4-AN ACT concerning State government.
5-Be it enacted by the People of the State of Illinois,
6-represented in the General Assembly:
7-Section 5. The State Treasurer Act is amended by changing
8-Section 18 as follows:

10-Sec. 18. Banking and automated automatic teller machine
11-services.
12-(a) The Treasurer may enter into written agreements with
13-financial institutions for the provision of banking services
14-at the State Capitol and with automated teller machine
15-providers for the provision of automated automatic teller
16-machine services at State office buildings, State parks, State
17-tourism centers, and State fairs at Springfield and DuQuoin.
18-The Treasurer shall establish competitive procedures for the
19-selection of financial institutions and automated teller
20-machine providers to provide the services authorized under
21-this Section. No State agency may procure services authorized
22-by this Section without the approval of the Treasurer.
23-(b) The Treasurer shall enter into written agreements with
24-the authorities having jurisdiction of the property where the
25-services are intended to be provided. These agreements shall
26-include, but need not be limited to, the quantity of machines

37-(c) The Treasurer's agreement with a financial institution
38-or automated teller machine providers may authorize the
39-financial institution or automated teller machine providers to
40-provide any or all of the banking services that the financial
41-institution or automated teller machine providers is otherwise
42-authorized by law to provide to the public.
43-The Treasurer's agreement with a financial institution or
44-automated teller machine providers shall establish the amount
45-of compensation to be paid by the financial institution. The
46-financial institution or automated teller machine providers
47-shall pay the compensation to the Treasurer in accordance with
48-the terms of the agreement. The Treasurer shall deposit moneys
49-received under this Section into the State Treasurer's Bank
50-Services Trust Fund. Treasurer's Rental Fee Fund, a special
51-fund hereby created in the State treasury. The Treasurer shall
52-use the moneys in the Fund for the operation of the program
53-established under this Section. If the Treasurer determines
54-that any moneys in the Treasurer's Rental Fee Fund are in
55-excess of the amount necessary to sustain the operation of the
56-program established under this Section, the Treasurer may
57-transfer any unobligated and unexpended moneys from the
58-Treasurer's Rental Fee Fund into the State Pensions Fund.

61-(d) This Section does not apply to a State office building
62-in which a currency exchange or a credit union providing
63-financial services located in the building on July 1, 1995
64-(the effective date of Public Act 88-640) is operating.
65-(e) Notwithstanding any other provision of law to the
66-contrary, and in addition to any other transfers that may be
67-provided by law, within 30 days of the effective date of this
68-amendatory Act of the 103rd General Assembly, or as soon
69-thereafter as practicable, the State Comptroller shall direct
70-and the State Treasurer shall transfer the remaining balance
71-from the Treasurer's Rental Fee Fund into the State
72-Treasurer's Bank Services Trust Fund. Upon completion of the
73-transfer, the Treasurer's Rental Fee Fund is dissolved, and
74-any future deposits due to that Fund and any outstanding
75-obligations or liabilities of that Fund shall pass to the
76-State Treasurer's Bank Services Trust Fund.

78-Section 10. The State Finance Act is amended by changing
79-Section 5.397 as follows:

81-Sec. 5.397. The Treasurer's Rental Fee Fund. This Fund is
82-dissolved upon the transfer of the remaining balance from the
83-Treasurer's Rental Fee Fund to the State Treasurer's Bank
84-Services Trust Fund as provided under subsection (e) of

88-repealed on January 1, 2025.

94-State treasury a special fund to be known as the State
95-Treasurer's Bank Services Trust Fund. Moneys deposited in the
96-Fund shall be used by the State Treasurer to pay the cost of
97-the following banking services: processing of payments of
98-taxes, fees, and other moneys due the State; transactional,
99-technological, consultant, legal service charges, and other
100-operational expenses of the State Treasurer's Office related
101-to the investment or safekeeping of funds under the
102-Treasurer's control; the provision of banking and automated
103-teller machine services at State office buildings, State
104-parks, State tourism centers, and State fairs at Springfield
105-and DuQuoin; and the cost of paying bondholders and legal
106-services under the State's general obligation bond program.
