4-AN ACT concerning education.
5-Be it enacted by the People of the State of Illinois,
6-represented in the General Assembly:
7-Section 5. The School Code is amended by changing Section
8-24-14 as follows:
9-(105 ILCS 5/24-14) (from Ch. 122, par. 24-14)
10-Sec. 24-14. Termination of contractual continued service
11-by teacher. As used in this Section, "teaching assignment"
12-means any full-time position that requires licensure under
13-Article 21B of this Code.
14-A teacher, as defined in Section 24-11 of this Code, who
15-has entered into contractual continued service may resign at
16-any time by obtaining concurrence of the board or by serving at
17-least 30 days' written notice upon the secretary of the board.
18-During the school term, However, no teacher may resign during
19-the school term, without the concurrence of the board, in
20-order to accept another teaching assignment. Outside of a
21-school term, a resignation submitted by any teacher after the
22-completion of the school year must be submitted in writing to
23-the secretary of the board a minimum of 30 calendar days prior
24-to the first student attendance day of the following school
25-year or else the teacher will be deemed to have resigned during
26-the school term. Any teacher terminating said service not in

34-the State Superintendent of Education. A referral to the State
35-Superintendent for an alleged violation of this Section must
36-include (i) a dated copy of the teacher's resignation letter,
37-(ii) a copy of the reporting district's current school year
38-calendar, (iii) proof of employment for the school year at
39-issue, (iv) documentation showing that the district's board
40-did not accept the teacher's resignation, and (v) evidence
41-that the teacher left the district in order to accept another
42-teaching assignment. If the district intends to submit a
43-referral to the State Superintendent, the district shall
44-submit the referral to the State Superintendent within 10
45-business days after the board denies acceptance of the
46-resignation. The district shall notify the teacher that it
47-submitted the referral to the State Superintendent within 5
48-business days after submitting the referral to the State
49-Superintendent. The State Superintendent or his or her
50-designee shall convene an informal evidentiary hearing no
51-later than 90 days after receipt of the required documentation
52-from the school district as required in this Section of a
53-resolution by the board. The teacher shall receive a written
54-determination from the State Superintendent or his or her
55-designee no later than 14 days after the hearing is completed.
56-If the State Superintendent or his or her designee finds that
57-the teacher resigned during the school term without the
58-concurrence of the board to accept another teaching
