Permits the use of a drone by a law enforcement agency at a special event to prepare for or monitor crowd size, density, and movement; assess public safety staffing; or to monitor the safety of the participants. Provides that if the special event is occurring on private property, the use of a drone shall be authorized by the owners or organizers prior to flight. Provides that a law enforcement agency may use a drone to respond to Public Safety Answering Point (PSAP) dispatched calls for service, when the primary purpose for the response is to locate or assist victims, or both, identify offenders, or guide emergency response. 1515 1 AN ACT concerning criminal law.
1616 2 Be it enacted by the People of the State of Illinois,

1818 4 Section 5. The Freedom of Information Act is amended by

403403 2 "Law enforcement agency" means any agency of this State or
404404 3 a political subdivision of this State which is vested by law
405405 4 with the duty to maintain public order and to enforce criminal
406406 5 laws.
407407 6 "Special event" means a non-routine activity within a
408408 7 community that brings together a large number of people and
409409 8 the event is in a location where a person does not have a
410410 9 reasonable expectation of privacy.

413413 12 Sec. 15. Exceptions. This Act does not prohibit the use of
414414 13 a drone by a law enforcement agency:
415415 14 (1) To counter a high risk of a terrorist attack by a
416416 15 specific individual or organization if the United States
417417 16 Secretary of Homeland Security determines that credible
418418 17 intelligence indicates that there is that risk.
419419 18 (2) If a law enforcement agency first obtains a search
420420 19 warrant based on probable cause issued under Section 108-3
421421 20 of the Code of Criminal Procedure of 1963. The warrant
422422 21 must be limited to a period of 45 days, renewable by the
423423 22 judge upon a showing of good cause for subsequent periods
424424 23 of 45 days.
425425 24 (3) If a law enforcement agency possesses reasonable
426426 25 suspicion that, under particular circumstances, swift

437437 1 action is needed to prevent imminent harm to life, or to
438438 2 forestall the imminent escape of a suspect or the
439439 3 destruction of evidence. The use of a drone under this
440440 4 paragraph (3) is limited to a period of 48 hours. Within 24
441441 5 hours of the initiation of the use of a drone under this
442442 6 paragraph (3), the chief executive officer of the law
443443 7 enforcement agency must report in writing the use of a
444444 8 drone to the local State's Attorney.
445445 9 (4) If a law enforcement agency is attempting to
446446 10 locate a missing person or assisting an emotionally
447447 11 disturbed person, and is not also undertaking a criminal
448448 12 investigation.
449449 13 (5) If a law enforcement agency is using a drone
450450 14 solely for crime scene and traffic crash scene
451451 15 photography. Crime scene and traffic crash photography
452452 16 must be conducted in a geographically confined and
453453 17 time-limited manner to document specific occurrences. The
454454 18 use of a drone under this paragraph (5) on private
455455 19 property requires either a search warrant based on
456456 20 probable cause under Section 108-3 of the Code of Criminal
457457 21 Procedure of 1963 or lawful consent to search. The use of a
458458 22 drone under this paragraph (5) on lands, highways,
459459 23 roadways, or areas belonging to this State or political
460460 24 subdivisions of this State does not require a search
461461 25 warrant or consent to search. Any law enforcement agency
462462 26 operating a drone under this paragraph (5) shall make

474474 2 scene or traffic crash scene and avoid other areas.
475475 3 (6) If a law enforcement agency is using a drone
476476 4 during a disaster or public health emergency, as defined
477477 5 by Section 4 of the Illinois Emergency Management Agency
478478 6 Act. The use of a drone under this paragraph (6) does not
479479 7 require an official declaration of a disaster or public
480480 8 health emergency prior to use. A law enforcement agency
481481 9 may use a drone under this paragraph (6) to obtain
482482 10 information necessary for the determination of whether or
483483 11 not a disaster or public health emergency should be
484484 12 declared, to monitor weather or emergency conditions, to
485485 13 survey damage, or to otherwise coordinate response and
486486 14 recovery efforts. The use of a drone under this paragraph
487487 15 (6) is permissible during the disaster or public health
488488 16 emergency and during subsequent response and recovery
489489 17 efforts.
490490 18 (7) If a law enforcement agency is using a drone at a
491491 19 special event to:
492492 20 (A) prepare for or monitor crowd size, density,
493493 21 and movement;
494494 22 (B) assess public safety staffing; or
495495 23 (C) monitor the safety of the participants.
496496 24 If the special event is occurring on private property,
497497 25 the use of a drone for this exception shall be authorized
498498 26 by the owners or organizers prior to flight.

509509 1 (8) If a law enforcement agency is using a drone to
510510 2 respond to Public Safety Answering Point (PSAP) dispatched
511511 3 calls for service, when the primary purpose for the
512512 4 response is to locate or assist victims, or both, identify
513513 5 offenders, or guide emergency response.
514514 6 (9) If a law enforcement agency is using a drone under
515515 7 circumstances in which the drone is used over private
516516 8 property with permission or over publicly owned property
517517 9 for the purpose of training peace officers, public
518518 10 relations, conducting infrastructure inspections, or other
519519 11 similar non-law enforcement purposes.

522522 14 Sec. 20. Information retention. If a law enforcement
523523 15 agency uses a drone under Section 15 of this Act, the agency
524524 16 within 30 days shall destroy all information gathered by the
525525 17 drone, except that the a supervisor at that agency may retain
526526 18 particular information if:
527527 19 (1) there is reasonable suspicion that the information
528528 20 contains evidence of criminal activity; , or
529529 21 (2) the information is relevant to an ongoing
530530 22 investigation or pending criminal trial; .
531531 23 (3) the information is required to be retained to
532532 24 comply with the Local Records Commission retention

547547 4 If a law enforcement agency uses a drone under Section 15
548548 5 at any demonstration, protest, rally, march, parade, or other
549549 6 gathering for the purpose of expressing political, religious,
550550 7 social, or other views, the law enforcement agency shall
551551 8 destroy all information gathered by the drone within 7 days,
552552 9 except that the agency may retain the particular information
553553 10 if:
554554 11 (1) there is a reasonable suspicion that the
555555 12 information contains evidence of criminal activity; or
556556 13 (2) the information is relevant to an ongoing
557557 14 investigation or pending criminal trial.

561561 18 a drone is subject to the Freedom of Information Act. If a law
562562 19 enforcement agency uses a drone under Section 15 of this Act,

565565 22 particular information to another government agency, if (1)
566566 23 there is reasonable suspicion that the information contains
