The Illinois Vehicle Code is amended by 5 changing Sections 3-101, 3-111, and 3-111.1 as follows: 6 (625 ILCS 5/3-101) (from Ch. 95 1/2, par. 3-101) 7 Sec. 3-101. Certificate of title required. 8 (a) Except as provided in Section 3-102, every owner of a 9 vehicle which is in this State and for which no Illinois 10 certificate of title has been issued by the Secretary of State 11 shall make application to the Secretary of State for an 12 Illinois a certificate of title of the vehicle. Except as 13 provided in Section 3-102, every owner of a vehicle that is in 14 this State for which no Illinois certificate of title has been 15 issued by the Secretary of State and every owner of a vehicle 16 that is in the State applying for a duplicate certificate of 17 title or a corrected certificate of title, including a dealer 18 lien release certificate of title, must make application to 19 the Secretary of State for an Illinois duplicate certificate 20 of title or corrected certificate of title. Any owner of a 21 vehicle in this State with a certificate of title that was 22 issued by an entity other than the Secretary of State and 23 showing an Illinois address for the owner must be converted to SB0898 Engrossed LRB103 03370 HEP 48376 b SB0898 Engrossed- 2 -LRB103 03370 HEP 48376 b SB0898 Engrossed - 2 - LRB103 03370 HEP 48376 b SB0898 Engrossed - 2 - LRB103 03370 HEP 48376 b 1 an Illinois title before the owner can transfer the vehicle. 2 Under no circumstances shall a dealer required to obtain 3 an Illinois certificate of title pursuant to this Code be 4 allowed to obtain an out-of-state certificate of title for 5 purposes of a vehicle held for sale in this State by the 6 dealer. Under no circumstances shall a dealer be allowed to 7 obtain an out-of-state certificate of title in lieu of an 8 Illinois-issued dealer lien release certificate of title when 9 a dealer may have need of such title issuance. Nothing in this 10 Section shall be construed so as to allow a dealer to acquire 11 an out-of-state certificate of title in lieu of acquiring an 12 Illinois certificate of title for purposes of a vehicle held 13 for sale in this State by the dealer. 14 (b) Every owner of a motorcycle or motor driven cycle 15 purchased new on and after January 1, 1980 shall make 16 application to the Secretary of State for a certificate of 17 title. However, if such cycle is not properly manufactured or 18 equipped for general highway use pursuant to the provisions of 19 this Act, it shall not be eligible for license registration, 20 but shall be issued a distinctive certificate of title except 21 as provided in Sections 3-102 and 3-110 of this Act. 22 (c) The Secretary of State shall not register or renew the 23 registration of a vehicle unless a certificate of title has 24 been issued by the Secretary of State to the owner or an 25 application therefor has been delivered by the owner to the 26 Secretary of State. Lost, stolen or mutilated certificates. (a) If 11 a certificate of title is lost, stolen, mutilated or destroyed 12 or becomes illegible, the first lienholder or, if none, the 13 owner or legal representative of the owner named in the 14 certificate, as shown by the records of the Secretary of 15 State, shall promptly make application to the Secretary of 16 State for and may obtain a duplicate upon furnishing 17 information satisfactory to the Secretary of State. The 18 duplicate certificate of title shall contain the legend "This 19 is a duplicate certificate and may be subject to the rights of 20 a person under the original certificate." It shall be mailed 21 to the first lienholder named in it or, if none, to the owner 22 or the owner's designee. A certificate of title or a duplicate 23 certificate of title issued by another State showing an 24 Illinois address for the owner cannot be used to transfer 25 ownership of a vehicle. SB0898 Engrossed - 3 - LRB103 03370 HEP 48376 b SB0898 Engrossed- 4 -LRB103 03370 HEP 48376 b SB0898 Engrossed - 4 - LRB103 03370 HEP 48376 b SB0898 Engrossed - 4 - LRB103 03370 HEP 48376 b 1 (b) The Secretary of State shall not issue a duplicate 2 certificate of title to any person within 15 days after the 3 issuance of an original certificate of title to such person. 4 (c) A person recovering an original certificate of title 5 for which a duplicate has been issued shall promptly surrender 6 the original certificate to the Secretary of State. 7 (d) An application for a duplicate certificate of title 8 must state the current vehicle odometer reading at the time of 9 application and that the stated odometer reading is one of the 10 following: actual mileage, not the actual mileage or mileage 11 is in excess of its mechanical limits. 12 (e) If a Display certificate of title is lost, stolen, 13 mutilated or destroyed or becomes illegible, the owner or 14 legal representative of the owner named in the original 15 Display certificate of title and in the certificate of title, 16 as shown by the records of the Secretary of State, shall 17 promptly make application for and may obtain a duplicate upon 18 furnishing information satisfactory to the Secretary of State. 19 The duplicate Display certificate of title shall contain the 20 legend "Duplicate Display Certificate of Title." It shall be 21 mailed to the owner or legal representative of the owner named 22 in the original Display certificate of title and in the 23 certificate of title. Corrected certificates. An application for a 5 corrected certificate of title must state the current vehicle 6 odometer reading at the time of application and that the 7 stated odometer reading is one of the following: actual 8 mileage, not the actual mileage or mileage is in excess of its 9 mechanical limits. The corrected certificate issued under this 10 Section shall contain the notation "corrected". A certificate 11 of title or a corrected certificate of title issued by another 12 State showing an Illinois address for the owner cannot be used 13 to transfer ownership of a vehicle. The owner of a vehicle with 14 a certificate of title or duplicate certificate of title 15 issued by another state showing an Illinois address cannot 16 transfer ownership of the vehicle without first converting the 17 certificate of title to an Illinois certificate of title. 18 (Source: P.A. 90-212, eff. 1-1-98.)
