11 103RD GENERAL ASSEMBLY State of Illinois 2023 and 2024 SB2313 Introduced 2/10/2023, by Sen. Celina Villanueva SYNOPSIS AS INTRODUCED: New Act Creates the Failure to Fund Instruction Act. Provides that public institutions of higher education that spend less on instruction than 33% of the amount of revenue it receives in tuition and fees shall report details on revenue and expenditures and submit a plan to spend more than 33% on instruction to the State Board of Education. Provides that any public institutions of higher education that fails to submit a plan or continues to spend less than 33% of the amount of revenue it receives in tuition and fees on instruction for 2 consecutive years shall be ineligible for participation in the monetary award program established under the Higher Education Student Assistance Act for all new applicants. Provides that the Board shall adopt rules necessary to implement the Act. 1111 1 AN ACT concerning education.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the
1515 5 Failure to Fund Instruction Act.
1616 6 Section 5. Definition. As used in this Act, "public
1717 7 institutions of higher education" means the University of
1818 8 Illinois; Southern Illinois University; Chicago State
1919 9 University; Eastern Illinois University; Governors State
2020 10 University; Illinois State University; Northeastern Illinois
2121 11 University; Northern Illinois University; Western Illinois
2222 12 University; the public community colleges of this State; and
2323 13 any other public universities, colleges, and community
2424 14 colleges now or hereafter established or authorized by the
2525 15 General Assembly.
2626 16 Section 10. Failure to fund.
2727 17 (a) Public institutions of higher education that spends
2828 18 less on instruction than 33% of the amount of revenue it
2929 19 receives in tuition and fees shall report details on revenue
3030 20 and expenditures and submit a plan to spend more than 33% on
3131 21 instruction to the State Board of Education.
