1111 1 AN ACT concerning public employee benefits.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Pension Code is amended by
1515 5 changing Section 15-159 as follows:

1717 7 Sec. 15-159. Board created.
1818 8 (a) A board of trustees constituted as provided in this
1919 9 Section shall administer this System. The board shall be known
2020 10 as the Board of Trustees of the State Universities Retirement
2121 11 System.

2424 14 (d) Beginning on the 90th day after April 3, 2009 (the
2525 15 effective date of Public Act 96-6), the Board of Trustees
2626 16 shall be constituted as follows:

2828 18 (2) Four trustees appointed by the Governor with the
2929 19 advice and consent of the Senate who may not be members of
3030 20 the system or hold an elective State office and who shall

3232 22 initial appointees under this subsection (d) shall be as

6868 1 years. The term of an appointed trustee shall terminate
6969 2 immediately upon becoming a member of the system or being
7070 3 sworn into an elective State office, and the position
7171 4 shall be considered to be vacant and shall be filled
7272 5 pursuant to subsection (f) of this Section.
7373 6 (3) Four participating employees of the system to be
7474 7 elected from the contributing membership of the system by
7575 8 the contributing members, no more than 2 of which may be
7676 9 from any of the University of Illinois campuses and one of
7777 10 which must be from a community college, who shall serve
7878 11 for a term of 6 years, except that the terms of the initial
7979 12 electees shall be as follows: 2 for a term of 3 years and 2
8080 13 for a term of 6 years.
8181 14 (4) Two annuitants of the system who have been
8282 15 annuitants for at least one full year, to be elected from
8383 16 and by the annuitants of the system, no more than one of
8484 17 which may be from any of the University of Illinois
8585 18 campuses, who shall serve for a term of 6 years, except
8686 19 that the terms of the initial electees shall be as
8787 20 follows: one for a term of 3 years and one for a term of 6
8888 21 years.
8989 22 The chairperson of the Board shall be appointed by the
9090 23 Governor from among the trustees.
9191 24 For the purposes of this Section, the Governor may make a
9292 25 nomination and the Senate may confirm the nominee in advance
9393 26 of the commencement of the nominee's term of office.

104104 1 (e) The 6 elected trustees shall be elected within 90 days
105105 2 after April 3, 2009 (the effective date of Public Act 96-6) for
106106 3 a term beginning on the 90th day after that effective date.
107107 4 Trustees shall be elected thereafter as terms expire for a
108108 5 6-year term beginning July 15 next following their election,
109109 6 and such election shall be held on May 1, or on May 2 when May
110110 7 1 falls on a Sunday. The board may establish rules for the
111111 8 election of trustees to implement the provisions of Public Act
112112 9 96-6 and for future elections. Candidates for the
113113 10 participating trustee shall be nominated by petitions in
114114 11 writing, signed by not less than 400 participants with their
115115 12 addresses shown opposite their names. Candidates for the
116116 13 annuitant trustee shall be nominated by petitions in writing,
117117 14 signed by not less than 100 annuitants with their addresses
118118 15 shown opposite their names. If there is more than one
119119 16 qualified nominee for each elected trustee, then the board
120120 17 shall conduct a secret ballot election by mail for that
121121 18 trustee, in accordance with rules as established by the board.
122122 19 If there is only one qualified person nominated by petition
123123 20 for each elected trustee, then the election as required by
124124 21 this Section shall not be conducted for that trustee and the
125125 22 board shall declare such nominee duly elected. A vacancy
126126 23 occurring in the elective membership of the board shall be
127127 24 filled for the unexpired term by the elected trustees serving
128128 25 on the board for the remainder of the term. Nothing in this
129129 26 subsection shall preclude the adoption of rules providing for

140140 1 internet or phone balloting in addition, or as an alternative,
141141 2 to election by mail.
142142 3 (f) A vacancy in the appointed membership on the board of
143143 4 trustees caused by resignation, death, expiration of term of
144144 5 office, or other reason shall be filled by a qualified person
145145 6 appointed by the Governor for the remainder of the unexpired
146146 7 term.
147147 8 (g) Trustees shall continue in office until their
148148 9 respective successors are appointed and have qualified, except
149149 10 that a trustee elected to one of the participating employee
150150 11 positions after the effective date of this amendatory Act of
151151 12 the 102nd General Assembly shall be disqualified immediately
152152 13 upon the termination of his or her status as a participating
153153 14 employee and a trustee elected to one of the annuitant
154154 15 positions after the effective date of this amendatory Act of
155155 16 the 102nd General Assembly shall be disqualified immediately
156156 17 upon the termination of his or her status as an annuitant
157157 18 receiving a retirement annuity.
158158 19 An elected trustee who is incumbent on the effective date
159159 20 of this amendatory Act of the 102nd General Assembly whose
160160 21 status as a participating employee or annuitant has terminated
161161 22 after having been elected shall continue to serve in the
162162 23 participating employee or annuitant position to which he or
163163 24 she was elected for the remainder of the term.
164164 25 (h) Each trustee must take an oath of office before a
165165 26 notary public of this State and shall qualify as a trustee upon

177177 2 The oath must state that the person will diligently and
178178 3 honestly administer the affairs of the retirement system, and
179179 4 will not knowingly violate or willfully permit to be violated
180180 5 any provisions of this Article.
181181 6 Each trustee shall serve without compensation but shall be
182182 7 reimbursed for expenses necessarily incurred in attending
183183 8 board meetings and carrying out his or her duties as a trustee
184184 9 or officer of the system.
