1111 1 AN ACT concerning safety.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The PFAS Reduction Act is amended by adding
1515 5 Section 45 as follows:
1616 6 (415 ILCS 170/45 new)
1717 7 Sec. 45. Publicly accessible data collection program.
1818 8 (a) The Agency may participate, along with other states
1919 9 and governmental entities, in an interstate clearinghouse to
2020 10 promote safer chemicals in consumer products and may cooperate
2121 11 with the interstate clearinghouse to:
2222 12 (1) organize and manage available data on chemicals,
2323 13 including information on uses, hazards, environmental
2424 14 concerns, safer alternatives, and model policies and
2525 15 programs concerning specific chemicals;
2626 16 (2) provide technical assistance regarding chemical
2727 17 safety to businesses, consumers, and policymakers;
2828 18 (3) establish a data collection interface for use in
2929 19 the manner described in this Section; and
3030 20 (4) undertake any other activities in support of State
3131 21 programs to promote chemical safety.
3232 22 (b) The Agency may enter into any contracts necessary to
3333 23 implement this Section by January 1, 2026. To the extent

6868 1 reasonable and feasible, the data collection interface
6969 2 established under subsection (a) shall streamline and
7070 3 facilitate data reporting required by this Section with
7171 4 similar data reporting required by other states and
7272 5 jurisdictions.
7373 6 (c) The Agency may adopt rules necessary to implement this
7474 7 Section.
7575 8 (d) The Agency may provide technical assistance to
7676 9 manufacturers in complying with this Section.
7777 10 (e) The Agency may use rules adopted under subsection (c)
7878 11 or technical assistance provided under subsection (d) to
7979 12 clarify the reporting requirements established under this
8080 13 Section and to ensure that the data collected are not
8181 14 duplicative among the reporting entities.
8282 15 (f) On or before July 1, 2026, and on or before July 1 of
8383 16 each year thereafter, a manufacturer of PFAS or a product or
8484 17 product component containing intentionally added PFAS that,
8585 18 during the prior calendar year, is sold, offered for sale,
8686 19 distributed, or offered for promotional purposes in, or
8787 20 imported into, the State shall register the PFAS or the
8888 21 product or product component containing intentionally added
8989 22 PFAS on the publicly accessible data collection interface
9090 23 established under subsection (a), along with all of the
9191 24 following information, as applicable:
9292 25 (1) the name and type of product or product component
9393 26 containing intentionally added PFAS;

104104 1 (2) the universal product code of the product or
105105 2 product component containing intentionally added PFAS;
106106 3 (3) the purpose or function for which the
107107 4 intentionally added PFAS are used in the product or
108108 5 product component;
109109 6 (4) the identity and a reasonable estimate of the
110110 7 amount of all PFAS compounds in the product or product
111111 8 component containing intentionally added PFAS;
112112 9 (5) the amount of the product or product component or
113113 10 the number of products or product components sold,
114114 11 delivered, or imported into the State in the prior
115115 12 calendar year; and
116116 13 (6) the name and address of the manufacturer and the
117117 14 name, address, and phone number of a contact person for
118118 15 the manufacturer.
119119 16 When reporting the identity of a PFAS compound under
120120 17 paragraph (4), the manufacturer shall provide (i) the brand
121121 18 name of the formulation that contains PFAS and the name of the
122122 19 manufacturer of the formulation and (ii) the chemical formula
123123 20 or standardized name of the PFAS compound.
124124 21 When reporting the amount or weight of a PFAS compound
125125 22 under paragraph (4), the manufacturer shall provide (i) the
126126 23 amount or weight of each intentionally added PFAS compound or
127127 24 (ii) if the amount or weight of each intentionally added PFAS
128128 25 compound is not known, the total organic fluorine in the
