1111 1 AN ACT concerning criminal law.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Hypodermic Syringes and Needles Act is
1515 5 amended by changing Section 1 as follows:
1616 6 (720 ILCS 635/1) (from Ch. 38, par. 22-50)
1717 7 Sec. 1. Possession of hypodermic syringes and needles.
1818 8 (a) Except as provided in subsection (b), no person, not
1919 9 being a physician, dentist, chiropodist or veterinarian
2020 10 licensed under the the laws of this State or of the state where
2121 11 he resides, or a registered professional nurse, or a
2222 12 registered embalmer, manufacturer or dealer in embalming
2323 13 supplies, wholesale druggist, manufacturing pharmacist,
2424 14 registered pharmacist, manufacturer of surgical instruments,
2525 15 industrial user, official of any government having possession
2626 16 of the articles hereinafter mentioned by reason of his or her
2727 17 official duties, nurse or a medical laboratory technician
2828 18 acting under the direction of a physician or dentist, employee
2929 19 of an incorporated hospital acting under the direction of its
3030 20 superintendent or officer in immediate charge, or a carrier or
3131 21 messenger engaged in the transportation of the articles, or
3232 22 the holder of a permit issued under Section 5 of this Act, or a
3333 23 farmer engaged in the use of the instruments on livestock, or a

6868 1 person engaged in chemical, clinical, pharmaceutical or other
6969 2 scientific research, or a staff person, volunteer, or
7070 3 participant in a needle or hypodermic syringe access program,
7171 4 shall have in his or her possession a hypodermic syringe,
7272 5 hypodermic needle, or any instrument adapted for the use of
7373 6 controlled substances or cannabis by subcutaneous injection.
7474 7 (b) A person who is at least 18 years of age may purchase
7575 8 from a pharmacy and have in his or her possession up to 100
7676 9 hypodermic syringes or needles.
