternative Pilot Program
256256 24 participants' available cannabis allotment and assigned
257257 25 dispensary, and the tracking of the date of sale, amount, and

270270 2 (m) "Medical cannabis cultivation center registration"
271271 3 means a registration issued by the Department of Agriculture.
272272 4 (n) "Medical cannabis container" means a sealed,
273273 5 traceable, food compliant, tamper resistant, tamper evident
274274 6 container, or package used for the purpose of containment of
275275 7 medical cannabis from a cultivation center to a dispensing
276276 8 organization.
277277 9 (o) "Medical cannabis dispensing organization", or
278278 10 "dispensing organization", or "dispensary organization" means
279279 11 a facility operated by an organization or business that is
280280 12 registered by the Department of Financial and Professional
281281 13 Regulation to acquire medical cannabis from a registered
282282 14 cultivation center for the purpose of dispensing cannabis,
283283 15 paraphernalia, or related supplies and educational materials
284284 16 to registered qualifying patients, individuals with a
285285 17 provisional registration for qualifying patient cardholder
286286 18 status, or an Opioid Alternative Pilot Program participant.
287287 19 (p) "Medical cannabis dispensing organization agent" or
288288 20 "dispensing organization agent" means a principal officer,
289289 21 board member, employee, or agent of a registered medical
290290 22 cannabis dispensing organization who is 21 years of age or
291291 23 older and has not been convicted of an excluded offense.
292292 24 (q) "Medical cannabis infused product" means food, oils,
293293 25 ointments, or other products containing usable cannabis that
294294 26 are not smoked.

305305 1 (r) "Medical use" means the acquisition; administration;
306306 2 delivery; possession; transfer; transportation; or use of
307307 3 cannabis to treat or alleviate a registered qualifying
308308 4 patient's debilitating medical condition or symptoms
309309 5 associated with the patient's debilitating medical condition.
310310 6 (r-5) "Opioid" means a narcotic drug or substance that is
311311 7 a Schedule II controlled substance under paragraph (1), (2),
312312 8 (3), or (5) of subsection (b) or under subsection (c) of
313313 9 Section 206 of the Illinois Controlled Substances Act.
314314 10 (r-10) "Opioid Alternative Pilot Program participant"
315315 11 means an individual who has received a valid written
316316 12 certification to participate in the Opioid Alternative Pilot
317317 13 Program for a medical condition for which an opioid has been or
318318 14 could be prescribed by a certifying health care professional
319319 15 based on generally accepted standards of care.
320320 16 (s) "Physician" means a doctor of medicine or doctor of
321321 17 osteopathy licensed under the Medical Practice Act of 1987 to
322322 18 practice medicine and who has a controlled substances license
323323 19 under Article III of the Illinois Controlled Substances Act.
324324 20 It does not include a licensed practitioner under any other
325325 21 Act including but not limited to the Illinois Dental Practice
326326 22 Act.
327327 23 (s-1) "Physician assistant" means a physician assistant
328328 24 licensed under the Physician Assistant Practice Act of 1987
329329 25 and who has a controlled substances license under Article III
330330 26 of the Illinois Controlled Substances Act.

341341 1 (s-5) "Provisional registration" means a document issued
342342 2 by the Department of Public Health to a qualifying patient who
343343 3 has submitted: (1) an online application and paid a fee to
344344 4 participate in Compassionate Use of Medical Cannabis Program
345345 5 pending approval or denial of the patient's application; or
346346 6 (2) a completed application for terminal illness.
347347 7 (t) "Qualifying patient" means a person who has been
348348 8 diagnosed by a certifying health care professional as having a
349349 9 debilitating medical condition.
350350 10 (u) "Registered" means licensed, permitted, or otherwise
351351 11 certified by the Department of Agriculture, Department of
352352 12 Public Health, or Department of Financial and Professional
353353 13 Regulation.
354354 14 (v) "Registry identification card" means a document issued
355355 15 by the Department of Public Health that identifies a person as
356356 16 a registered qualifying patient or registered designated
357357 17 caregiver.
358358 18 (w) "Usable cannabis" means the seeds, leaves, buds, and
359359 19 flowers of the cannabis plant and any mixture or preparation
360360 20 thereof, but does not include the stalks, and roots of the
361361 21 plant. It does not include the weight of any non-cannabis
362362 22 ingredients combined with cannabis, such as ingredients added
363363 23 to prepare a topical administration, food, or drink.
364364 24 (x) "Verification system" means a Web-based system
365365 25 established and maintained by the Department of Public Health

378378 2 enforcement personnel, and registered medical cannabis
379379 3 dispensing organization agents on a 24-hour basis for the
380380 4 verification of registry identification cards, the tracking of
381381 5 delivery of medical cannabis to medical cannabis dispensing
382382 6 organizations, and the tracking of the date of sale, amount,
383383 7 and price of medical cannabis purchased by a registered
384384 8 qualifying patient.
385385 9 (y) "Written certification" means a document dated and
386386 10 signed by a certifying health care professional, stating (1)
387387 11 that the qualifying patient has a debilitating medical
388388 12 condition and specifying the debilitating medical condition
389389 13 the qualifying patient has; and (2) that (A) the certifying
390390 14 health care professional is treating or managing treatment of
391391 15 the patient's debilitating medical condition; or (B) an Opioid
392392 16 Alternative Pilot Program participant has a medical condition
393393 17 for which opioids have been or could be prescribed. A written
394394 18 certification shall be made only in the course of a bona fide
395395 19 health care professional-patient relationship, after the
396396 20 certifying health care professional has completed an
397397 21 assessment of either a qualifying patient's medical history or
398398 22 Opioid Alternative Pilot Program participant, reviewed
399399 23 relevant records related to the patient's debilitating
400400 24 condition, and conducted a physical examination.
401401 25 (z) "Bona fide health care professional-patient
402402 26 relationship" means a relationship established at a hospital,

413413 1 certifying health care professional's office, or other health
414414 2 care facility in which the certifying health care professional
415415 3 has an ongoing responsibility for the assessment, care, and
416416 4 treatment of a patient's debilitating medical condition or a
417417 5 symptom of the patient's debilitating medical condition.
418418 6 A veteran who has received treatment at a VA hospital
419419 7 shall be deemed to have a bona fide health care
420420 8 professional-patient relationship with a VA certifying health

461461 14 will be grown, harvested, manufactured, packaged, or
462462 15 otherwise prepared for distribution to a dispensing
463463 16 organization;
464464 17 (3) the name, address, and date of birth of each
465465 18 principal officer and board member of the cultivation
466466 19 center, provided that all those individuals shall be at
467467 20 least 21 years of age;
468468 21 (4) any instance in which a business that any of the
469469 22 prospective board members of the cultivation center had
470470 23 managed or served on the board of the business and was
471471 24 convicted, fined, censured, or had a registration or
472472 25 license suspended or revoked in any administrative or
473473 26 judicial proceeding;

489489 6 keeping, staffing plan, and security plan reviewed by the
490490 7 Illinois State Police that are in accordance with the
491491 8 rules issued by the Department of Agriculture under this
492492 9 Act. A physical inventory shall be performed of all plants
493493 10 and medical cannabis containers on a weekly basis;
494494 11 (7) experience with agricultural cultivation
495495 12 techniques and industry standards;
496496 13 (8) any academic degrees, certifications, or relevant
497497 14 experience with related businesses;
498498 15 (9) the identity of every person, association, trust,
499499 16 or corporation having any direct or indirect pecuniary
500500 17 interest in the cultivation center operation with respect
501501 18 to which the registration is sought. If the disclosed
502502 19 entity is a trust, the application shall disclose the
503503 20 names and addresses of the beneficiaries; if a
504504 21 corporation, the names and addresses of all stockholders
505505 22 and directors; if a partnership, the names and addresses
506506 23 of all partners, both general and limited;
507507 24 (10) verification from the Illinois State Police that
508508 25 all background checks of the principal officer, board
509509 26 members, and registered agents have been conducted and

526526 7 (12) an application fee set by the Department of
527527 8 Agriculture by rule; and
528528 9 (13) any other information required by Department of
529529 10 Agriculture rules, including, but not limited to a
530530 11 cultivation center applicant's experience with the
531531 12 cultivation of agricultural or horticultural products,
532532 13 operating an agriculturally related business, or operating
533533 14 a horticultural business.
534534 15 (e) An application for a cultivation center permit must be
535535 16 denied if any of the following conditions are met:
536536 17 (1) the applicant failed to submit the materials
537537 18 required by this Section, including if the applicant's
538538 19 plans do not satisfy the security, oversight, inventory,
539539 20 or recordkeeping rules issued by the Department of
540540 21 Agriculture;
541541 22 (2) the applicant would not be in compliance with
542542 23 local zoning rules issued in accordance with Section 140;
543543 24 (3) (blank) one or more of the prospective principal
544544 25 officers or board members has been convicted of an

569569 14 similar laws of any other jurisdiction; or
570570 15 (8) the person has submitted an application for a
571571 16 certificate under this Act which contains false
572572 17 information.

602602 12 Department of Agriculture.
603603 13 (b) (Blank). When applying for the initial permit, the
604604 14 background checks for the principal officer, board members,
605605 15 and registered agents shall be completed prior to submitting
606606 16 the application to the Department of Agriculture.
607607 17 (c) Through the Illinois State Police, the licensing or
608608 18 issuing Department shall conduct a criminal history record
609609 19 check of the prospective principal officers, board members,
610610 20 and agents of a medical cannabis dispensing organization or
611611 21 cultivation center applying for a license or agent
612612 22 identification card under this Act.
613613 23 Each medical cannabis dispensing organization or
614614 24 cultivation center's prospective principal officer, board
615615 25 member, or agent shall submit his or her fingerprints to the

642642 16 (1) the Department of Agriculture, with respect to a
643643 17 cultivation center; or
644644 18 (2) the Department of Financial and Professional
645645 19 Regulation, with respect to a dispensing organization.
646646 20 (d) When applying for the initial license or
647647 21 identification card, the background checks for all prospective
648648 22 principal officers, board members, and agents shall be
649649 23 completed before submitting the application to the licensing
650650 24 or issuing agency.

705705 8 (1) the name of the cardholder;
706706 9 (2) the date of issuance and expiration date of
707707 10 cultivation center agent identification cards;
708708 11 (3) a random 10-digit alphanumeric identification
709709 12 number containing at least 4 numbers and at least 4
710710 13 letters that is unique to the holder; and
711711 14 (4) a photograph of the cardholder.
712712 15 (d) The cultivation center agent identification cards
713713 16 shall be immediately returned to the cultivation center upon
714714 17 termination of employment.
715715 18 (e) Any card lost by a cultivation center agent shall be
716716 19 reported to the Illinois State Police and the Department of
717717 20 Agriculture immediately upon discovery of the loss.
718718 21 (f) (Blank). An applicant shall be denied a cultivation
719719 22 center agent identification card if he or she has been
720720 23 convicted of an excluded offense.
721721 24 (g) An agent applicant may begin employment at a
722722 25 cultivation center while the agent applicant's identification

743743 10 (a) The operating documents of a registered cultivation
744744 11 center shall include procedures for the oversight of the
745745 12 cultivation center, a cannabis plant monitoring system
746746 13 including a physical inventory recorded weekly, a cannabis
747747 14 container system including a physical inventory recorded
748748 15 weekly, accurate record keeping, and a staffing plan.
749749 16 (b) A registered cultivation center shall implement a
750750 17 security plan reviewed by the Illinois State Police and
751751 18 including but not limited to: facility access controls,
752752 19 perimeter intrusion detection systems, personnel
753753 20 identification systems, 24-hour surveillance system to monitor
754754 21 the interior and exterior of the registered cultivation center
755755 22 facility and accessible to authorized law enforcement and the
756756 23 Department of Agriculture in real-time.

775775 7 at the physical address provided to the Department of
776776 8 Agriculture during the registration process. The cultivation
777777 9 center location shall only be accessed by the cultivation
778778 10 center agents working for the registered cultivation center,
779779 11 Department of Agriculture staff performing inspections,
780780 12 Department of Public Health staff performing inspections, law
781781 13 enforcement or other emergency personnel, and contractors
782782 14 working on jobs unrelated to medical cannabis, such as
783783 15 installing or maintaining security devices or performing
784784 16 electrical wiring.
785785 17 (e) A cultivation center may not sell or distribute any
786786 18 cannabis to any individual or entity other than another
787787 19 cultivation center, a dispensing organization registered under
788788 20 this Act, or a laboratory licensed by the Department of
789789 21 Agriculture.
790790 22 (f) All harvested cannabis intended for distribution to a
791791 23 dispensing organization must be packaged in a labeled medical
792792 24 cannabis container and entered into a data collection system.
793793 25 (g) (Blank). No person who has been convicted of an
794794 26 excluded offense may be a cultivation center agent.

816816 12 federal rules and regulations regarding the use of pesticides.

848848 9 comparable geographic area that satisfies the following
849849 10 criteria as determined by the Department of Commerce and
850850 11 Economic Opportunity, that:
851851 12 (1) meets at least one of the following criteria:
852852 13 (A) the area has a poverty rate of at least 20%
853853 14 according to the latest federal decennial census; or
854854 15 (B) 75% or more of the children in the area
855855 16 participate in the federal free lunch program
856856 17 according to reported statistics from the State Board
857857 18 of Education; or
858858 19 (C) at least 20% of the households in the area
859859 20 receive assistance under the Supplemental Nutrition
860860 21 Assistance Program; or
861861 22 (D) the area has an average unemployment rate, as
862862 23 determined by the Illinois Department of Employment
863863 24 Security, that is more than 120% of the national
864864 25 unemployment average, as determined by the United
865865 26 States Department of Labor, for a period of at least 2

881881 6 "Qualifying Applicant" means an applicant that: (i)
882882 7 submitted an application pursuant to Section 15-30 of the
883883 8 Cannabis Regulation and Tax Act that received at least 85% of
884884 9 250 application points available under Section 15-30 of the
885885 10 Cannabis Regulation and Tax Act as the applicant's final
886886 11 score; (ii) received points at the conclusion of the scoring
887887 12 process for meeting the definition of a "Social Equity
888888 13 Applicant" as set forth under the Cannabis Regulation and Tax
889889 14 Act; and (iii) is an applicant that did not receive a
890890 15 Conditional Adult Use Dispensing Organization License through
891891 16 a Qualifying Applicant Lottery pursuant to Section 15-35 of
892892 17 the Cannabis Regulation and Tax Act or any Tied Applicant
893893 18 Lottery conducted under the Cannabis Regulation and Tax Act.
894894 19 "Social Equity Justice Involved Applicant" means an
895895 20 applicant that is an Illinois resident and one of the
896896 21 following:
897897 22 (1) an applicant with at least 51% ownership and
898898 23 control by one or more individuals who have resided for at
899899 24 least 5 of the preceding 10 years in a Disproportionately
900900 25 Impacted Area;

923923 12 (c) When applying for a dispensing organization
924924 13 registration, the applicant shall submit, at a minimum, the
925925 14 following in accordance with Department of Financial and
926926 15 Professional Regulation rules:
927927 16 (1) a non-refundable application fee established by
928928 17 rule;
929929 18 (2) the proposed legal name of the dispensing
930930 19 organization;
931931 20 (3) the proposed physical address of the dispensing
932932 21 organization;
933933 22 (4) the name, address, and date of birth of each
934934 23 principal officer and board member of the dispensing
935935 24 organization, provided that all those individuals shall be
936936 25 at least 21 years of age;

958958 11 organization agent shall submit a full set of fingerprints to
959959 12 the Department of State Police for the purpose of obtaining a
960960 13 State and federal criminal records check. These fingerprints
961961 14 shall be checked against the fingerprint records now and
962962 15 hereafter, to the extent allowed by law, filed in the
963963 16 Department of State Police and Federal Bureau of Investigation
964964 17 criminal history records databases. The Department of State
965965 18 Police shall furnish, following positive identification, all
966966 19 Illinois conviction information to the Department of Financial
967967 20 and Professional Regulation.
968968 21 (e) A dispensing organization must pay a registration fee
969969 22 set by the Department of Financial and Professional
970970 23 Regulation.
971971 24 (f) An application for a medical cannabis dispensing
972972 25 organization registration must be denied if any of the

985985 2 required by this Section, including if the applicant's
986986 3 plans do not satisfy the security, oversight, or
987987 4 recordkeeping rules issued by the Department of Financial
988988 5 and Professional Regulation;
989989 6 (2) the applicant would not be in compliance with
990990 7 local zoning rules issued in accordance with Section 140;
991991 8 (3) the applicant does not meet the requirements of
992992 9 Section 130;
993993 10 (4) (blank); one or more of the prospective principal
994994 11 officers or board members has been convicted of an
995995 12 excluded offense;
996996 13 (5) one or more of the prospective principal officers
997997 14 or board members has served as a principal officer or
998998 15 board member for a registered medical cannabis dispensing
999999 16 organization that has had its registration revoked; and

10011001 18 members is under 21 years of age.

10201020 2 identification card submitted under this Act, and approve
10211021 3 or deny an application or renewal, within 30 days of
10221022 4 receiving a completed application or renewal application
10231023 5 and all supporting documentation required by rule;
10241024 6 (2) issue a dispensing organization agent
10251025 7 identification card to a qualifying agent within 15
10261026 8 business days of approving the application or renewal;
10271027 9 (3) enter the registry identification number of the
10281028 10 dispensing organization where the agent works; and
10291029 11 (4) allow for an electronic application process, and
10301030 12 provide a confirmation by electronic or other methods that
10311031 13 an application has been submitted.
10321032 14 (b) A dispensing agent must keep his or her identification
10331033 15 card visible at all times when on the property of a dispensing
10341034 16 organization.
10351035 17 (c) The dispensing organization agent identification cards
10361036 18 shall contain the following:
10371037 19 (1) the name of the cardholder;
10381038 20 (2) the date of issuance and expiration date of the
10391039 21 dispensing organization agent identification cards;
10401040 22 (3) a random 10 digit alphanumeric identification
10411041 23 number containing at least 4 numbers and at least 4
10421042 24 letters; that is unique to the holder; and
10431043 25 (4) a photograph of the cardholder.

10921092 4 fingerprint records now and hereafter filed in the Illinois
10931093 5 State Police and Federal Bureau of Investigation criminal
10941094 6 history records databases. The Illinois State Police shall
10951095 7 charge a fee for conducting the criminal history record check,
10961096 8 which shall be deposited into the State Police Services Fund
10971097 9 and shall not exceed the actual cost of the State and national
10981098 10 criminal history record check. The Illinois State Police shall
10991099 11 furnish, pursuant to positive identification, all Illinois
11001100 12 conviction information and shall forward the national criminal
11011101 13 history record information to:
11021102 14 (i) the Department of Agriculture, with respect to a
11031103 15 cultivation center, craft grower, infuser organization, or
11041104 16 transporting organization; or
11051105 17 (ii) the Department of Financial and Professional
11061106 18 Regulation, with respect to a dispensing organization.
11071107 19 (b) When applying for the initial license or
11081108 20 identification card, the background checks for all prospective
11091109 21 principal officers, board members, and agents shall be
11101110 22 completed before submitting the application to the licensing
11111111 23 or issuing agency.
11121112 24 (c) All applications for licensure under this Act by
11131113 25 applicants with criminal convictions shall be subject to
11141114 26 Sections 2105-131, 2105-135, and 2105-205 of the Department of
