1  AN ACT concerning transportation.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The State Finance Act is amended by adding
5  Section 5.1012 as follows:

7  Sec. 5.1012. The Illinois USTA/Midwest Tennis Foundation
8  Youth Tennis Fund.
9  Section 10. The Illinois Vehicle Code is amended by
10  changing Section 3-699.14 as follows:

15  (a) In addition to any other special license plate, the

19  Illinois on behalf of organizations that have been authorized
20  by the General Assembly to issue decals for Universal special
21  license plates. Appropriate documentation, as determined by

1  the Secretary, shall accompany each application. Authorized
2  organizations shall be designated by amendment to this
3  Section. When applying for a Universal special license plate
4  the applicant shall inform the Secretary of the name of the
5  authorized organization from which the applicant will obtain a
6  decal to place on the plate. The Secretary shall make a record
7  of that organization and that organization shall remain
8  affiliated with that plate until the plate is surrendered,
9  revoked, or otherwise cancelled. The authorized organization
10  may charge a fee to offset the cost of producing and
11  distributing the decal, but that fee shall be retained by the
12  authorized organization and shall be separate and distinct
13  from any registration fees charged by the Secretary. No decal,
14  sticker, or other material may be affixed to a Universal
15  special license plate other than a decal authorized by the
16  General Assembly in this Section or a registration renewal
17  sticker. The special plates issued under this Section shall be
18  affixed only to passenger vehicles of the first division,
19  including motorcycles and autocycles, or motor vehicles of the
20  second division weighing not more than 8,000 pounds. Plates
21  issued under this Section shall expire according to the
22  multi-year procedure under Section 3-414.1 of this Code.
23  (b) The design, color, and format of the Universal special
24  license plate shall be wholly within the discretion of the
25  Secretary. Universal special license plates are not required
26  to designate "Land of Lincoln", as prescribed in subsection

1  (b) of Section 3-412 of this Code. The design shall allow for
2  the application of a decal to the plate. Organizations
3  authorized by the General Assembly to issue decals for
4  Universal special license plates shall comply with rules
5  adopted by the Secretary governing the requirements for and
6  approval of Universal special license plate decals. The
7  Secretary may, in his or her discretion, allow Universal
8  special license plates to be issued as vanity or personalized
9  plates in accordance with Section 3-405.1 of this Code. The
10  Secretary of State must make a version of the special
11  registration plates authorized under this Section in a form
12  appropriate for motorcycles and autocycles.
13  (c) When authorizing a Universal special license plate,
14  the General Assembly shall set forth whether an additional fee
15  is to be charged for the plate and, if a fee is to be charged,
16  the amount of the fee and how the fee is to be distributed.
17  When necessary, the authorizing language shall create a
18  special fund in the State treasury into which fees may be
19  deposited for an authorized Universal special license plate.
20  Additional fees may only be charged if the fee is to be paid
21  over to a State agency or to a charitable entity that is in
22  compliance with the registration and reporting requirements of
23  the Charitable Trust Act and the Solicitation for Charity Act.
24  Any charitable entity receiving fees for the sale of Universal
25  special license plates shall annually provide the Secretary of
26  State a letter of compliance issued by the Attorney General

1  verifying that the entity is in compliance with the Charitable
2  Trust Act and the Solicitation for Charity Act.
3  (d) Upon original issuance and for each registration
4  renewal period, in addition to the appropriate registration
5  fee, if applicable, the Secretary shall collect any additional
6  fees, if required, for issuance of Universal special license
7  plates. The fees shall be collected on behalf of the
8  organization designated by the applicant when applying for the
9  plate. All fees collected shall be transferred to the State
10  agency on whose behalf the fees were collected, or paid into
11  the special fund designated in the law authorizing the
12  organization to issue decals for Universal special license
13  plates. All money in the designated fund shall be distributed
14  by the Secretary subject to appropriation by the General
15  Assembly.
16  (e) The following organizations may issue decals for
17  Universal special license plates with the original and renewal
18  fees and fee distribution as follows:
19  (1) The Illinois Department of Natural Resources.
20  (A) Original issuance: $25; with $10 to the
21  Roadside Monarch Habitat Fund and $15 to the Secretary
22  of State Special License Plate Fund.
23  (B) Renewal: $25; with $23 to the Roadside Monarch
24  Habitat Fund and $2 to the Secretary of State Special
25  License Plate Fund.
26  (2) Illinois Veterans' Homes.

7  (6) The Mechanics Training Fund. All money in the
8  Mechanics Training Fund shall be paid as grants to the
9  Mechanics Local 701 Training Fund.
10  (7) The Theresa Tracy Trot - Illinois CancerCare
11  Foundation Fund. All money in the Theresa Tracy Trot -
12  Illinois CancerCare Foundation Fund shall be paid to the
13  Illinois CancerCare Foundation for the purpose of
14  furthering pancreatic cancer research.
15  (8) The Developmental Disabilities Awareness Fund. All
16  money in the Developmental Disabilities Awareness Fund
17  shall be paid as grants to the Illinois Department of
18  Human Services to fund legal aid groups to assist with
19  guardianship fees for private citizens willing to become
20  guardians for individuals with developmental disabilities
21  but who are unable to pay the legal fees associated with
22  becoming a guardian.
23  (9) The Pediatric Cancer Awareness Fund. All money in
24  the Pediatric Cancer Awareness Fund shall be paid as
25  grants to the Cancer Center at Illinois for pediatric
26  cancer treatment and research.

8  and distribution by the Secretary, as grants to promote
9  recreational aviation.

17  for the benefit of health care workers, doctors, nurses,
18  and others who work in the health care industry in this

21  the Future Farmers of America Fund shall be paid as grants
22  to the Illinois Association of Future Farmers of America.

11  Secretary. Universal special license plates are not required
12  to designate "Land of Lincoln", as prescribed in subsection
13  (b) of Section 3-412 of this Code. The design shall allow for
14  the application of a decal to the plate. Organizations
15  authorized by the General Assembly to issue decals for
16  Universal special license plates shall comply with rules
17  adopted by the Secretary governing the requirements for and
18  approval of Universal special license plate decals. The
19  Secretary may, in his or her discretion, allow Universal
20  special license plates to be issued as vanity or personalized
21  plates in accordance with Section 3-405.1 of this Code. The
22  Secretary of State must make a version of the special
23  registration plates authorized under this Section in a form
24  appropriate for motorcycles and autocycles.
25  (c) When authorizing a Universal special license plate,
26  the General Assembly shall set forth whether an additional fee

1  is to be charged for the plate and, if a fee is to be charged,
2  the amount of the fee and how the fee is to be distributed.
3  When necessary, the authorizing language shall create a
4  special fund in the State treasury into which fees may be
5  deposited for an authorized Universal special license plate.
6  Additional fees may only be charged if the fee is to be paid
7  over to a State agency or to a charitable entity that is in
8  compliance with the registration and reporting requirements of
9  the Charitable Trust Act and the Solicitation for Charity Act.
10  Any charitable entity receiving fees for the sale of Universal
11  special license plates shall annually provide the Secretary of
12  State a letter of compliance issued by the Attorney General
13  verifying that the entity is in compliance with the Charitable
14  Trust Act and the Solicitation for Charity Act.
15  (d) Upon original issuance and for each registration
16  renewal period, in addition to the appropriate registration
17  fee, if applicable, the Secretary shall collect any additional
18  fees, if required, for issuance of Universal special license
19  plates. The fees shall be collected on behalf of the
20  organization designated by the applicant when applying for the
21  plate. All fees collected shall be transferred to the State
22  agency on whose behalf the fees were collected, or paid into
23  the special fund designated in the law authorizing the
24  organization to issue decals for Universal special license
25  plates. All money in the designated fund shall be distributed
26  by the Secretary subject to appropriation by the General
