11	11	1 AN ACT concerning criminal law.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Hypodermic Syringes and Needles Act is
15	15	5 amended by changing Section 1 as follows:
16	16	6 (720 ILCS 635/1) (from Ch. 38, par. 22-50)
17	17	7 Sec. 1. Possession of hypodermic syringes and needles.
18	18	8 (a) Except as provided in subsection (b), no person, not
19	19	9 being a physician, dentist, chiropodist or veterinarian
20	20	10 licensed under the the laws of this State or of the state where
21	21	11 he resides, or a registered professional nurse, or a
22	22	12 registered embalmer, manufacturer or dealer in embalming
23	23	13 supplies, wholesale druggist, manufacturing pharmacist,
24	24	14 registered pharmacist, manufacturer of surgical instruments,
25	25	15 industrial user, official of any government having possession
26	26	16 of the articles hereinafter mentioned by reason of his or her
27	27	17 official duties, nurse or a medical laboratory technician
28	28	18 acting under the direction of a physician or dentist, employee
29	29	19 of an incorporated hospital acting under the direction of its
30	30	20 superintendent or officer in immediate charge, or a carrier or
31	31	21 messenger engaged in the transportation of the articles, or
32	32	22 the holder of a permit issued under Section 5 of this Act, or a
33	33	23 farmer engaged in the use of the instruments on livestock, or a

68	68	1 person engaged in chemical, clinical, pharmaceutical or other
69	69	2 scientific research, or a staff person, volunteer, or
70	70	3 participant in a needle or hypodermic syringe access program,
71	71	4 shall have in his or her possession a hypodermic syringe,
72	72	5 hypodermic needle, or any instrument adapted for the use of
73	73	6 controlled substances or cannabis by subcutaneous injection.
74	74	7 (b) A person who is at least 18 years of age may purchase
75	75	8 from a pharmacy and have in his or her possession up to 100
76	76	9 hypodermic syringes or needles.
