The School Code is amended by changing Section 5 24-14 as follows: 6 (105 ILCS 5/24-14) (from Ch. 122, par. 24-14) 7 Sec. 24-14. Termination of contractual continued service 8 by teacher. As used in this Section, "teaching assignment" 9 means any full-time position that requires licensure under 10 Article 21B of this Code. 11 A teacher, as defined in Section 24-11 of this Code, who 12 has entered into contractual continued service may resign at 13 any time by obtaining concurrence of the board or by serving at 14 least 30 days' written notice upon the secretary of the board. 15 During the school term, However, no teacher may resign during 16 the school term, without the concurrence of the board, in 17 order to accept another teaching assignment. Outside of a 18 school term, a resignation submitted by any teacher after the 19 completion of the school year must be submitted in writing to 20 the secretary of the board a minimum of 30 calendar days prior 21 to the first student attendance day of the following school 22 year or else the teacher will be deemed to have resigned during 23 the school term. A referral to the State 3 Superintendent for an alleged violation of this Section must 4 include (i) a dated copy of the teacher's resignation letter, 5 (ii) a copy of the reporting district's current school year 6 calendar, (iii) proof of employment for the school year at 7 issue, (iv) documentation showing that the district's board 8 did not accept the teacher's resignation, and (v) evidence 9 that the teacher left the district in order to accept another 10 teaching assignment. If the district intends to submit a 11 referral to the State Superintendent, the district shall 12 submit the referral to the State Superintendent within 10 13 business days after the board denies acceptance of the 14 resignation. The district shall notify the teacher that it 15 submitted the referral to the State Superintendent within 5 16 business days after submitting the referral to the State 17 Superintendent. The State Superintendent or his or her 18 designee shall convene an informal evidentiary hearing no 19 later than 90 days after receipt of the required documentation 20 from the school district as required in this Section of a 21 resolution by the board.
