Permits the use of a drone by a law enforcement agency at a special event to prepare for or monitor crowd size, density, and movement; assess public safety staffing; or to monitor the safety of the participants. If the special event is occurring on private property, use of a drone for this exception shall be authorized by the owners or organizers prior to flight. Provides that a law enforcement agency may use a drone to respond to Public Safety Answering Point (PSAP) dispatched calls for service, when the primary purpose for the response is to locate or assist victims, or both, identify offenders, and to guide emergency response. 1616 2 Be it enacted by the People of the State of Illinois,

403403 2 apply to circumstances in which the drone is used over
404404 3 publicly owned property or private property with permission
405405 4 when the purpose is training peace officers, public relations,
406406 5 conducting infrastructure inspections, or other similar
407407 6 non-law enforcement purposes.
408408 7 "Law enforcement agency" means any agency of this State or
409409 8 a political subdivision of this State which is vested by law
410410 9 with the duty to maintain public order and to enforce criminal
411411 10 laws.
412412 11 "Special event" means a non-routine activity within a
413413 12 community that brings together a large number of people.

416416 15 Sec. 15. Exceptions. This Act does not prohibit the use of
417417 16 a drone by a law enforcement agency:
418418 17 (1) To counter a high risk of a terrorist attack by a
419419 18 specific individual or organization if the United States
420420 19 Secretary of Homeland Security determines that credible
421421 20 intelligence indicates that there is that risk.
422422 21 (2) If a law enforcement agency first obtains a search
423423 22 warrant based on probable cause issued under Section 108-3
424424 23 of the Code of Criminal Procedure of 1963. The warrant
425425 24 must be limited to a period of 45 days, renewable by the
426426 25 judge upon a showing of good cause for subsequent periods

438438 2 (3) If a law enforcement agency possesses reasonable
439439 3 suspicion that, under particular circumstances, swift
440440 4 action is needed to prevent imminent harm to life, or to
441441 5 forestall the imminent escape of a suspect or the
442442 6 destruction of evidence. The use of a drone under this
443443 7 paragraph (3) is limited to a period of 48 hours. Within 24
444444 8 hours of the initiation of the use of a drone under this
445445 9 paragraph (3), the chief executive officer of the law
446446 10 enforcement agency must report in writing the use of a
447447 11 drone to the local State's Attorney.
448448 12 (4) If a law enforcement agency is attempting to
449449 13 locate a missing person or assisting an emotionally
450450 14 disturbed person, and is not also undertaking a criminal
451451 15 investigation.
452452 16 (5) If a law enforcement agency is using a drone
453453 17 solely for crime scene and traffic crash scene
454454 18 photography. Crime scene and traffic crash photography
455455 19 must be conducted in a geographically confined and
456456 20 time-limited manner to document specific occurrences. The
457457 21 use of a drone under this paragraph (5) on private
458458 22 property requires either a search warrant based on
459459 23 probable cause under Section 108-3 of the Code of Criminal
460460 24 Procedure of 1963 or lawful consent to search. The use of a
461461 25 drone under this paragraph (5) on lands, highways,
462462 26 roadways, or areas belonging to this State or political

474474 2 warrant or consent to search. Any law enforcement agency
475475 3 operating a drone under this paragraph (5) shall make
476476 4 every reasonable attempt to only photograph the crime
477477 5 scene or traffic crash scene and avoid other areas.
478478 6 (6) If a law enforcement agency is using a drone
479479 7 during a disaster or public health emergency, as defined
480480 8 by Section 4 of the Illinois Emergency Management Agency
481481 9 Act. The use of a drone under this paragraph (6) does not
482482 10 require an official declaration of a disaster or public
483483 11 health emergency prior to use. A law enforcement agency
484484 12 may use a drone under this paragraph (6) to obtain
485485 13 information necessary for the determination of whether or
486486 14 not a disaster or public health emergency should be
487487 15 declared, to monitor weather or emergency conditions, to
488488 16 survey damage, or to otherwise coordinate response and
489489 17 recovery efforts. The use of a drone under this paragraph
490490 18 (6) is permissible during the disaster or public health
491491 19 emergency and during subsequent response and recovery
492492 20 efforts.
493493 21 (7) If a law enforcement agency is using a drone at a
494494 22 special event to:
495495 23 (A) prepare for or monitor crowd size, density,
496496 24 and movement;
497497 25 (B) assess public safety staffing; or
498498 26 (C) monitor the safety of the participants.

509509 1 If the special event is occurring on private property,
510510 2 use of a drone for this exception shall be authorized by
511511 3 the owners or organizers prior to flight.
512512 4 (8) If a law enforcement agency is using a drone to
513513 5 respond to Public Safety Answering Point (PSAP) dispatched
514514 6 calls for service, when the primary purpose for the
515515 7 response is to locate or assist victims, or both, identify
516516 8 offenders, and to guide emergency response.

519519 11 Sec. 20. Information retention. If a law enforcement
520520 12 agency uses a drone under Section 15 of this Act, the agency
521521 13 within 30 days shall destroy all information gathered by the
522522 14 drone, except that the a supervisor at that agency may retain
523523 15 particular information if:
524524 16 (1) there is reasonable suspicion that the information
525525 17 contains evidence of criminal activity; , or
526526 18 (2) the information is relevant to an ongoing
527527 19 investigation or pending criminal trial; .
528528 20 (3) the information is required to be retained to
529529 21 comply with the Local Records Commission retention
530530 22 schedules;
531531 23 (4) a supervisor at the agency deems that the
532532 24 information will be used exclusively for training

544544 1 If a law enforcement agency uses a drone under Section 15
545545 2 at any demonstration, protest, rally, march, parade, or other
546546 3 gathering for the purpose of expressing political, religious,
547547 4 social, or other views, the law enforcement agency shall
548548 5 destroy all information gathered by the drone within 7 days,
549549 6 except that the agency may retain the particular information
550550 7 if:
551551 8 (1) there is reasonable suspicion that the information
552552 9 contains evidence of criminal activity; or
553553 10 (2) the information is relevant to an ongoing
554554 11 investigation or pending criminal trial.

557557 14 Sec. 25. Information disclosure. Information gathered by
558558 15 a drone is subject to the Freedom of Information Act. If a law
559559 16 enforcement agency uses a drone under Section 15 of this Act,
560560 17 the agency shall not disclose any information gathered by the
561561 18 drone, except that a supervisor of that agency may disclose
562562 19 particular information to another government agency, if (1)
563563 20 there is reasonable suspicion that the information contains
564564 21 evidence of criminal activity, or (2) the information is
565565 22 relevant to an ongoing investigation or pending criminal
566566 23 trial.
