1212 1 AN ACT concerning firearms.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 1. Short title. This Act may be cited as the
1616 5 Voluntary Do Not Sell Firearms Act.
1717 6 Section 5. Voluntary waiver of firearm rights.
1818 7 (a) A person may file a voluntary waiver of firearm
1919 8 rights, either in writing or electronically, with the clerk of
2020 9 the court in any county in this State. The clerk of the court
2121 10 must request a physical or scanned copy of photo
2222 11 identification to verify the person's identity prior to
2323 12 accepting the form. The person filing the form may provide the
2424 13 name of a family member, mental health professional, substance
2525 14 use disorder professional, or other person to be contacted if
2626 15 the filer attempts to purchase a firearm while the voluntary
2727 16 waiver of firearm rights is in effect or if the filer applies
2828 17 to have the voluntary waiver revoked. The clerk of the court
2929 18 must immediately give notice to the person filing the form and
3030 19 any listed family member, mental health professional,
3131 20 substance use disorder professional, or other person if the
3232 21 filer's voluntary waiver of firearm rights has been accepted.
3333 22 By the end of the business day, the clerk of the court shall,

7171 1 Police, transmit the accepted form to the Illinois State
7272 2 Police. The Illinois State Police must enter the voluntary
7373 3 waiver of firearm rights into the national instant criminal
7474 4 background check system and any other federal or State
7575 5 computer-based systems used by law enforcement agencies or
7676 6 others to identify prohibited purchasers of firearms within 24
7777 7 hours of receipt of the form. Copies and records of the
7878 8 voluntary waiver of firearm rights shall not be disclosed
7979 9 except to law enforcement agencies.
8080 10 (b) A filer of a voluntary waiver of firearm rights may
8181 11 update the contact information for any family member, mental
8282 12 health professional, substance use disorder professional, or
8383 13 other person provided under subsection (a) of this section by
8484 14 making an electronic or written request to the clerk of the
8585 15 court in the same county where the voluntary waiver of firearm
8686 16 rights was filed. The clerk of the court must request a
8787 17 physical or scanned copy of photo identification to verify the
8888 18 person's identity prior to updating the contact information on
8989 19 the form. By the end of the business day, the clerk of the
9090 20 court shall transmit the updated contact information to the
9191 21 Illinois State Police.
9292 22 (c) No sooner than 21 calendar days after filing a
9393 23 voluntary waiver of firearm rights, the person may file a
9494 24 revocation of the voluntary waiver of firearm rights, either
9595 25 in writing or electronically, in the same county where the
9696 26 voluntary waiver of firearm rights was filed. The clerk of the

107107 1 court must request a physical or scanned copy of photo
108108 2 identification to verify the person's identity prior to
109109 3 accepting the form. By the end of the business day, the clerk
110110 4 of the court must transmit the form to the Illinois State
111111 5 Police and to any family member, mental health professional,
112112 6 substance use disorder professional, or other person listed on
113113 7 the voluntary waiver of firearm rights. Within 7 days of
114114 8 receiving a revocation of a voluntary waiver of firearm
115115 9 rights, the Illinois State Police must remove the person from
116116 10 the national instant criminal background check system, and any
117117 11 other federal or State computer-based systems used by law
118118 12 enforcement agencies or others to identify prohibited
119119 13 purchasers of firearms in which the person was entered, unless
120120 14 the person is otherwise ineligible to possess a firearm under
121121 15 Illinois law, and destroy all records of the voluntary waiver.
122122 16 (d) A person who knowingly makes a false Statement
123123 17 regarding the person's identity on the voluntary waiver of
124124 18 firearm rights form or revocation of waiver of firearm rights
125125 19 form is in violation of this Act and is subject to the penalty
126126 20 for perjury under Section 32-2 of the Criminal Code of 2012.
127127 21 (e) Neither a voluntary waiver of firearm rights nor a
128128 22 revocation of a voluntary waiver of firearm rights shall be
129129 23 considered by a court in any legal proceeding.
130130 24 (f) A voluntary waiver of firearm rights may not be
131131 25 required of an individual as a condition for receiving
132132 26 employment, benefits, or services.

143143 1 (g) All records obtained and all reports produced, as
144144 2 required by this Section, are not subject to disclosure and
145145 3 shall be confidential with respect to all matters involving
146146 4 health care, employment, education, housing, insurance,
147147 5 government benefits, and contracting.
148148 6 Section 90. The Freedom of Information Act is amended by
149149 7 changing Section 7 as follows:

151151 9 Sec. 7. Exemptions.
152152 10 (1) When a request is made to inspect or copy a public
153153 11 record that contains information that is exempt from
154154 12 disclosure under this Section, but also contains information
155155 13 that is not exempt from disclosure, the public body may elect
156156 14 to redact the information that is exempt. The public body
157157 15 shall make the remaining information available for inspection
158158 16 and copying. Subject to this requirement, the following shall
159159 17 be exempt from inspection and copying:
160160 18 (a) Information specifically prohibited from
161161 19 disclosure by federal or State law or rules and
162162 20 regulations implementing federal or State law.
163163 21 (b) Private information, unless disclosure is required
164164 22 by another provision of this Act, a State or federal law,
165165 23 or a court order.

177177 1 maintained by one or more law enforcement agencies and
178178 2 specifically designed to provide information to one or
179179 3 more law enforcement agencies regarding the physical or
180180 4 mental status of one or more individual subjects.
181181 5 (c) Personal information contained within public
182182 6 records, the disclosure of which would constitute a
183183 7 clearly unwarranted invasion of personal privacy, unless
184184 8 the disclosure is consented to in writing by the
185185 9 individual subjects of the information. "Unwarranted
186186 10 invasion of personal privacy" means the disclosure of
187187 11 information that is highly personal or objectionable to a
188188 12 reasonable person and in which the subject's right to
189189 13 privacy outweighs any legitimate public interest in
190190 14 obtaining the information. The disclosure of information
191191 15 that bears on the public duties of public employees and
192192 16 officials shall not be considered an invasion of personal
193193 17 privacy.
194194 18 (d) Records in the possession of any public body
195195 19 created in the course of administrative enforcement
196196 20 proceedings, and any law enforcement or correctional
197197 21 agency for law enforcement purposes, but only to the
198198 22 extent that disclosure would:
199199 23 (i) interfere with pending or actually and
200200 24 reasonably contemplated law enforcement proceedings
201201 25 conducted by any law enforcement or correctional
202202 26 agency that is the recipient of the request;

213213 1 (ii) interfere with active administrative
214214 2 enforcement proceedings conducted by the public body
215215 3 that is the recipient of the request;
216216 4 (iii) create a substantial likelihood that a
217217 5 person will be deprived of a fair trial or an impartial
218218 6 hearing;
219219 7 (iv) unavoidably disclose the identity of a
220220 8 confidential source, confidential information
221221 9 furnished only by the confidential source, or persons
222222 10 who file complaints with or provide information to
223223 11 administrative, investigative, law enforcement, or
224224 12 penal agencies; except that the identities of
225225 13 witnesses to traffic crashes, traffic crash reports,
226226 14 and rescue reports shall be provided by agencies of
227227 15 local government, except when disclosure would
228228 16 interfere with an active criminal investigation
229229 17 conducted by the agency that is the recipient of the
230230 18 request;
231231 19 (v) disclose unique or specialized investigative
232232 20 techniques other than those generally used and known
233233 21 or disclose internal documents of correctional
234234 22 agencies related to detection, observation, or
235235 23 investigation of incidents of crime or misconduct, and
236236 24 disclosure would result in demonstrable harm to the
237237 25 agency or public body that is the recipient of the
238238 26 request;

249249 1 (vi) endanger the life or physical safety of law
250250 2 enforcement personnel or any other person; or
251251 3 (vii) obstruct an ongoing criminal investigation
252252 4 by the agency that is the recipient of the request.
253253 5 (d-5) A law enforcement record created for law
254254 6 enforcement purposes and contained in a shared electronic
255255 7 record management system if the law enforcement agency
256256 8 that is the recipient of the request did not create the
257257 9 record, did not participate in or have a role in any of the
258258 10 events which are the subject of the record, and only has
259259 11 access to the record through the shared electronic record
260260 12 management system.
261261 13 (d-6) Records contained in the Officer Professional
262262 14 Conduct Database under Section 9.2 of the Illinois Police
263263 15 Training Act, except to the extent authorized under that
264264 16 Section. This includes the documents supplied to the
265265 17 Illinois Law Enforcement Training Standards Board from the
266266 18 Illinois State Police and Illinois State Police Merit
267267 19 Board.
268268 20 (d-7) Information gathered or records created from the
269269 21 use of automatic license plate readers in connection with
270270 22 Section 2-130 of the Illinois Vehicle Code.
271271 23 (e) Records that relate to or affect the security of
272272 24 correctional institutions and detention facilities.
273273 25 (e-5) Records requested by persons committed to the
274274 26 Department of Corrections, Department of Human Services

332332 12 crime scene photographs, except as these records may be
333333 13 relevant to the requester's current or potential case or

335335 15 (f) Preliminary drafts, notes, recommendations,
336336 16 memoranda, and other records in which opinions are
337337 17 expressed, or policies or actions are formulated, except
338338 18 that a specific record or relevant portion of a record
339339 19 shall not be exempt when the record is publicly cited and
340340 20 identified by the head of the public body. The exemption
341341 21 provided in this paragraph (f) extends to all those
342342 22 records of officers and agencies of the General Assembly
343343 23 that pertain to the preparation of legislative documents.
344344 24 (g) Trade secrets and commercial or financial
345345 25 information obtained from a person or business where the

357357 1 furnished under a claim that they are proprietary,
358358 2 privileged, or confidential, and that disclosure of the
359359 3 trade secrets or commercial or financial information would
360360 4 cause competitive harm to the person or business, and only
361361 5 insofar as the claim directly applies to the records
362362 6 requested.
363363 7 The information included under this exemption includes
364364 8 all trade secrets and commercial or financial information
365365 9 obtained by a public body, including a public pension
366366 10 fund, from a private equity fund or a privately held
367367 11 company within the investment portfolio of a private
368368 12 equity fund as a result of either investing or evaluating
369369 13 a potential investment of public funds in a private equity
370370 14 fund. The exemption contained in this item does not apply
371371 15 to the aggregate financial performance information of a
372372 16 private equity fund, nor to the identity of the fund's
373373 17 managers or general partners. The exemption contained in
374374 18 this item does not apply to the identity of a privately
375375 19 held company within the investment portfolio of a private
376376 20 equity fund, unless the disclosure of the identity of a
377377 21 privately held company may cause competitive harm.
378378 22 Nothing contained in this paragraph (g) shall be
379379 23 construed to prevent a person or business from consenting
380380 24 to disclosure.
381381 25 (h) Proposals and bids for any contract, grant, or

393393 1 disclosed would frustrate procurement or give an advantage
394394 2 to any person proposing to enter into a contractor
395395 3 agreement with the body, until an award or final selection
396396 4 is made. Information prepared by or for the body in
397397 5 preparation of a bid solicitation shall be exempt until an
398398 6 award or final selection is made.
399399 7 (i) Valuable formulae, computer geographic systems,
400400 8 designs, drawings, and research data obtained or produced
401401 9 by any public body when disclosure could reasonably be
402402 10 expected to produce private gain or public loss. The
403403 11 exemption for "computer geographic systems" provided in
404404 12 this paragraph (i) does not extend to requests made by
405405 13 news media as defined in Section 2 of this Act when the
406406 14 requested information is not otherwise exempt and the only
407407 15 purpose of the request is to access and disseminate
408408 16 information regarding the health, safety, welfare, or
409409 17 legal rights of the general public.
410410 18 (j) The following information pertaining to
411411 19 educational matters:
412412 20 (i) test questions, scoring keys, and other
413413 21 examination data used to administer an academic
414414 22 examination;
415415 23 (ii) information received by a primary or
416416 24 secondary school, college, or university under its
417417 25 procedures for the evaluation of faculty members by
418418 26 their academic peers;

435435 7 (k) Architects' plans, engineers' technical
