In provisions concerning provider notification of dental plan changes, provides that no insurer, service corporation, dental service plan corporation, insurance network leasing company, or any company that issues, delivers, amends, or renews an individual or group policy of accident and health insurance on or after the effective date of the amendatory Act that provides dental insurance may automatically enroll a provider in a leased network without the provider's written consent. Provides that any contract entered into or renewed on or after the effective date of the amendatory Act that allows the rights and obligations of the contract to be assigned or leased to another insurer shall provide for notice that informs each provider in writing via certified mail 90 days before any scheduled assignment or lease of the network to which the provider is a contracted provider (rather than shall provide notice of that assignment or lease within 30 days after the assignment or lease to the contracting dentist). Provides that an insurer, service corporation, dental service plan corporation, insurance network leasing company, or any company that issues, delivers, amends, or renews an individual or group policy of accident and health insurance on or after the effective date of the amendatory Act that provides dental insurance that leases or assigns its network shall not cancel a network participating dentist's contractual relationship or otherwise penalize a network participating dentist in any way based on whether or not the dentist accepts the terms of the assignment or lease. 11	11	1 AN ACT concerning regulation.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Insurance Code is amended by
15	15	5 changing Section 355.4 as follows:

18	18	8 (a) No insurer, service corporation, dental service plan
19	19	9 corporation, insurance network leasing company, or any company
20	20	10 that issues, delivers, amends, or renews an individual or
21	21	11 group policy of accident and health insurance on or after the
22	22	12 effective date of this amendatory Act of the 103rd General
23	23	13 Assembly that provides dental insurance may automatically
24	24	14 enroll a provider in a leased network without the provider's
25	25	15 written consent.
26	26	16 (b) Any contract entered into or renewed on or after the
27	27	17 effective date of this amendatory Act of the 103rd General
28	28	18 Assembly this amendatory Act of the 99th General Assembly that
29	29	19 allows the rights and obligations of the contract to be
30	30	20 assigned or leased to another insurer shall provide for notice

68	68	1 notification must include all contract terms, a policy manual,
69	69	2 a fee schedule, and a form whereby the provider must choose to
70	70	3 opt in to the network of the insurer that gains access to the
71	71	4 dentist's contractual relationship in order to be in
72	72	5 compliance with this Section of that assignment or lease
73	73	6 within 30 days after the assignment or lease to the
74	74	7 contracting dentist.
75	75	8 (c) An insurer, service corporation, dental service plan
76	76	9 corporation, insurance network leasing company, or any company
77	77	10 that issues, delivers, amends, or renews an individual or
78	78	11 group policy of accident and health insurance on or after the
79	79	12 effective date of this amendatory Act of the 103rd General
80	80	13 Assembly that provides dental insurance that leases or assigns
81	81	14 its network shall not cancel a network participating dentist's
82	82	15 contractual relationship or otherwise penalize a network
83	83	16 participating dentist in any way based on whether or not the
84	84	17 dentist accepts the terms of the assignment or lease. Before
85	85	18 accepting the terms of an assignment or lease agreement as
86	86	19 described in this Section, any provider who receives
87	87	20 notification of an impending assignment or lease must be given
88	88	21 the option to contract directly with the entities proposing to
89	89	22 gain access to the provider's network.
