1111 1 AN ACT concerning revenue.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Film Production Services Tax Credit Act of
1515 5 2008 is amended by changing Section 10 as follows:

1717 7 Sec. 10. Definitions. As used in this Act:
1818 8 "Accredited production" means: (i) for productions
1919 9 commencing before May 1, 2006, a film, video, or television
2020 10 production that has been certified by the Department in which
2121 11 the aggregate Illinois labor expenditures included in the cost
2222 12 of the production, in the period that ends 12 months after the
2323 13 time principal filming or taping of the production began,
2424 14 exceed $100,000 for productions of 30 minutes or longer, or
2525 15 $50,000 for productions of less than 30 minutes; and (ii) for
2626 16 productions commencing on or after May 1, 2006, a film, video,
2727 17 or television production that has been certified by the
2828 18 Department in which the Illinois production spending included
2929 19 in the cost of production in the period that ends 12 months
3030 20 after the time principal filming or taping of the production
3131 21 began exceeds $100,000 for productions of 30 minutes or longer
3232 22 or exceeds $50,000 for productions of less than 30 minutes.

6868 1 July 1, 2023, Illinois production spending includes only
6969 2 spending for the period that ends 12 months after the time
7070 3 principal filming or taping of the production began. On and
7171 4 after July 1, 2023, "accredited production" also includes
7272 5 productions in which only post production activities occur in
7373 6 Illinois. "Accredited production" does not include a
7474 7 production that:
7575 8 (1) is news, current events, or public programming, or
7676 9 a program that includes weather or market reports;
7777 10 (2) is a talk show;
7878 11 (3) is a production in respect of a game,
7979 12 questionnaire, or contest;
8080 13 (4) is a sports event or activity;
8181 14 (5) is a gala presentation or awards show;
8282 15 (6) is a finished production that solicits funds;
8383 16 (7) is a production produced by a film production
8484 17 company if records, as required by 18 U.S.C. 2257, are to
8585 18 be maintained by that film production company with respect
8686 19 to any performer portrayed in that single media or
8787 20 multimedia program; or
8888 21 (8) is a production produced primarily for industrial,
8989 22 corporate, or institutional purposes.
9090 23 "Accredited animated production" means an accredited
9191 24 production in which movement and characters' performances are
9292 25 created using a frame-by-frame technique, visual effects
9393 26 (VFX), augmented reality (AR), mixed reality (MR), or virtual

105105 2 animated. Motion capture by itself is not an animation
106106 3 technique.
107107 4 "Accredited production certificate" means a certificate
108108 5 issued by the Department certifying that the production is an
109109 6 accredited production that meets the guidelines of this Act.
110110 7 "Applicant" means a taxpayer that is a film production
111111 8 company that is operating or has operated an accredited
112112 9 production located within the State of Illinois and that (i)
113113 10 owns the copyright in the accredited production throughout the
114114 11 Illinois production period or (ii) has contracted directly
115115 12 with the owner of the copyright in the accredited production
116116 13 or a person acting on behalf of the owner to provide services
117117 14 for the production, where the owner of the copyright is not an
118118 15 eligible production corporation.
119119 16 "Credit" means:
120120 17 (1) for an accredited production approved by the
121121 18 Department on or before January 1, 2005 and commencing
122122 19 before May 1, 2006, the amount equal to 25% of the Illinois
123123 20 labor expenditure approved by the Department. The
124124 21 applicant is deemed to have paid, on its balance due day
125125 22 for the year, an amount equal to 25% of its qualified
126126 23 Illinois labor expenditure for the tax year. For Illinois
127127 24 labor expenditures generated by the employment of
128128 25 residents of geographic areas of high poverty or high

140140 1 accredited production commencing before May 1, 2006 and
141141 2 approved by the Department after January 1, 2005, the
142142 3 applicant shall receive an enhanced credit of 10% in
143143 4 addition to the 25% credit; and
144144 5 (2) for an accredited production commencing on or
145145 6 after May 1, 2006, the amount equal to:
146146 7 (i) 20% of the Illinois production spending for
147147 8 the taxable year; plus
148148 9 (ii) 15% of the Illinois labor expenditures
149149 10 generated by the employment of residents of geographic
150150 11 areas of high poverty or high unemployment, as
151151 12 determined by the Department; and
152152 13 (3) for an accredited production commencing on or
153153 14 after January 1, 2009, the amount equal to:
154154 15 (i) 30% of the Illinois production spending for
155155 16 the taxable year; plus
156156 17 (ii) 15% of the Illinois labor expenditures
157157 18 generated by the employment of residents of geographic
158158 19 areas of high poverty or high unemployment, as
159159 20 determined by the Department; and .
160160 21 (4) for an accredited production commencing on or
161161 22 after July 1, 2023, the amount calculated under paragraph
162162 23 (3), plus 10% of the Illinois production spending incurred
163163 24 for the purpose of building a soundstage or digital wall.
164164 25 "Department" means the Department of Commerce and Economic
165165 26 Opportunity.

176176 1 "Director" means the Director of Commerce and Economic

178178 3 "Illinois labor expenditure" means salary or wages paid to
179179 4 employees of the applicant for services on the accredited

181181 6 To qualify as an Illinois labor expenditure, the
182182 7 expenditure must be:
183183 8 (1) Reasonable in the circumstances.
184184 9 (2) Included in the federal income tax basis of the
185185 10 property.
186186 11 (3) Incurred by the applicant for services on or after
187187 12 January 1, 2004.
188188 13 (4) Incurred for the production stages of the
189189 14 accredited production, from the final script stage to the
190190 15 end of the post-production stage.
191191 16 (5) Limited to the first $25,000 of wages paid or
192192 17 incurred to each employee of a production commencing
193193 18 before May 1, 2006 and the first $100,000 of wages paid or
194194 19 incurred to each employee of a production commencing on or
195195 20 after May 1, 2006 and prior to July 1, 2022. For
196196 21 productions commencing on or after July 1, 2022, limited
197197 22 to the first $500,000 of wages paid or incurred to each
198198 23 nonresident or resident employee of a production company
199199 24 or loan out company that provides in-State services to a
200200 25 production, whether those wages are paid or incurred by
201201 26 the production company, loan out company, or both, subject

213213 2 Illinois Income Tax Act. For purposes of calculating
214214 3 Illinois labor expenditures for a television series, the
215215 4 nonresident wage limitations provided under this
216216 5 subparagraph are applied to the entire season.
217217 6 (6) For a production commencing before May 1, 2006,
218218 7 exclusive of the salary or wages paid to or incurred for
219219 8 the 2 highest paid employees of the production.
220220 9 (7) Directly attributable to the accredited
221221 10 production.
222222 11 (8) (Blank).
223223 12 (9) Prior to July 1, 2022, paid to persons resident in
224224 13 Illinois at the time the payments were made. For a
225225 14 production commencing on or after July 1, 2022, paid to
226226 15 persons resident in Illinois and nonresidents at the time
227227 16 the payments were made. For purposes of this subparagraph,
228228 17 only wages paid to nonresidents working in the following
229229 18 positions shall be considered Illinois labor expenditures:
230230 19 Writer, Director, Director of Photography, Production
231231 20 Designer, Costume Designer, Production Accountant, VFX
232232 21 Supervisor, Editor, Composer, and Actor, subject to the
233233 22 limitations set forth under this subparagraph. For an
234234 23 accredited Illinois production spending of $25,000,000 or
235235 24 less, no more than 2 nonresident actors' wages shall
236236 25 qualify as an Illinois labor expenditure. For an

250250 3 (10) Paid for services rendered in Illinois.
251251 4 "Illinois production spending" means the expenses incurred
252252 5 by the applicant for an accredited production, including,
253253 6 without limitation, all of the following:
254254 7 (1) expenses to purchase, from vendors within
255255 8 Illinois, tangible personal property that is used in the
256256 9 accredited production;
257257 10 (2) expenses to acquire services, from vendors in
258258 11 Illinois, for film production, editing, or processing; and
259259 12 (3) for a production commencing before July 1, 2022,
260260 13 the compensation, not to exceed $100,000 for any one
261261 14 employee, for contractual or salaried employees who are
262262 15 Illinois residents performing services with respect to the
263263 16 accredited production. For a production commencing on or
264264 17 after July 1, 2022, the compensation, not to exceed
265265 18 $500,000 for any one employee, for contractual or salaried
266266 19 employees who are Illinois residents or nonresident
267267 20 employees, subject to the limitations set forth under
268268 21 Section 10 of this Act.
269269 22 "Loan out company" means a personal service corporation or
270270 23 other entity that is under contract with the taxpayer to
271271 24 provide specified individual personnel, such as artists, crew,
272272 25 actors, producers, or directors for the performance of
273273 26 services used directly in a production. "Loan out company"

284284 1 does not include entities contracted with by the taxpayer to
285285 2 provide goods or ancillary contractor services such as
286286 3 catering, construction, trailers, equipment, or
287287 4 transportation.
288288 5 "Qualified production facility" means stage facilities in
289289 6 the State in which television shows and films are or are
290290 7 intended to be regularly produced and that contain at least
291291 8 one sound stage of at least 15,000 square feet.
292292 9 Rulemaking authority to implement Public Act 95-1006, if
293293 10 any, is conditioned on the rules being adopted in accordance
294294 11 with all provisions of the Illinois Administrative Procedure
295295 12 Act and all rules and procedures of the Joint Committee on
296296 13 Administrative Rules; any purported rule not so adopted, for
297297 14 whatever reason, is unauthorized.
