Requires the Department to report to specified House and Senate committees (i) before June 30, 2025 regarding each county awarded a grant under the pilot program and the details of each project and (ii) before June 30, 2027 regarding data gathered on each project, recommendations for future use of mental health crisis services and substance use disorder crisis services in behavioral health recovery centers, and other matters. Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to apply, no later than July 1, 2024, for a waiver or State Plan amendment to offer a program that provides reimbursement through a bundled daily rate for crisis management services that are delivered to an individual during the individual's stay at a behavioral health recovery center. Requires the Department to implement the program upon federal approval and to require certain managed care organizations to provide coverage for behavioral health crisis management services at a behavioral health recovery center. 1212 1 AN ACT concerning behavioral health.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Substance Use Disorder Act is amended by
1616 5 adding Section 5-28 as follows:

1818 7 Sec. 5-28. Behavioral Health Recovery Center Grant
1919 8 Program.
2020 9 (a) As used in this Section:
2121 10 "Behavioral health recovery center" means a facility that
2222 11 provides mental health crisis services and substance use
2323 12 disorder crisis services to individuals who are experiencing a
2424 13 mental health or substance use crisis that does not require
2525 14 treatment beyond 23 hours and 59 minutes.
2626 15 "Project" means a behavioral health recovery center
2727 16 project.
2828 17 (b) The Department shall establish a Behavioral Health
2929 18 Recovery Center Grant Pilot Program in accordance with this
3030 19 Section. The pilot program shall operate for a 5-year period.
3131 20 No later than July 1, 2024, the Department shall issue a
3232 21 request for proposals to award a grant to one or more counties
3333 22 to develop and implement a behavioral health recovery center
3434 23 project. A grant awarded under this Section may not be used to

7171 1 purchase land for the behavioral health recovery center. The
7272 2 Department shall award all grants under this Section before
7373 3 December 31, 2024.
7474 4 (c) The purpose of a project is to:
7575 5 (1) increase access to mental health crisis services
7676 6 for individuals in the State who are experiencing a mental
7777 7 health crisis or substance use disorder crisis; and
7878 8 (2) reduce the number of individuals in the State who
7979 9 are incarcerated or in a hospital emergency room while
8080 10 experiencing a mental health crisis or substance use
8181 11 disorder crisis.
8282 12 (d) An application for a grant under this Section shall:
8383 13 (1) identify the population to which the behavioral
8484 14 health recovery center will provide mental health crisis
8585 15 and substance use disorder crisis services;
8686 16 (2) identify the type of mental health crisis services
8787 17 or substance use disorder crisis services the behavioral
8888 18 health recovery center will provide;
8989 19 (3) explain how the population described in paragraph
9090 20 (1) will benefit from the provision of mental health
9191 21 crisis or substance use disorder crisis services;
9292 22 (4) provide details regarding:
9393 23 (A) how the proposed project plans to provide
9494 24 mental health crisis and substance use disorder crisis
9595 25 services;
9696 26 (B) how the proposed project will ensure that

107107 1 consideration is given to the capacity of the
108108 2 behavioral health recovery center;
109109 3 (C) how the proposed project will ensure timely
110110 4 and effective provision of mental health crisis and
111111 5 substance use disorder crisis services;
112112 6 (D) the cost of the proposed project;
113113 7 (E) any existing or planned contracts or
114114 8 partnerships between the applicant and other
115115 9 individuals or entities to develop and implement the
116116 10 proposed project;
117117 11 (F) any plan to use funding sources in addition to
118118 12 a grant under this Section for the proposed project;
119119 13 (G) the sustainability of the proposed project;
120120 14 and
121121 15 (H) the methods the proposed project will use to:
122122 16 (i) protect the privacy of each individual who
123123 17 receives mental health crisis or substance use
124124 18 disorder crisis services from the behavioral
125125 19 health recovery center;
126126 20 (ii) collect non-identifying data relating to
127127 21 the proposed project; and
128128 22 (iii) provide transparency on the costs and
129129 23 operation of the proposed project; and
130130 24 (5) provide other information requested by the
131131 25 Department to ensure that the proposed project satisfies
132132 26 the criteria described in subsection (f).

143143 1 (f) In evaluating an application for the grant, the
144144 2 Department shall consider:
145145 3 (1) the extent to which the proposed project will
146146 4 fulfill the purposes described in subsection (c);
147147 5 (2) the extent to which the population described in
148148 6 paragraph (1) of subsection (d) is likely to benefit from
149149 7 the proposed project;
150150 8 (3) the cost of the proposed project;
151151 9 (4) the extent to which any existing or planned
152152 10 contracts or partnerships between the applicant and other
153153 11 individuals or entities to develop and implement the
154154 12 project, or additional funding sources available to the
155155 13 applicant for the proposed project, are likely to benefit
156156 14 the proposed project; and
157157 15 (5) the viability and innovation of the proposed
158158 16 project.
159159 17 (g) Before June 30, 2025, the Department shall report to
160160 18 the Mental Health and Addiction Committee of the House and the
161161 19 Behavioral and Mental Health Committee of the Senate
162162 20 regarding:
163163 21 (1) each county awarded a grant under this Section;
164164 22 and
165165 23 (2) the details of each project.
166166 24 (h) Before June 30, 2027, the Department shall report to
167167 25 the Mental Health and Addiction Committee of the House and the
168168 26 Behavioral and Mental Health Committee of the Senate, or

181181 3 (2) knowledge gained relating to the provision of

184184 6 (3) recommendations for the future use of mental
185185 7 health crisis services and substance use disorder crisis
186186 8 services in behavioral health recovery centers; and
187187 9 (4) obstacles encountered in the provision of mental
188188 10 health crisis services in a behavioral health recovery
189189 11 center.
190190 12 Section 10. The Illinois Public Aid Code is amended by
191191 13 adding Section 5-52 as follows:

193193 15 Sec. 5-52. Reimbursement for crisis management services at
194194 16 behavioral health recovery centers.
195195 17 (a) As used in this Section:
196196 18 "Behavioral health recovery center" has the meaning
197197 19 ascribed to that term in Section 5-28 of the Substance Use
198198 20 Disorder Act.
199199 21 "Crisis management services" means behavioral health
200200 22 services provided to an individual who is experiencing a
201201 23 mental health crisis or substance use crisis.
202202 24 "Managed care organization" has the meaning ascribed to

214214 2 (b) No later than July 1, 2024, the Department shall apply
215215 3 for a waiver or Title XIX State Plan amendment with the federal
216216 4 Centers for Medicare and Medicaid Services to offer a program
217217 5 that provides reimbursement through a bundled daily rate for
218218 6 crisis management services that are delivered to an individual
219219 7 during the individual's stay at a behavioral health recovery
220220 8 center.
221221 9 (c) If the waiver or Title XIX State Plan amendment
222222 10 described in subsection (b) is approved, the Department shall:
223223 11 (1) implement the program described in subsection (b);
224224 12 and
225225 13 (2) require a managed care organization that contracts
226226 14 with the Department for behavioral health services or
227227 15 integrated health services to provide coverage for crisis
228228 16 management services that are delivered to an individual
229229 17 during the individual's stay at a behavioral health
230230 18 recovery center.
231231 19 (d) The Department may elect to integrate payment for
232232 20 physical health services provided in a behavioral health
233233 21 recovery center. In determining whether to integrate payment
234234 22 under this subsection, the Department shall consult with
235235 23 managed care organizations and counties in the State.
