Provides that the purpose of the committee is to complete a statewide review of State mandates on school districts. Sets forth the membership of the committee. Contains provisions concerning meetings, administrative support, and reporting. Repeals these provisions on December 31, 2025. Effective immediately. 1  AN ACT concerning education.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The School Code is amended by adding Section
5  2-3.104a as follows:
6  (105 ILCS 5/2-3.104a new)
7  Sec. 2-3.104a. Committee on Mandate Review.
8  (a) In this Section, "school district category" includes
9  unit school districts, rural school districts, suburban school
10  districts, and a school district organized under Article 34 of
11  this Code.
12  (b) The State Board of Education shall create a Committee
13  on Mandate Review for the purpose of completing a statewide
14  review of State mandates on school districts.
15  (c) The membership of the committee shall include, but is
16  not limited to, all of the following members:
17  (1) The State Superintendent of Education or a
18  designee who shall serve as chairperson.
19  (2) One member representing a statewide association of
20  regional superintendents of schools appointed by the
21  chairperson of the State Board of Education.
22  (3) Two members appointed by the Speaker of the House
23  of Representatives.

11  representing individuals who hold professional educator
12  licenses and are employed by a school district organized
13  under Article 34 of this Code appointed by the chairperson
14  of the State Board of Education.
15  (9) One regional superintendent of schools
16  representing a suburban school district appointed by the
17  chairperson of the State Board of Education.
18  (10) One regional superintendent of schools
19  representing a rural school district appointed by the
20  chairperson of the State Board of Education.
21  (11) One superintendent representing a unit school
22  district appointed by the chairperson of the State Board
23  of Education.
24  (12) One superintendent representing a high school
25  district appointed by the chairperson of the State Board
26  of Education.

22  organization representing students.
23  (21) One member from a suburban area from an
24  organization representing students.
25  (22) One member from a rural area from an organization

1  (d) The committee shall meet at the call of the
2  chairperson. Members of the committee shall serve without
3  compensation but shall be reimbursed for their reasonable and
4  necessary expenses from funds appropriated to the State Board
5  of Education for that purpose, including travel, subject to
6  the rules of the appropriate travel control board. The State
7  Board of Education shall provide administrative and other
8  support to the committee.
9  (e) The committee shall report its findings and
10  recommendations to the State Board of Education and General
11  Assembly on or before December 1, 2024.
12  The report shall include, but is not limited to, all of the
13  following items:
14  (1) An analysis of the cost to implement a mandate by
15  each school district category.
16  (2) An analysis of the amount of staff time and the
17  number of staff needed to implement the mandate by each
18  school district category.
19  (3) An analysis of the resources available for the
20  consistent implementation of the mandate by each school
21  district category.
22  (4) An analysis of the duplication of any mandates
23  that school districts are required to implement and are
24  related to a legislative mandate.
25  (5) A summary of the practices used by school
26  districts that have been granted waivers of a legislative

1  mandate.
2  (6) An analysis of the waiver and modification
3  process, including, but not limited to, the role of
4  regional offices of education.
5  Upon filing its report, the committee is dissolved.
6  (f) This Section is repealed on December 31, 2025.
7  Section 99. Effective date. This Act takes effect upon
8  becoming law.
