4-AN ACT concerning education.
5-Be it enacted by the People of the State of Illinois,
6-represented in the General Assembly:
7-Section 5. The School Code is amended by changing Sections
8-21B-20, 24-11, and 24A-7 as follows:
9-(105 ILCS 5/21B-20)
10-Sec. 21B-20. Types of licenses. The State Board of
11-Education shall implement a system of educator licensure,
12-whereby individuals employed in school districts who are
13-required to be licensed must have one of the following
14-licenses: (i) a professional educator license; (ii) an
15-educator license with stipulations; (iii) a substitute
16-teaching license; or (iv) until June 30, 2028, a short-term
17-substitute teaching license. References in law regarding
18-individuals certified or certificated or required to be
19-certified or certificated under Article 21 of this Code shall
20-also include individuals licensed or required to be licensed
21-under this Article. The first year of all licenses ends on June
22-30 following one full year of the license being issued.
23-The State Board of Education, in consultation with the
24-State Educator Preparation and Licensure Board, may adopt such
25-rules as may be necessary to govern the requirements for
26-licenses and endorsements under this Section.
3+1 AN ACT concerning education.
4+2 Be it enacted by the People of the State of Illinois,

6+4 Section 5. The School Code is amended by changing Sections
7+5 21B-20, 24-11, and 24A-7 as follows:

11+9 whereby individuals employed in school districts who are

33-(1) Professional Educator License. Persons who (i)
34-have successfully completed an approved educator
35-preparation program and are recommended for licensure by
36-the Illinois institution offering the educator preparation
37-program, (ii) have successfully completed the required
38-testing under Section 21B-30 of this Code, (iii) have
39-successfully completed coursework on the psychology of,
40-the identification of, and the methods of instruction for
41-the exceptional child, including, without limitation,
42-children with learning disabilities, (iv) have
43-successfully completed coursework in methods of reading
44-and reading in the content area, and (v) have met all other
45-criteria established by rule of the State Board of
46-Education shall be issued a Professional Educator License.
47-All Professional Educator Licenses are valid until June 30
48-immediately following 5 years of the license being issued.
49-The Professional Educator License shall be endorsed with
50-specific areas and grade levels in which the individual is
51-eligible to practice. For an early childhood education
52-endorsement, an individual may satisfy the student
53-teaching requirement of his or her early childhood teacher
54-preparation program through placement in a setting with
55-children from birth through grade 2, and the individual
56-may be paid and receive credit while student teaching. The
57-student teaching experience must meet the requirements of
58-and be approved by the individual's early childhood

68-License with Stipulations shall be issued an endorsement
69-that limits the license holder to one particular position
70-or does not require completion of an approved educator
71-program or both.
72-An individual with an Educator License with
73-Stipulations must not be employed by a school district or
74-any other entity to replace any presently employed teacher
75-who otherwise would not be replaced for any reason.
76-An Educator License with Stipulations may be issued
77-with the following endorsements:
78-(A) (Blank).
79-(B) Alternative provisional educator. An
80-alternative provisional educator endorsement on an
81-Educator License with Stipulations may be issued to an
82-applicant who, at the time of applying for the
83-endorsement, has done all of the following:
84-(i) Graduated from a regionally accredited
85-college or university with a minimum of a
86-bachelor's degree.

89-(ii) Successfully completed the first phase of
90-the Alternative Educator Licensure Program for
91-Teachers, as described in Section 21B-50 of this
92-Code.
93-(iii) Passed a content area test, as required
94-under Section 21B-30 of this Code.
95-The alternative provisional educator endorsement is
96-valid for 2 years of teaching and may be renewed for a
97-third year by an individual meeting the requirements set
98-forth in Section 21B-50 of this Code.
99-(C) Alternative provisional superintendent. An
100-alternative provisional superintendent endorsement on
101-an Educator License with Stipulations entitles the
102-holder to serve only as a superintendent or assistant
103-superintendent in a school district's central office.
104-This endorsement may only be issued to an applicant
105-who, at the time of applying for the endorsement, has
106-done all of the following:
107-(i) Graduated from a regionally accredited
108-college or university with a minimum of a master's
109-degree in a management field other than education.
110-(ii) Been employed for a period of at least 5
111-years in a management level position in a field
112-other than education.
113-(iii) Successfully completed the first phase
114-of an alternative route to superintendent

117-endorsement program, as provided in Section 21B-55
118-of this Code.
119-(iv) Passed a content area test required under
120-Section 21B-30 of this Code.
121-The endorsement is valid for 2 fiscal years in
122-order to complete one full year of serving as a
123-superintendent or assistant superintendent.
124-(D) (Blank).
125-(E) Career and technical educator. A career and
126-technical educator endorsement on an Educator License
127-with Stipulations may be issued to an applicant who
128-has a minimum of 60 semester hours of coursework from a
129-regionally accredited institution of higher education
130-or an accredited trade and technical institution and
131-has a minimum of 2,000 hours of experience outside of
132-education in each area to be taught.
133-The career and technical educator endorsement on
134-an Educator License with Stipulations is valid until
135-June 30 immediately following 5 years of the
136-endorsement being issued and may be renewed.
137-An individual who holds a valid career and
138-technical educator endorsement on an Educator License
139-with Stipulations but does not hold a bachelor's
140-degree may substitute teach in career and technical
141-education classrooms.
142-An individual who holds a valid career and

145-technical educator endorsement on an Educator License
146-with Stipulations is entitled to all of the rights and
147-privileges granted to a holder of a Professional
148-Educator License.
149-(F) (Blank).
150-(G) Transitional bilingual educator. A
151-transitional bilingual educator endorsement on an
152-Educator License with Stipulations may be issued for
153-the purpose of providing instruction in accordance
154-with Article 14C of this Code to an applicant who
155-provides satisfactory evidence that he or she meets
156-all of the following requirements:
157-(i) Possesses adequate speaking, reading, and
158-writing ability in the language other than English
159-in which transitional bilingual education is
160-offered.
161-(ii) Has the ability to successfully
162-communicate in English.
163-(iii) Either possessed, within 5 years
164-previous to his or her applying for a transitional
165-bilingual educator endorsement, a valid and
166-comparable teaching certificate or comparable
167-authorization issued by a foreign country or holds
168-a degree from an institution of higher learning in
169-a foreign country that the State Educator
170-Preparation and Licensure Board determines to be

173-the equivalent of a bachelor's degree from a
174-regionally accredited institution of higher
175-learning in the United States.
176-A transitional bilingual educator endorsement
177-shall be valid for prekindergarten through grade 12,
178-is valid until June 30 immediately following 5 years
179-of the endorsement being issued, and shall not be
180-renewed.
181-Persons holding a transitional bilingual educator
182-endorsement shall not be employed to replace any
183-presently employed teacher who otherwise would not be
184-replaced for any reason.
185-(H) Language endorsement. In an effort to
186-alleviate the shortage of teachers speaking a language
187-other than English in the public schools, an
188-individual who holds an Educator License with
189-Stipulations may also apply for a language
190-endorsement, provided that the applicant provides
191-satisfactory evidence that he or she meets all of the
192-following requirements:
193-(i) Holds a transitional bilingual
194-endorsement.
195-(ii) Has demonstrated proficiency in the
196-language for which the endorsement is to be issued
197-by passing the applicable language content test
198-required by the State Board of Education.

201-(iii) Holds a bachelor's degree or higher from
202-a regionally accredited institution of higher
203-education or, for individuals educated in a
204-country other than the United States, holds a
205-degree from an institution of higher learning in a
206-foreign country that the State Educator
207-Preparation and Licensure Board determines to be
208-the equivalent of a bachelor's degree from a
209-regionally accredited institution of higher
210-learning in the United States.
211-(iv) (Blank).
212-A language endorsement on an Educator License with
213-Stipulations is valid for prekindergarten through
214-grade 12 for the same validity period as the
215-individual's transitional bilingual educator
216-endorsement on the Educator License with Stipulations
217-and shall not be renewed.
218-(I) Visiting international educator. A visiting
219-international educator endorsement on an Educator
220-License with Stipulations may be issued to an
221-individual who is being recruited by a particular
222-school district that conducts formal recruitment
223-programs outside of the United States to secure the
224-services of qualified teachers and who meets all of
225-the following requirements:
226-(i) Holds the equivalent of a minimum of a

106+1 (ii) Successfully completed the first phase of

112+7 The alternative provisional educator endorsement is

114+9 third year by an individual meeting the requirements set
115+10 forth in Section 21B-50 of this Code.
116+11 (C) Alternative provisional superintendent. An

118+13 an Educator License with Stipulations entitles the
119+14 holder to serve only as a superintendent or assistant
120+15 superintendent in a school district's central office.
121+16 This endorsement may only be issued to an applicant
122+17 who, at the time of applying for the endorsement, has
123+18 done all of the following:
124+19 (i) Graduated from a regionally accredited
125+20 college or university with a minimum of a master's
126+21 degree in a management field other than education.
127+22 (ii) Been employed for a period of at least 5

230-(ii) Has been prepared as a teacher at the

236-A holder of a visiting international educator
237-endorsement on an Educator License with Stipulations
238-shall be permitted to teach in bilingual education
239-programs in the language that was the medium of
240-instruction in his or her teacher preparation program,
241-provided that he or she passes the English Language
242-Proficiency Examination or another test of writing
243-skills in English identified by the State Board of
244-Education, in consultation with the State Educator
245-Preparation and Licensure Board.
246-A visiting international educator endorsement on
247-an Educator License with Stipulations is valid for 5
248-years and shall not be renewed.
249-(J) Paraprofessional educator. A paraprofessional
250-educator endorsement on an Educator License with
251-Stipulations may be issued to an applicant who holds a
252-high school diploma or its recognized equivalent and
253-(i) holds an associate's degree or a minimum of 60
254-semester hours of credit from a regionally accredited

257-institution of higher education; (ii) has passed a
258-paraprofessional competency test under subsection
259-(c-5) of Section 21B-30; or (iii) is at least 18 years
260-of age and will be using the Educator License with
261-Stipulations exclusively for grades prekindergarten
262-through grade 8, until the individual reaches the age
263-of 19 years and otherwise meets the criteria for a
264-paraprofessional educator endorsement pursuant to this
265-subparagraph (J). The paraprofessional educator
266-endorsement is valid until June 30 immediately
267-following 5 years of the endorsement being issued and
268-may be renewed through application and payment of the
269-appropriate fee, as required under Section 21B-40 of
270-this Code. An individual who holds only a
271-paraprofessional educator endorsement is not subject
272-to additional requirements in order to renew the
273-endorsement.
274-(K) Chief school business official. A chief school
275-business official endorsement on an Educator License
276-with Stipulations may be issued to an applicant who
277-qualifies by having a master's degree or higher, 2
278-years of full-time administrative experience in school
279-business management or 2 years of university-approved
280-practical experience, and a minimum of 24 semester
281-hours of graduate credit in a program approved by the
282-State Board of Education for the preparation of school

285-business administrators and by passage of the
286-applicable State tests, including an applicable
287-content area test.
288-The chief school business official endorsement may
289-also be affixed to the Educator License with
290-Stipulations of any holder who qualifies by having a
291-master's degree in business administration, finance,
292-accounting, or public administration and who completes
293-an additional 6 semester hours of internship in school
294-business management from a regionally accredited
295-institution of higher education and passes the
296-applicable State tests, including an applicable
297-content area test. This endorsement shall be required
298-for any individual employed as a chief school business
299-official.
300-The chief school business official endorsement on
301-an Educator License with Stipulations is valid until
302-June 30 immediately following 5 years of the
303-endorsement being issued and may be renewed if the
304-license holder completes renewal requirements as
305-required for individuals who hold a Professional
306-Educator License endorsed for chief school business
307-official under Section 21B-45 of this Code and such
308-rules as may be adopted by the State Board of
309-Education.
310-The State Board of Education shall adopt any rules

314-(L) Provisional in-state educator. A provisional
315-in-state educator endorsement on an Educator License
316-with Stipulations may be issued to a candidate who has
317-completed an Illinois-approved educator preparation
318-program at an Illinois institution of higher education
319-and who has not successfully completed an
320-evidence-based assessment of teacher effectiveness but
321-who meets all of the following requirements:
322-(i) Holds at least a bachelor's degree.
323-(ii) Has completed an approved educator
324-preparation program at an Illinois institution.
325-(iii) Has passed an applicable content area
326-test, as required by Section 21B-30 of this Code.
327-(iv) Has attempted an evidence-based
328-assessment of teacher effectiveness and received a
329-minimum score on that assessment, as established
330-by the State Board of Education in consultation
331-with the State Educator Preparation and Licensure
332-Board.
333-A provisional in-state educator endorsement on an
334-Educator License with Stipulations is valid for one
335-full fiscal year after the date of issuance and may not
336-be renewed.
337-(M) (Blank).
338-(N) Specialized services. A specialized services

341-endorsement on an Educator License with Stipulations
342-may be issued as defined and specified by rule.
343-(O) Provisional career and technical educator. A
344-provisional career and technical educator endorsement
345-on an Educator License with Stipulations may be issued
346-to an applicant who has a minimum of 8,000 hours of
347-work experience in the skill for which the applicant
348-is seeking the endorsement. Each employing school
349-board and regional office of education shall provide
350-verification, in writing, to the State Superintendent
351-of Education at the time the application is submitted
352-that no qualified teacher holding a Professional
353-Educator License or an Educator License with
354-Stipulations with a career and technical educator
355-endorsement is available to teach and that actual
356-circumstances require such issuance.
357-A provisional career and technical educator
358-endorsement on an Educator License with Stipulations
359-is valid until June 30 immediately following 5 years
360-of the endorsement being issued and may be renewed.
361-An individual who holds a provisional career and
362-technical educator endorsement on an Educator License
363-with Stipulations may teach as a substitute teacher in
364-career and technical education classrooms.
365-An individual who holds a provisional career and
366-technical educator endorsement on an Educator License

369-with Stipulations is entitled to all of the rights and
370-privileges granted to a holder of a Professional
371-Educator License.
372-(3) Substitute Teaching License. A Substitute Teaching
373-License may be issued to qualified applicants for
374-substitute teaching in all grades of the public schools,
375-prekindergarten through grade 12. Substitute Teaching
376-Licenses are not eligible for endorsements. Applicants for
377-a Substitute Teaching License must hold a bachelor's
378-degree or higher from a regionally accredited institution
379-of higher education or must be enrolled in an approved
380-educator preparation program in this State and have earned
381-at least 90 credit hours.
382-Substitute Teaching Licenses are valid for 5 years.
383-Substitute Teaching Licenses are valid for substitute
384-teaching in every county of this State. If an individual
385-has had his or her Professional Educator License or
386-Educator License with Stipulations suspended or revoked,
387-then that individual is not eligible to obtain a
388-Substitute Teaching License.
389-A substitute teacher may only teach in the place of a
390-licensed teacher who is under contract with the employing
391-board. If, however, there is no licensed teacher under
392-contract because of an emergency situation, then a
393-district may employ a substitute teacher for no longer
394-than 30 calendar days per each vacant position in the

179+2 with Stipulations is entitled to all of the rights and
180+3 privileges granted to a holder of a Professional
181+4 Educator License.
182+5 (F) (Blank).
183+6 (G) Transitional bilingual educator. A
184+7 transitional bilingual educator endorsement on an
185+8 Educator License with Stipulations may be issued for
186+9 the purpose of providing instruction in accordance
187+10 with Article 14C of this Code to an applicant who
188+11 provides satisfactory evidence that he or she meets
189+12 all of the following requirements:
190+13 (i) Possesses adequate speaking, reading, and
191+14 writing ability in the language other than English
192+15 in which transitional bilingual education is
193+16 offered.
194+17 (ii) Has the ability to successfully
195+18 communicate in English.
196+19 (iii) Either possessed, within 5 years
197+20 previous to his or her applying for a transitional
198+21 bilingual educator endorsement, a valid and
199+22 comparable teaching certificate or comparable
200+23 authorization issued by a foreign country or holds
201+24 a degree from an institution of higher learning in
202+25 a foreign country that the State Educator
203+26 Preparation and Licensure Board determines to be

397-district if the district notifies the appropriate regional
398-office of education within 5 business days after the
399-employment of the substitute teacher in that vacant
400-position. A district may continue to employ that same
401-substitute teacher in that same vacant position for 90
402-calendar days or until the end of the semester, whichever
403-is greater, if, prior to the expiration of the
404-30-calendar-day period then current, the district files a
405-written request with the appropriate regional office of
406-education for a 30-calendar-day extension on the basis
407-that the position remains vacant and the district
408-continues to actively seek qualified candidates and
409-provides documentation that it has provided training
410-specific to the position, including training on meeting
411-the needs of students with disabilities and English
412-learners if applicable. Each extension request shall be
413-granted in writing by the regional office of education. An
414-emergency situation is one in which an unforeseen vacancy
415-has occurred and (i) a teacher is unexpectedly unable to
416-fulfill his or her contractual duties or (ii) teacher
417-capacity needs of the district exceed previous indications
418-or vacancies are unfilled due to a lack of qualified
419-candidates, and the district is actively engaged in
420-advertising to hire a fully licensed teacher for the
421-vacant position.

487-(a) As used in this and the succeeding Sections of this

489-"Teacher" means any or all school district employees
490-regularly required to be licensed under laws relating to the
491-licensure of teachers.
492-"Board" means board of directors, board of education, or
493-board of school inspectors, as the case may be.
494-"School term" means that portion of the school year, July
495-1 to the following June 30, when school is in actual session.
496-"Program" means a program of a special education joint
497-agreement.
498-"Program of a special education joint agreement" means
499-instructional, consultative, supervisory, administrative,
500-diagnostic, and related services that are managed by a special
501-educational joint agreement designed to service 2 or more
502-school districts that are members of the joint agreement.
503-"PERA implementation date" means the implementation date
504-of an evaluation system for teachers as specified by Section
505-24A-2.5 of this Code for all schools within a school district

509-(b) This Section and Sections 24-12 through 24-16 of this
510-Article apply only to school districts having less than
511-500,000 inhabitants.
512-(c) Any teacher who is first employed as a full-time
513-teacher in a school district or program prior to the PERA
514-implementation date and who is employed in that district or
515-program for a probationary period of 4 consecutive school
516-terms shall enter upon contractual continued service in the
517-district or in all of the programs that the teacher is legally
518-qualified to hold, unless the teacher is given written notice
519-of dismissal by certified mail, return receipt requested, by
520-the employing board at least 45 days before the end of any
521-school term within such period.
522-(d) For any teacher who is first employed as a full-time
523-teacher in a school district or program on or after the PERA
524-implementation date but before July 1, 2023, the probationary
525-period shall be one of the following periods, based upon the
526-teacher's school terms of service and performance, before the
527-teacher shall enter upon contractual continued service in the
528-district or in all of the programs that the teacher is legally

267+18 (I) Visiting international educator. A visiting

269+20 License with Stipulations may be issued to an
270+21 individual who is being recruited by a particular
271+22 school district that conducts formal recruitment
272+23 programs outside of the United States to secure the
273+24 services of qualified teachers and who meets all of
274+25 the following requirements:
275+26 (i) Holds the equivalent of a minimum of a

333+12 may be renewed through application and payment of the
334+13 appropriate fee, as required under Section 21B-40 of
335+14 this Code. An individual who holds only a
336+15 paraprofessional educator endorsement is not subject
337+16 to additional requirements in order to renew the
338+17 endorsement.
339+18 (K) Chief school business official. A chief school
340+19 business official endorsement on an Educator License
341+20 with Stipulations may be issued to an applicant who
342+21 qualifies by having a master's degree or higher, 2
343+22 years of full-time administrative experience in school
344+23 business management or 2 years of university-approved
345+24 practical experience, and a minimum of 24 semester
346+25 hours of graduate credit in a program approved by the
347+26 State Board of Education for the preparation of school

767-district's or program's educational program for 120 days or
768-more, provided that the days of leave under the federal Family
769-Medical Leave Act that the teacher is required to take until
770-the end of the school term shall be considered days of teaching
771-or participation in the district's or program's educational
772-program. A school term that is not counted toward attainment
773-of contractual continued service shall not be considered a
774-break in service for purposes of determining whether a teacher
775-has been employed for consecutive school terms, provided that
776-the teacher actually teaches or is otherwise present and

779-(f) If the employing board determines to dismiss the
780-teacher in the last year of the probationary period as
781-provided in subsection (c) of this Section or subdivision (1)
782-or (2) of subsection (d) of this Section or subdivision (1) or
783-(2) of subsection (d-5) of this Section, but not subdivision
784-(3) of subsection (d) of this Section or subdivision (3) of
785-subsection (d-5) of this Section, the written notice of

789-specific reasons for dismissal. Any full-time teacher who does
790-not receive written notice from the employing board on or

792-performance does not require dismissal after the fourth
793-probationary year pursuant to subsection (d) of this Section
794-or the third probationary year pursuant to subsection (d-5) of
795-this Section shall be re-employed for the following school
796-term.
797-(g) Contractual continued service shall continue in effect
798-the terms and provisions of the contract with the teacher
799-during the last school term of the probationary period,
800-subject to this Act and the lawful regulations of the
801-employing board. This Section and succeeding Sections do not
802-modify any existing power of the board except with respect to
803-the procedure of the discharge of a teacher and reductions in
804-salary as hereinafter provided. Contractual continued service
805-status shall not restrict the power of the board to transfer a
806-teacher to a position which the teacher is qualified to fill or
807-to make such salary adjustments as it deems desirable, but
808-unless reductions in salary are uniform or based upon some
809-reasonable classification, any teacher whose salary is reduced
810-shall be entitled to a notice and a hearing as hereinafter
811-provided in the case of certain dismissals or removals.
812-(h) If, by reason of any change in the boundaries of school
813-districts, by reason of a special education cooperative

383+26 The State Board of Education shall adopt any rules

817-10-22.31 of this Code, or by reason of the creation of a new
818-school district, the position held by any teacher having a
819-contractual continued service status is transferred from one
820-board to the control of a new or different board, then the
821-contractual continued service status of the teacher is not
822-thereby lost, and such new or different board is subject to
823-this Code with respect to the teacher in the same manner as if
824-the teacher were its employee and had been its employee during
825-the time the teacher was actually employed by the board from
826-whose control the position was transferred.

400+7 and who has not successfully completed an
401+8 evidence-based assessment of teacher effectiveness but
402+9 who meets all of the following requirements:

956-rules shall not preclude a school district having 500,000 or
957-more inhabitants from using an annual State assessment as the
958-sole measure of student growth for purposes of teacher or
959-principal evaluations.
960-(b) The State Superintendent of Education shall convene a
961-Performance Evaluation Advisory Council, which shall be
962-staffed by the State Board of Education. Members of the
963-Council shall be selected by the State Superintendent and
964-include, without limitation, representatives of teacher unions
965-and school district management, persons with expertise in
966-performance evaluation processes and systems, as well as other
967-stakeholders. The Council shall meet at least quarterly and
968-may also meet at the call of the chairperson of the Council,

983-Section 24A-3. The Committee shall be staffed by the State
984-Board of Education. Members of the Committee shall include,
985-without limitation, representatives from providers of the

987-State, which include teacher unions, school district
988-management, including a school district organized under
989-Article 34, and a statewide organization representing regional
990-offices of education. Members of the Committee shall be
991-nominated by the providers and appointed by the State

1005+1 dismissal provided by the employing board must contain
1006+2 specific reasons for dismissal. Any full-time teacher who does
1007+3 not receive written notice from the employing board on or
1008+4 before April 15 as provided in this Section and whose
1009+5 performance does not require dismissal after the fourth
1010+6 probationary year pursuant to subsection (d) of this Section
1011+7 or the third probationary year pursuant to subsection (d-5) of
1012+8 this Section shall be re-employed for the following school

1014+10 (g) Contractual continued service shall continue in effect
1015+11 the terms and provisions of the contract with the teacher
1016+12 during the last school term of the probationary period,
1017+13 subject to this Act and the lawful regulations of the
1018+14 employing board. This Section and succeeding Sections do not
1019+15 modify any existing power of the board except with respect to
1020+16 the procedure of the discharge of a teacher and reductions in
1021+17 salary as hereinafter provided. Contractual continued service
1022+18 status shall not restrict the power of the board to transfer a
1023+19 teacher to a position which the teacher is qualified to fill or
1024+20 to make such salary adjustments as it deems desirable, but
1025+21 unless reductions in salary are uniform or based upon some
1026+22 reasonable classification, any teacher whose salary is reduced
1027+23 shall be entitled to a notice and a hearing as hereinafter
1028+24 provided in the case of certain dismissals or removals.

1152+4 (m) The employment of any teacher in a special education
1153+5 program authorized by Section 14-1.01 through 14-14.01, or a
1154+6 joint educational program established under Section 10-22.31a,
1155+7 shall be under this and the succeeding Sections of this
1156+8 Article, and such employment shall be deemed a continuation of
1157+9 the previous employment of such teacher in any of the
1158+10 participating districts, regardless of the participation of
1159+11 other districts in the program.

1185+2 such rules as are deemed necessary to implement and accomplish
1186+3 the purposes and provisions of this Article, including, but
1187+4 not limited to, rules:
1188+5 (1) relating to the methods for measuring student
1189+6 growth (including, but not limited to, limitations on the
1190+7 age of usable data; the amount of data needed to reliably
1191+8 and validly measure growth for the purpose of teacher and
1192+9 principal evaluations; and whether and at what time annual
1193+10 State assessments may be used as one of multiple measures
1194+11 of student growth);
1195+12 (2) defining the term "significant factor" for
1196+13 purposes of including consideration of student growth in
1197+14 performance ratings;
1198+15 (3) controlling for such factors as student
1199+16 characteristics (including, but not limited to, students
1200+17 receiving special education and English Learner services),
1201+18 student attendance, and student mobility so as to best
1202+19 measure the impact that a teacher, principal, school and
1203+20 school district has on students' academic achievement;
1204+21 (4) establishing minimum requirements for district
1205+22 teacher and principal evaluation instruments and
1206+23 procedures; and
1207+24 (5) establishing a model evaluation plan for use by
1208+25 school districts in which student growth shall comprise
1209+26 50% of the performance rating.

1221+2 rules shall not preclude a school district having 500,000 or
1222+3 more inhabitants from using an annual State assessment as the
1223+4 sole measure of student growth for purposes of teacher or
1224+5 principal evaluations.
1225+6 (b) The State Superintendent of Education shall convene a
1226+7 Performance Evaluation Advisory Council, which shall be
1227+8 staffed by the State Board of Education. Members of the
1228+9 Council shall be selected by the State Superintendent and
1229+10 include, without limitation, representatives of teacher unions
1230+11 and school district management, persons with expertise in
1231+12 performance evaluation processes and systems, as well as other
1232+13 stakeholders. The Council shall meet at least quarterly and
1233+14 may also meet at the call of the chairperson of the Council,
1234+15 following August 18, 2017 (the effective date of Public Act
1235+16 100-211) until December 31 June 30, 2024. The Council shall
1236+17 advise the State Board of Education on the ongoing
1237+18 implementation of performance evaluations in this State, which
1238+19 may include gathering public feedback, sharing best practices,
1239+20 consulting with the State Board on any proposed rule changes
1240+21 regarding evaluations, and other subjects as determined by the
1241+22 chairperson of the Council.
1242+23 (c) On July 1, 2024, the State Superintendent of Education
1243+24 shall convene a Performance Evaluation Advisory Committee for
1244+25 the purpose of maintaining and improving the evaluator

1260+5 State, which include teacher unions, school district
1261+6 management, including a school district organized under
1262+7 Article 34, and a statewide organization representing regional
1263+8 offices of education. Members of the Committee shall be
1264+9 nominated by the providers and appointed by the State
1265+10 Superintendent.
1266+11 The Committee shall meet initially at the call of the
1267+12 State Superintendent and shall select one member as
1268+13 chairperson at its initial meeting. The Committee shall meet
1269+14 at least quarterly and may also meet at the call of the
1270+15 chairperson of the Committee.
1271+16 The Committee shall advise the State Board of Education on
1272+17 the continued implementation of the evaluator training and
1273+18 pre-qualification program in this State, which may include the
1274+19 development and delivery of the program's existing and new
1275+20 administrators' academies, gathering feedback from program
1276+21 instructors and participants, sharing best practices,
1277+22 consulting with the State Board on any proposed rule changes
1278+23 regarding evaluator training, and other subjects as determined
1279+24 by the chairperson of the Committee.
1280+25 (d) Prior to the applicable implementation date, the these
1281+26 rules shall not apply to teachers assigned to schools
