1111 1 AN ACT concerning regulation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the
1515 5 Enhanced Oil Recovery Ban Act.
1616 6 Section 5. Intent. The General Assembly finds and declares
1717 7 that the purpose of carbon-capture technologies and carbon
1818 8 capture and sequestration is to facilitate the transition to a
1919 9 carbon-neutral society and not to facilitate continued
2020 10 dependence upon fossil fuel production.
2121 11 Section 10. Definitions. In this Act:
2222 12 "Carbon dioxide capture project" means a project that uses
2323 13 a process to separate carbon dioxide from industrial or
2424 14 energy-related sources, other than oil or gas production from
2525 15 a well, and produces a concentrated fluid of carbon dioxide
2626 16 with the intent of preventing emission of the carbon dioxide
2727 17 into the atmosphere.
2828 18 "Carbon dioxide capture and sequestration project" means a
2929 19 carbon dioxide capture project that seeks to provide for the
3030 20 long-term isolation of the concentrated carbon dioxide fluid
3131 21 from the atmosphere through storage in a geologic formation.
3232 22 "Class II well" has the same meaning as in 40 CFR 144.6.

6767 1 "Concentrated carbon dioxide fluid" means a fluid that
6868 2 contains concentrated carbon dioxide that is proportionately
6969 3 greater than the ambient atmospheric concentration of carbon

7171 5 Section 15. Enhanced oil recovery ban.
7272 6 (a) A person shall not inject a concentrated carbon
7373 7 dioxide fluid produced by a carbon dioxide capture project or
7474 8 carbon dioxide capture and sequestration project into a Class
7575 9 II well for purposes of enhanced oil recovery, including the
7676 10 facilitation of enhanced oil recovery from another well.
7777 11 (b) An individual who violates this Act is subject to a
7878 12 fine of $20,000 for each violation.
7979 13 Section 99. Effective date. This Act takes effect upon
