Ram Villivalam SYNOPSIS AS INTRODUCED: 20 ILCS 2705/2705-625 new Amends the Department of Transportation Law of the Civil Administration Code of Illinois. Establishes that the Department of Transportation shall make advance payments to its consultants for the preparatory work necessary for the consultant to provide initial personnel, equipment, supplies, and incidentals on its project with the Department. Provides that the amount paid shall be equal to 10% of the total value of the contract between the consultant and the Department. Provides that the advance payment to the consultant is an advance payment of the reported amount of the contract and is not a payment in addition to the amount of the contract; therefore, the amount of the advance payment shall be deducted from the future progress payments or the total contract amount. 1111 1 AN ACT concerning transportation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Department of Transportation Law of the
1515 5 Civil Administrative Code of Illinois is amended by adding
1616 6 Section 2705-625 as follows:
1717 7 (20 ILCS 2705/2705-625 new)
1818 8 Sec. 2705-625. Advance payments for consultants. The
1919 9 Department shall make advance payments to its consultants for
2020 10 the preparatory work necessary for the consultant to provide
2121 11 initial personnel, equipment, supplies, and incidentals on its
2222 12 project with the Department. The amount paid shall be made 14
2323 13 days prior to the consultant starting work. The amount paid
2424 14 shall be equal to 10% of the total value of the contract
2525 15 between the consultant and the Department. The advance payment
2626 16 to the consultant is an advance payment of the reported amount
2727 17 of the contract and is not a payment in addition to the amount
2828 18 of the contract; therefore, the amount of the advance payment
2929 19 shall be deducted from the future progress payments or the
3030 20 total contract amount.
3131 21 Section 99. Effective date. This Act takes effect upon
3232 22 becoming law.
