1111 1 AN ACT concerning State government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Civil Administrative Code of Illinois is
1515 5 amended by changing Section 5-715 as follows:

1717 7 Sec. 5-715. Expedited licensure for service members and
1818 8 spouses.
1919 9 (a) In this Section, "service member" means any person
2020 10 who, at the time of application under this Section, is an
2121 11 active duty member of the United States Armed Forces or any
2222 12 reserve component of the United States Armed Forces, the Coast
2323 13 Guard, or the National Guard of any state, commonwealth, or
2424 14 territory of the United States or the District of Columbia or
2525 15 whose active duty service concluded within the preceding 2
2626 16 years before application.
2727 17 (a-5) The Department of Financial and Professional
2828 18 Regulation shall within 180 days after January 1, 2020 (the
2929 19 effective date of Public Act 101-240) designate one staff
3030 20 member as the military liaison within the Department of
3131 21 Financial and Professional Regulation to ensure proper
3232 22 enactment of the requirements of this Section. The military
3333 23 liaison's responsibilities shall also include, but are not

6868 1 limited to: (1) the management of all expedited applications
6969 2 to ensure processing within 30 days after receipt of a
7070 3 completed application; (2) coordination with all military
7171 4 installation military and family support center directors
7272 5 within this State, including virtual, phone, or in-person
7373 6 periodic meetings with each military installation military and
7474 7 family support center; and (3) training by the military
7575 8 liaison to all directors of each division that issues an
7676 9 occupational or professional license to ensure proper
7777 10 application of this Section. At the end of each calendar year,
7878 11 the military liaison shall provide an annual report
7979 12 documenting the expedited licensure program for service
8080 13 members and spouses, and shall deliver that report to the
8181 14 Secretary of Financial and Professional Regulation and the
8282 15 Lieutenant Governor.
8383 16 (b) Each director of a department that issues an
8484 17 occupational or professional license is authorized to and
8585 18 shall issue an expedited license to a service member who meets
8686 19 the requirements under this Section. Review and determination
8787 20 of an application for a license issued by the department shall
8888 21 be expedited by the department within 30 days after the date on
8989 22 which the department receives all necessary documentation
9090 23 required for licensure, including any required information
9191 24 from State and federal agencies. An expedited license shall be
9292 25 issued by the department to any service members meeting the
9393 26 application requirements of this Section, regardless of

105105 2 The service member shall apply to the department on forms
106106 3 provided by the department. An application must include proof
107107 4 that:
108108 5 (1) the applicant is a service member;
109109 6 (2) the applicant holds a valid license in good
110110 7 standing for the occupation or profession issued by
111111 8 another state, commonwealth, possession, or territory of
112112 9 the United States, the District of Columbia, or any
113113 10 foreign jurisdiction;
114114 11 (2.5) the applicant meets the requirements and
115115 12 standards for licensure through endorsement or reciprocity
116116 13 for the occupation or profession for which the applicant
117117 14 is applying;
118118 15 (3) the applicant is assigned to a duty station in
119119 16 this State, has established legal residence in this State,
120120 17 or will reside in this State within 6 months after the date
121121 18 of application for licensure;
122122 19 (4) a complete set of the applicant's fingerprints has
123123 20 been submitted to the Illinois State Police for statewide
124124 21 and national criminal history checks, if applicable to the
125125 22 requirements of the department issuing the license; the
126126 23 applicant shall pay the fee to the Illinois State Police
127127 24 or to the fingerprint vendor for electronic fingerprint
128128 25 processing; no temporary occupational or professional

141141 2 that would cause the denial of an application for
142142 3 licensure under any applicable occupational or
143143 4 professional licensing Act;
144144 5 (5) the applicant is not ineligible for licensure
145145 6 pursuant to Section 2105-165 of the Civil Administrative
146146 7 Code of Illinois;
147147 8 (6) the applicant has submitted an application for
148148 9 full licensure; and
149149 10 (7) the applicant has paid the required fee; fees
150150 11 shall not be refundable.
151151 12 (c) Each director of a department that issues an
152152 13 occupational or professional license is authorized to and
153153 14 shall issue an expedited license to the spouse of a service
154154 15 member who meets the requirements under this Section. Review
155155 16 and determination of an application for a license shall be
156156 17 expedited by the department within 30 days after the date on
157157 18 which the department receives all necessary documentation
158158 19 required for licensure, including information from State and
159159 20 federal agencies. An expedited license shall be issued by the
160160 21 department to any spouse of a service member meeting the
161161 22 application requirements of this Section, regardless of
162162 23 whether the spouse or the service member currently resides in
163163 24 this State. The spouse of a service member shall apply to the

219219 8 (c-3) Each director of a department that is created under
220220 9 this Code and that issues an occupational or professional
221221 10 license is authorized to and shall issue a temporary
222222 11 provisional license to any qualified service member or spouse
223223 12 thereof during the expedited 60-day application review period
224224 13 as provided under subsections (b) and (c). A provisional
225225 14 license shall be issued by the department to any qualified
226226 15 service member or spouse thereof meeting the application
227227 16 requirements under subsections (b) and (c) during the
228228 17 application review period regardless of whether the service
229229 18 member or the spouse currently resides in this State.
230230 19 (c-5) If a service member or his or her spouse relocates
231231 20 from this State, he or she shall be provided an opportunity to
232232 21 place his or her license in inactive status through
233233 22 coordination with the military liaison. If the service member
234234 23 or his or her spouse returns to this State, he or she may
235235 24 reactivate the license in accordance with the statutory
236236 25 provisions regulating the profession and any applicable
237237 26 administrative rules. The license reactivation shall be

248248 1 expedited and completed within 30 days after receipt of a
249249 2 completed application to reactivate the license. A license
250250 3 reactivation is only applicable when the valid license for
251251 4 which the first issuance of a license was predicated is still
252252 5 valid and in good standing. An application to reactivate a
253253 6 license must include proof that the applicant still holds a
254254 7 valid license in good standing for the occupation or
255255 8 profession issued in another State, commonwealth, possession,
256256 9 or territory of the United States, the District of Columbia,
257257 10 or any foreign jurisdiction.
258258 11 (d) All relevant experience of a service member or his or
259259 12 her spouse in the discharge of official duties, including
260260 13 full-time and part-time experience, shall be credited in the
261261 14 calculation of any years of practice in an occupation or
262262 15 profession as may be required under any applicable
263263 16 occupational or professional licensing Act. All relevant
264264 17 training provided by the military and completed by a service
265265 18 member shall be credited to that service member as meeting any
266266 19 training or education requirement under any applicable
267267 20 occupational or professional licensing Act, provided that the
268268 21 training or education is determined by the department to meet
269269 22 the requirements under any applicable Act and is not otherwise
270270 23 contrary to any other licensure requirement.
271271 24 (e) A department may adopt any rules necessary for the
272272 25 implementation and administration of this Section and shall by
273273 26 rule provide for fees for the administration of this Section.
