15	15	1 AN ACT concerning criminal law.
16	16	2 Be it enacted by the People of the State of Illinois,
17	17	3 represented in the General Assembly:
18	18	4 Section 5. The Freedom of Information Act is amended by
19	19	5 changing Section 7.5 as follows:
20	20	6 (5 ILCS 140/7.5)
21	21	7 Sec. 7.5. Statutory exemptions. To the extent provided for
22	22	8 by the statutes referenced below, the following shall be
23	23	9 exempt from inspection and copying:
24	24	10 (a) All information determined to be confidential
25	25	11 under Section 4002 of the Technology Advancement and
26	26	12 Development Act.
27	27	13 (b) Library circulation and order records identifying
28	28	14 library users with specific materials under the Library
29	29	15 Records Confidentiality Act.
30	30	16 (c) Applications, related documents, and medical
31	31	17 records received by the Experimental Organ Transplantation
32	32	18 Procedures Board and any and all documents or other
33	33	19 records prepared by the Experimental Organ Transplantation
34	34	20 Procedures Board or its staff relating to applications it
35	35	21 has received.

404	404	3 "Law enforcement agency" means any agency of this State or
405	405	4 a political subdivision of this State which is vested by law
406	406	5 with the duty to maintain public order and to enforce criminal

408	408	7 "Special event" means a nonroutine activity that is open
409	409	8 to the public within a community and brings together a large
410	410	9 number of people.

413	413	12 Sec. 15. Exceptions. This Act does not prohibit the use of
414	414	13 a drone by a law enforcement agency:
415	415	14 (1) To counter a high risk of a terrorist attack by a
416	416	15 specific individual or organization if the United States
417	417	16 Secretary of Homeland Security determines that credible
418	418	17 intelligence indicates that there is that risk.
419	419	18 (2) If a law enforcement agency first obtains a search
420	420	19 warrant based on probable cause issued under Section 108-3
421	421	20 of the Code of Criminal Procedure of 1963. The warrant
422	422	21 must be limited to a period of 45 days, renewable by the
423	423	22 judge upon a showing of good cause for subsequent periods
424	424	23 of 45 days.
425	425	24 (3) If a law enforcement agency possesses reasonable
426	426	25 suspicion that, under particular circumstances, swift

437	437	1 action is needed to prevent imminent harm to life, or to
438	438	2 forestall the imminent escape of a suspect or the
439	439	3 destruction of evidence. The use of a drone under this
440	440	4 paragraph (3) is limited to a period of 48 hours. Within 24
441	441	5 hours of the initiation of the use of a drone under this
442	442	6 paragraph (3), the chief executive officer of the law
443	443	7 enforcement agency must report in writing the use of a
444	444	8 drone to the local State's Attorney.
445	445	9 (4) If a law enforcement agency is attempting to
446	446	10 locate a missing person, and is not also undertaking a
447	447	11 criminal investigation.
448	448	12 (5) If a law enforcement agency is using a drone
449	449	13 solely for crime scene and traffic crash scene
450	450	14 photography. Crime scene and traffic crash photography
451	451	15 must be conducted in a geographically confined and
452	452	16 time-limited manner to document specific occurrences. The
453	453	17 use of a drone under this paragraph (5) on private
454	454	18 property requires either a search warrant based on
455	455	19 probable cause under Section 108-3 of the Code of Criminal
456	456	20 Procedure of 1963 or lawful consent to search. The use of a
457	457	21 drone under this paragraph (5) on lands, highways,
458	458	22 roadways, or areas belonging to this State or political
459	459	23 subdivisions of this State does not require a search
460	460	24 warrant or consent to search. Any law enforcement agency
461	461	25 operating a drone under this paragraph (5) shall make
462	462	26 every reasonable attempt to only photograph the crime

474	474	2 (6) If a law enforcement agency is using a drone
475	475	3 during a disaster or public health emergency, as defined
476	476	4 by Section 4 of the Illinois Emergency Management Agency
477	477	5 Act. The use of a drone under this paragraph (6) does not
478	478	6 require an official declaration of a disaster or public
479	479	7 health emergency prior to use. A law enforcement agency
480	480	8 may use a drone under this paragraph (6) to obtain
481	481	9 information necessary for the determination of whether or
482	482	10 not a disaster or public health emergency should be
483	483	11 declared, to monitor weather or emergency conditions, to
484	484	12 survey damage, or to otherwise coordinate response and
485	485	13 recovery efforts. The use of a drone under this paragraph
486	486	14 (6) is permissible during the disaster or public health
487	487	15 emergency and during subsequent response and recovery
488	488	16 efforts.
489	489	17 (7) If a law enforcement agency is using a drone at a
490	490	18 special event to:
491	491	19 (A) prepare for or monitor crowd size, density,
492	492	20 and movement;
493	493	21 (B) assess public safety staffing; or
494	494	22 (C) monitor the safety of the participants.
495	495	23 (8) If a law enforcement agency is using a drone to
496	496	24 respond to Public Safety Answering Point (PSAP) dispatched
497	497	25 calls for service, when the primary purpose for the
498	498	26 response is to locate or assist victims, or both, identify

512	512	4 Sec. 20. Information retention. If a law enforcement
513	513	5 agency uses a drone under Section 15 of this Act, the agency
514	514	6 within 30 days shall destroy all information gathered by the
515	515	7 drone, except that the a supervisor at that agency may retain
516	516	8 particular information if:
517	517	9 (1) there is reasonable suspicion that the information
518	518	10 contains evidence of criminal activity; , or
519	519	11 (2) the information is relevant to an ongoing
520	520	12 investigation or pending criminal trial; .
521	521	13 (3) the information is required to be retained to
522	522	14 comply with the Local Records Commission retention
523	523	15 schedules; or
524	524	16 (4) a supervisor at the agency deems that the
525	525	17 information will be used exclusively for training
526	526	18 purposes.
527	527	19 If a law enforcement agency uses a drone under Section 15
528	528	20 at any demonstration, protest, rally, march, parade, or other
529	529	21 gathering for the purpose of expressing political, religious,
530	530	22 social, or other views, the law enforcement agency shall
531	531	23 destroy all information gathered by the drone within 7 days,
532	532	24 except that the agency may retain the particular information

551	551	8 a drone is subject to the Freedom of Information Act. If a law
552	552	9 enforcement agency uses a drone under Section 15 of this Act,
553	553	10 the agency shall not disclose any information gathered by the
554	554	11 drone, except that a supervisor of that agency may disclose
555	555	12 particular information to another government agency, if (1)
556	556	13 there is reasonable suspicion that the information contains
557	557	14 evidence of criminal activity, or (2) the information is
558	558	15 relevant to an ongoing investigation or pending criminal
