134134 1 preserve a record of all proceedings at the hearing of any case
135135 2 in which a license may be revoked, suspended, placed on
136136 3 probationary status, reprimanded, fined, or subjected to other

138138 5 disciplinary action is authorized in any licensing Act
139139 6 administered by the Department. The notice, complaint, and all

150150 17 person interested, who may obtain a copy of the transcript of

154154 21 Department for certifying the record.

171171 4 (a) An EMS Medical Director may suspend from participation

176176 9 (b) Prior to suspending any individual or entity, an EMS
177177 10 Medical Director shall provide an opportunity for a hearing

179179 12 subsection (f) and the rules promulgated by the Department.
180180 13 (1) If the local System review board affirms or
181181 14 modifies the EMS Medical Director's suspension order, the
182182 15 individual or entity shall have the opportunity for a
183183 16 review of the local board's decision by the State EMS
184184 17 Disciplinary Review Board, pursuant to Section 3.45 of
185185 18 this Act.
186186 19 (2) If the local System review board reverses or
187187 20 modifies the EMS Medical Director's order, the EMS Medical
188188 21 Director shall have the opportunity for a review of the
189189 22 local board's decision by the State EMS Disciplinary
190190 23 Review Board, pursuant to Section 3.45 of this Act.
191191 24 (3) The suspension shall commence only upon the
192192 25 occurrence of one of the following:

206206 3 (B) the order has been affirmed or modified by the

211211 8 local system review board, and the local board's
212212 9 decision has been affirmed or modified by the State

214214 11 (c) An EMS Medical Director may immediately suspend an
215215 12 EMR, EMD, EMT, EMT-I, A-EMT, Paramedic, ECRN, PHRN, LI, PHPA,
216216 13 PHAPRN, or other individual or entity if he or she finds that
217217 14 the continuation in practice by the individual or entity would
218218 15 constitute an imminent danger to the public. The suspended
219219 16 individual or entity shall be issued an immediate verbal
220220 17 notification followed by a written suspension order by the EMS
221221 18 Medical Director which states the length, terms and basis for
222222 19 the suspension.
223223 20 (1) Within 24 hours following the commencement of the
224224 21 suspension, the EMS Medical Director shall deliver to the
225225 22 Department, by messenger, telefax, or other
226226 23 Department-approved electronic communication, a copy of
227227 24 the suspension order and copies of any written materials
228228 25 which relate to the EMS Medical Director's decision to
229229 26 suspend the individual or entity. All medical and

240240 1 patient-specific information, including Department
241241 2 findings with respect to the quality of care rendered,
242242 3 shall be strictly confidential pursuant to the Medical
243243 4 Studies Act (Part 21 of Article VIII of the Code of Civil
244244 5 Procedure).
245245 6 (2) Within 24 hours following the commencement of the
246246 7 suspension, the suspended individual or entity may deliver
247247 8 to the Department, by messenger, telefax, or other
248248 9 Department-approved electronic communication, a written
249249 10 response to the suspension order and copies of any written
250250 11 materials which the individual or entity feels are
251251 12 appropriate. All medical and patient-specific information,
252252 13 including Department findings with respect to the quality
253253 14 of care rendered, shall be strictly confidential pursuant
254254 15 to the Medical Studies Act.
255255 16 (3) Within 24 hours following receipt of the EMS
256256 17 Medical Director's suspension order or the individual or
257257 18 entity's written response, whichever is later, the
258258 19 Director or the Director's designee shall determine
259259 20 whether the suspension should be stayed pending an
260260 21 opportunity for a hearing or review in accordance with
261261 22 this Act, or whether the suspension should continue during
262262 23 the course of that hearing or review. The Director or the
263263 24 Director's designee shall issue this determination to the
264264 25 EMS Medical Director, who shall immediately notify the

282282 7 board, in accordance with subsection (f) and the rules
283283 8 promulgated by the Department.
284284 9 (1) If the local System review board affirms or
285285 10 modifies the EMS Medical Director's suspension order, the
286286 11 individual or entity shall have the opportunity for a
287287 12 review of the local board's decision by the State EMS
288288 13 Disciplinary Review Board, pursuant to Section 3.45 of
289289 14 this Act.
290290 15 (2) If the local System review board reverses or
291291 16 modifies the EMS Medical Director's suspension order, the
292292 17 EMS Medical Director shall have the opportunity for a
293293 18 review of the local board's decision by the State EMS
294294 19 Disciplinary Review Board, pursuant to Section 3.45 of
295295 20 this Act.
296296 21 (3) The suspended individual or entity may elect to
297297 22 bypass the local System review board and seek direct
298298 23 review of the EMS Medical Director's suspension order by
299299 24 the State EMS Disciplinary Review Board.
300300 25 (e) The Resource Hospital shall designate a local System

317317 6 of that hearing and thereafter prepare a transcript of the
318318 7 proceedings. The transcript, all documents or materials
319319 8 received as evidence during the hearing and the local System

321321 10 custody of the EMS system. The System shall implement a
322322 11 decision of the local System review board unless that decision
323323 12 has been appealed to the State Emergency Medical Services
324324 13 Disciplinary Review Board in accordance with this Act and the
325325 14 rules of the Department.
326326 15 (f) The Resource Hospital shall implement a decision of
327327 16 the State Emergency Medical Services Disciplinary Review Board
328328 17 which has been rendered in accordance with this Act and the
329329 18 rules of the Department.

936936 11 Sec. 3.5. Uncertified practice; violation; civil penalty.
937937 12 (a) Any person who practices, offers to practice, attempts
938938 13 to practice, or holds oneself out to practice as a shorthand
939939 14 reporter or a voice writer reporter without being certified
940940 15 under this Act shall, in addition to any other penalty
941941 16 provided by law, pay a civil penalty to the Department in an
942942 17 amount not to exceed $10,000 for each offense as determined by
943943 18 the Department and the assessment of costs as provided under
944944 19 Section 23.3 of this Act. The civil penalty shall be assessed
945945 20 by the Department after a hearing is held in accordance with
946946 21 the provisions set forth in this Act regarding the provision
947947 22 of a hearing for the discipline of a licensee.
948948 23 (b) The Department has the authority and power to
949949 24 investigate any and all unlicensed activity.
950950 25 (c) The civil penalty shall be paid within 60 days after

10061006 11 Department's licensure maintenance unit. It is the duty of the
10071007 12 applicant or licensee to inform the Department of any change
10081008 13 of address and those changes must be made either through the
10091009 14 Department's Internet website or by contacting the Department.
10101010 15 (8) "The practice of voice writer reporting" means
10111011 16 reporting, by the use of a system of repeating words of the
10121012 17 speaker into a closed microphone voice dictation silencer that
10131013 18 is capable of digital translation into text of grand jury
10141014 19 proceedings, court proceedings, court-related proceedings,
10151015 20 pretrial examinations, depositions, motions, and related
10161016 21 proceedings of like character, or proceedings of an
10171017 22 administrative agency when the final decision of the
10181018 23 administrative agency is likely to be subject to judicial
10191019 24 review under the provisions of the Administrative Review Law.

11031103 3 Reporters Board. The Secretary shall appoint a Certified

11171117 17 this Act. One , and one member must be a member of the public
11181118 18 who is not certified under this Act, or a similar Act of
11191119 19 another jurisdiction. Members of the Board shall have no
11201120 20 liability in any action based upon any disciplinary proceeding
11211121 21 or other activity performed in good faith as members of the
11221122 22 Board.
11231123 23 Members shall serve 4 year terms and until their
11241124 24 successors are appointed and qualified. No member shall be
11251125 25 reappointed to the Board for a term that would cause the

11511151 15 conduct, discipline and qualifications of candidates and
11521152 16 certificate holders under this Act.
11531153 17 Members of the Board shall be reimbursed for all
11541154 18 legitimate, necessary, and authorized expenses incurred in
11551155 19 attending the meetings of the Board.
11561156 20 Members of the Board have no liability in any action based
11571157 21 upon any disciplinary proceedings or other activity performed
11581158 22 in good faith as members of the Board.

12231223 17 shall be denied. If an applicant for examination for
12241224 18 certification under this Act fails to pass the examination
12251225 19 within 3 years after filing his application, the application
12261226 20 shall be denied. However, such applicant may thereafter make a
12271227 21 new application accompanied by the required fee.
12281228 22 The Department may employ consultants for the purpose of
12291229 23 preparing and conducting examinations.
12301230 24 An applicant has one year from the date of notification of
12311231 25 successful completion of the examination to apply to the

13591359 12 under the supervision of the United States preliminary to

13611361 14 his certificate renewed or restored without paying any lapsed
13621362 15 renewal fees if within 2 years after termination of such
13631363 16 service, training, or education except under conditions other
13641364 17 than honorable, the reporter he furnished the Department with
13651365 18 satisfactory evidence to the effect that the reporter he has
13661366 19 been so engaged and that the reporter's his service, training,
13671367 20 or education has been so terminated.

15691569 9 (b) The determination by a circuit court that a
15701570 10 certificate holder is subject to involuntary admission or
15711571 11 judicial admission as provided in the Mental Health and
15721572 12 Developmental Disabilities Code, operates as an automatic
15731573 13 suspension. Such suspension will end only upon a finding by a
15741574 14 court that the patient is no longer subject to involuntary
15751575 15 admission or judicial admission, an order by the court so
15761576 16 finding and discharging the patient. In any case where a
15771577 17 license is suspended under this Section, the licensee may file
15781578 18 a petition for restoration and shall include evidence
15791579 19 acceptable to the Department that the licensee can resume
15801580 20 practice in compliance with acceptable and prevailing
15811581 21 standards of the profession.
15821582 22 (c) In cases where the Department of Healthcare and Family
15831583 23 Services has previously determined a licensee or a potential
15841584 24 licensee is more than 30 days delinquent in the payment of
15851585 25 child support and has subsequently certified the delinquency

16031603 7 (d) In enforcing this Section, the Department, upon a
16041604 8 showing of a possible violation, may compel any individual who
16051605 9 is certified under this Act or any individual who has applied
16061606 10 for certification under this Act to submit to a mental or
16071607 11 physical examination and evaluation, or both, which may
16081608 12 include a substance abuse or sexual offender evaluation, at
16091609 13 the expense of the Department. The Department shall
16101610 14 specifically designate the examining physician licensed to
16111611 15 practice medicine in all of its branches or, if applicable,
16121612 16 the multidisciplinary team involved in providing the mental or
16131613 17 physical examination and evaluation, or both. The
16141614 18 multidisciplinary team shall be led by a physician licensed to
16151615 19 practice medicine in all of its branches and may consist of one
16161616 20 or more or a combination of physicians licensed to practice
16171617 21 medicine in all of its branches, licensed chiropractic
16181618 22 physicians, licensed clinical psychologists, licensed clinical
16191619 23 social workers, licensed clinical professional counselors, and
16201620 24 other professional and administrative staff. Any examining
16211621 25 physician or member of the multidisciplinary team may require
16221622 26 any person ordered to submit to an examination and evaluation

16461646 14 voice writer reporter, or applicant, including testimony
16471647 15 concerning any supplemental testing or documents relating to
16481648 16 the examination and evaluation. No information, report,
16491649 17 record, or other documents in any way related to the
16501650 18 examination and evaluation shall be excluded by reason of any
16511651 19 common law or statutory privilege relating to communication
16521652 20 between the licensee or applicant and the examining physician
16531653 21 or any member of the multidisciplinary team. No authorization
16541654 22 is necessary from the certified shorthand reporter, certified
16551655 23 voice writer reporter, or applicant ordered to undergo an
16561656 24 evaluation and examination for the examining physician or any
16571657 25 member of the multidisciplinary team to provide information,
16581658 26 reports, records, or other documents or to provide any

16751675 7 result in an automatic suspension, without hearing, until such
16761676 8 time as the individual submits to the examination. If the

16781678 10 voice writer reporter unable to practice because of the
16791679 11 reasons set forth in this Section, the Department shall
16801680 12 require the certified shorthand reporter or certified voice
16811681 13 writer reporter to submit to care, counseling, or treatment by
16821682 14 physicians approved or designated by the Department, as a
16831683 15 condition for continued, reinstated, or renewed certification.
16841684 16 When the Secretary immediately suspends a certificate
16851685 17 under this Section, a hearing upon the person's certificate
16861686 18 must be convened by the Department within 15 days after the
16871687 19 suspension and completed without appreciable delay. The
16881688 20 Department shall have the authority to review the certified
16891689 21 shorthand reporter's or certified voice writer reporter's
16901690 22 record of treatment and counseling regarding the impairment,
16911691 23 to the extent permitted by applicable federal statutes and
16921692 24 regulations safeguarding the confidentiality of medical
16931693 25 records.

17521752 13 provisions of this Act then any certified shorthand reporter,
17531753 14 any certified voice writer reporter, any interested party or
17541754 15 any person injured thereby may, in addition to the Secretary,
17551755 16 petition for relief as provided in subsection (a).
17561756 17 (c) Whenever in the opinion of the Department any person
17571757 18 violates any provision of this Act, the Department may issue a
17581758 19 rule to show cause why an order to cease and desist should not
17591759 20 be entered against that individual. The rule shall clearly set
17601760 21 forth the grounds relied upon by the Department and shall
17611761 22 provide a period of 7 days from the date of the rule to file an
17621762 23 answer to the satisfaction of the Department. Failure to
17631763 24 answer to the satisfaction of the Department shall cause an
17641764 25 order to cease and desist to be issued forthwith.
