11	11	1 AN ACT concerning regulation.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 1. Short title. This Act may be cited as the
15	15	5 Enhanced Oil Recovery Ban Act.
16	16	6 Section 5. Intent. The General Assembly finds and declares
17	17	7 that the purpose of carbon-capture technologies and carbon
18	18	8 capture and sequestration is to facilitate the transition to a
19	19	9 carbon-neutral society and not to facilitate continued
20	20	10 dependence upon fossil fuel production.
21	21	11 Section 10. Definitions. In this Act:
22	22	12 "Carbon dioxide capture project" means a project that uses
23	23	13 a process to separate carbon dioxide from industrial or
24	24	14 energy-related sources, other than oil or gas production from
25	25	15 a well, and produces a concentrated fluid of carbon dioxide
26	26	16 with the intent of preventing emission of the carbon dioxide
27	27	17 into the atmosphere.
28	28	18 "Carbon dioxide capture and sequestration project" means a
29	29	19 carbon dioxide capture project that seeks to provide for the
30	30	20 long-term isolation of the concentrated carbon dioxide fluid
31	31	21 from the atmosphere through storage in a geologic formation.
32	32	22 "Class II well" has the same meaning as in 40 CFR 144.6.

67	67	1 "Concentrated carbon dioxide fluid" means a fluid that
68	68	2 contains concentrated carbon dioxide that is proportionately
69	69	3 greater than the ambient atmospheric concentration of carbon
70	70	4 dioxide.
71	71	5 Section 15. Enhanced oil recovery ban.
72	72	6 (a) A person shall not inject a concentrated carbon
73	73	7 dioxide fluid produced by a carbon dioxide capture project or
74	74	8 carbon dioxide capture and sequestration project into a Class
75	75	9 II well for purposes of enhanced oil recovery, including the
76	76	10 facilitation of enhanced oil recovery from another well.
77	77	11 (b) An individual who violates this Act is subject to a
78	78	12 fine of $20,000 for each violation.
79	79	13 Section 99. Effective date. This Act takes effect upon
80	80	14 becoming law.
