1414 1 AN ACT concerning transportation.
1515 2 Be it enacted by the People of the State of Illinois,

1717 4 Section 5. The Freedom of Information Act is amended by

407407 10 kidnaping, and aggravated battery resulting in great bodily
408408 11 harm or permanent disability or disfigurement.
409409 12 "Highway" has the meaning designated under Section 1-126.1
410410 13 of the Illinois Vehicle Code.
411411 14 "Terrorism" has the meaning provided in Section 29D-14.9
412412 15 of the Criminal Code of 2012.
413413 16 "Vehicular hijacking" has the meaning provided in Section
414414 17 18-3 of the Criminal Code of 2012.

443443 11 (b) Images from the cameras may be extracted by any
444444 12 authorized user and used by any municipal police department,
445445 13 county sheriff's office, State Police officer, or other law
446446 14 enforcement agency with jurisdiction in the investigation of
447447 15 any offenses involving vehicular hijacking, aggravated
448448 16 vehicular hijacking, terrorism, motor vehicle theft, or any
449449 17 forcible felony, including, but not limited to, offenses
450450 18 involving the use of a firearm; to detect expressway hazards
451451 19 and highway conditions; and to facilitate highway safety and
452452 20 incident management. Images from the cameras shall not be used
453453 21 to enforce petty offenses or offenses not listed in this
454454 22 subsection, unless use of the images pertains to expressway or
455455 23 highway safety or hazards. Images from the cameras may be used
456456 24 by any law enforcement agency conducting an active law
457457 25 enforcement investigation. All images from the cameras shall
458458 26 be deleted within 120 days, unless the images are relevant to

469469 1 an ongoing investigation or pending criminal trial. Cameras
470470 2 shall not be used to monitor individuals or groups in a
471471 3 discriminatory manner contrary to applicable State or federal
472472 4 law.
473473 5 (b-5) By June 30th of each year, the Illinois State
474474 6 Police, the Illinois Department of Transportation, and the
475475 7 Illinois State Toll Highway Authority shall issue a joint
476476 8 report to the General Assembly detailing the program
477477 9 operations, including, but not limited to:
478478 10 (1) the cost of installation of cameras by county;
479479 11 (2) the cost of ongoing maintenance of the camera
480480 12 systems per county, including electrical costs and data
481481 13 transfer costs;
482482 14 (3) the number of inquiries where the investigation
483483 15 involved the criminal offenses outlined in subsection (b);
484484 16 and
485485 17 (4) the number of incidents in which law enforcement
486486 18 searched the stored data for the criminal offenses
487487 19 outlined in subsection (b).
488488 20 (c) Subject to appropriation, any funds needed to conduct
489489 21 the program for use on the expressways or State highway system
490490 22 under the jurisdiction of the Department of Transportation
491491 23 shall be taken from the Road Fund and shall be included in
492492 24 requests for qualification processes. Any funds needed to
493493 25 conduct the program for use on expressways under the
494494 26 jurisdiction of the Illinois State Toll Highway Authority

505505 1 shall be paid for by funds from the Illinois State Tollway
506506 2 Highway Authority and shall be included in requests for
507507 3 qualification processes. Funds may be used for installation
508508 4 and maintenance of the camera systems, telecommunications
509509 5 costs, data storage costs, and for camera warranties. Cameras
510510 6 shall be interoperable with the Illinois State Police current
511511 7 camera system.
512512 8 (c-5) Any forcible felony, gunrunning, or firearms
513513 9 trafficking offense, as defined in Section 2-8, 24-3a, or
514514 10 24-3b of the Criminal Code of 2012, respectively, committed on
515515 11 an expressway monitored by a camera system funded by money
516516 12 from the Road Fund and investigated by officers of the
517517 13 Illinois State Police may be prosecuted by the Attorney
518518 14 General or the State's Attorney where the offense was
519519 15 committed.
