1515 1 AN ACT concerning criminal law.
1616 2 Be it enacted by the People of the State of Illinois,

1818 4 Section 5. The Freedom of Information Act is amended by

413413 12 Sec. 15. Exceptions. This Act does not prohibit the use of
414414 13 a drone by a law enforcement agency:
415415 14 (1) To counter a high risk of a terrorist attack by a
416416 15 specific individual or organization if the United States
417417 16 Secretary of Homeland Security determines that credible
418418 17 intelligence indicates that there is that risk.
419419 18 (2) If a law enforcement agency first obtains a search

438438 2 forestall the imminent escape of a suspect or the
439439 3 destruction of evidence. The use of a drone under this
440440 4 paragraph (3) is limited to a period of 48 hours. Within 24
441441 5 hours of the initiation of the use of a drone under this
442442 6 paragraph (3), the chief executive officer of the law
443443 7 enforcement agency must report in writing the use of a
444444 8 drone to the local State's Attorney.
445445 9 (4) If a law enforcement agency is attempting to
446446 10 locate a missing person, and is not also undertaking a
447447 11 criminal investigation.
448448 12 (5) If a law enforcement agency is using a drone
449449 13 solely for crime scene and traffic crash scene
450450 14 photography. Crime scene and traffic crash photography
451451 15 must be conducted in a geographically confined and
452452 16 time-limited manner to document specific occurrences. The
453453 17 use of a drone under this paragraph (5) on private
454454 18 property requires either a search warrant based on
455455 19 probable cause under Section 108-3 of the Code of Criminal
456456 20 Procedure of 1963 or lawful consent to search. The use of a
457457 21 drone under this paragraph (5) on lands, highways,
458458 22 roadways, or areas belonging to this State or political
459459 23 subdivisions of this State does not require a search
460460 24 warrant or consent to search. Any law enforcement agency
461461 25 operating a drone under this paragraph (5) shall make
462462 26 every reasonable attempt to only photograph the crime

474474 2 (6) If a law enforcement agency is using a drone
475475 3 during a disaster or public health emergency, as defined
476476 4 by Section 4 of the Illinois Emergency Management Agency
477477 5 Act. The use of a drone under this paragraph (6) does not
478478 6 require an official declaration of a disaster or public
479479 7 health emergency prior to use. A law enforcement agency
480480 8 may use a drone under this paragraph (6) to obtain
481481 9 information necessary for the determination of whether or
482482 10 not a disaster or public health emergency should be
483483 11 declared, to monitor weather or emergency conditions, to
484484 12 survey damage, or to otherwise coordinate response and
485485 13 recovery efforts. The use of a drone under this paragraph
486486 14 (6) is permissible during the disaster or public health
487487 15 emergency and during subsequent response and recovery
488488 16 efforts.
489489 17 (7) If a law enforcement agency is using a drone at a
490490 18 special event to:
491491 19 (A) prepare for or monitor crowd size, density,
492492 20 and movement;
493493 21 (B) assess public safety staffing; or
494494 22 (C) monitor the safety of the participants.
495495 23 (8) If a law enforcement agency is using a drone to
496496 24 respond to Public Safety Answering Point (PSAP) dispatched
497497 25 calls for service, when the primary purpose for the
498498 26 response is to locate or assist victims, or both, identify

514514 6 within 30 days shall destroy all information gathered by the
515515 7 drone, except that the a supervisor at that agency may retain
516516 8 particular information if:
517517 9 (1) there is reasonable suspicion that the information
518518 10 contains evidence of criminal activity; , or
519519 11 (2) the information is relevant to an ongoing
520520 12 investigation or pending criminal trial; .
521521 13 (3) the information is required to be retained to
522522 14 comply with the Local Records Commission retention
523523 15 schedules; or
524524 16 (4) a supervisor at the agency deems that the
525525 17 information will be used exclusively for training
526526 18 purposes.
527527 19 If a law enforcement agency uses a drone under Section 15
528528 20 at any demonstration, protest, rally, march, parade, or other
529529 21 gathering for the purpose of expressing political, religious,
530530 22 social, or other views, the law enforcement agency shall
531531 23 destroy all information gathered by the drone within 7 days,
532532 24 except that the agency may retain the particular information
