1515 1 AN ACT concerning local government.
1616 2 Be it enacted by the People of the State of Illinois,
1717 3 represented in the General Assembly:
1818 4 Section 5. The Counties Code is amended by adding Section
1919 5 1005.11 as follows:

2121 7 Sec. 1005.11. Regulations penalizing tenants for contact
2222 8 with law enforcement agencies.
2323 9 (a) As used in this Section:
2424 10 "Certificate of occupancy" means a license or permit
2525 11 required for the rental or occupancy of a dwelling unit.
2626 12 "Contact" encompasses any interaction with a law
2727 13 enforcement agency, including, but not limited to, notice,
2828 14 stop, arrest or detention, conviction or charge, or calls to
2929 15 or response by a law enforcement agency or other emergency
3030 16 services.
3131 17 "Law enforcement agency" means a department or agency of
3232 18 the United States, a state, a local government, or other
3333 19 political subdivision of the United States, a state, or a
3434 20 local government authorized by law or regulation to engage in
3535 21 or supervise the prevention, detection, investigation, or

9595 16 or imposition or threatened imposition of a similar
9696 17 designation.
9797 18 (7) An actual or threatened nuisance action.
9898 19 (8) A mandate or encouragement of the warrantless
9999 20 installation of, or police access to, surveillance
100100 21 equipment, such as cameras, recorders, or other similar
101101 22 devices intended to monitor tenant activity.
102102 23 (9) An actual or threatened restriction on the right
103103 24 to quiet enjoyment, including, but not limited to, the
104104 25 right to have guests.
105105 26 (10) Any other action that has the effect of

117117 2 tenant's or applicant's housing, tenancy, or housing
118118 3 opportunity.
119119 4 "Subsidized housing" means any local, State, or federal
120120 5 housing program intended to provide affordable housing or a
121121 6 housing subsidy or rental assistance to low-income or
122122 7 moderate-income persons.
123123 8 "Program" means any voluntary or mandatory initiative
124124 9 operated or endorsed by a local government, a housing
125125 10 authority, or a law enforcement agency.
126126 11 (b) A county may not enact a program, ordinance,
127127 12 resolution, or other regulation that:
128128 13 (1) penalizes landlords or tenants, guests, or others
129129 14 for contact with a law enforcement agency;
130130 15 (2) requires or encourages landlords to evict or
131131 16 penalize tenants or household members for contact with a
132132 17 law enforcement agency, a criminal conviction, or alleged
133133 18 unlawful conduct, including through cooperating agreements
134134 19 with law enforcement agencies;
135135 20 (3) requires or promotes the use of criminal
136136 21 background checks of prospective or current tenants;
137137 22 (4) defines nuisance behavior to include contact with
138138 23 a law enforcement agency;
139139 24 (5) requires tenants to secure certificates of
140140 25 occupancy as a condition of leasing rental housing or

152152 1 (6) creates or promotes the use of a registry of
153153 2 individual tenants for the purpose of discouraging
154154 3 landlords from renting to those tenants or otherwise
155155 4 excluding such individuals from rental housing within the
156156 5 subject jurisdiction;
157157 6 (7) penalizes tenants, guests, or others for contact
158158 7 made to police or other emergency services; or
159159 8 (8) requires or promotes the use of a lease addendum
160160 9 that penalizes tenants, guests, or others for any of the
161161 10 conditions listed in paragraphs (1) through (7) or is
162162 11 contrary to or inconsistent with requirements under
163163 12 federal law.
164164 13 (c) A program, ordinance, resolution, or other regulation
165165 14 that violates any of the provisions of this Section is void and
166166 15 unenforceable and cannot serve as a basis to pursue an
167167 16 eviction.
168168 17 (d) A resident, tenant, prospective tenant, owner,
169169 18 landlord, occupant, or any other aggrieved party may file an
170170 19 action in circuit court, including for injunctive relief or
171171 20 monetary relief, against a county to enforce the various
172172 21 provisions of this Section, including, without limitation, an
173173 22 order invalidating the subject program, ordinance, resolution,
174174 23 or other regulation to the extent required to bring it into
175175 24 compliance with the requirements of this Section. A person or
176176 25 entity who is the prevailing party in an action under this
177177 26 subsection shall also be entitled to reasonable attorney's

189189 2 (e) A county with a program, ordinance, resolution, or

193193 6 date of this amendatory Act of the 103rd General Assembly.
194194 7 (f) A home rule county may not have regulations that are
195195 8 inconsistent with this Section. This Section is a limitation
196196 9 under subsection (i) of Section 6 of Article VII of the
197197 10 Illinois Constitution on the concurrent exercise by home rule
198198 11 units of powers and functions exercised by the State.

370370 7 "Certificate of occupancy" means a license or permit

372372 9 "Contact" encompasses any interaction with a law
373373 10 enforcement agency, including, but not limited to, notice,
374374 11 stop, arrest or detention, conviction or charge, or calls to
375375 12 or response by a law enforcement agency or other emergency
376376 13 services.
377377 14 "Law enforcement agency" means a department or agency of
378378 15 the United States, a state, a local government, or other
379379 16 political subdivision of the United States, a state, or a
380380 17 local government authorized by law or regulation to engage in
381381 18 or supervise the prevention, detection, investigation, or
382382 19 prosecution of a violation of criminal or civil law,
383383 20 including, but not limited to, United States Immigration and
384384 21 Customs Enforcement and the State's Department of Human
385385 22 Services or Department of Children and Family Services.
386386 23 "Penalize" means any of the following:

404404 7 (5) An actual or threatened revocation, suspension, or
405405 8 nonrenewal of a certificate of occupancy.
406406 9 (6) A designation of closure or a threatened closure
407407 10 of a property, designation as a nuisance property or as a
408408 11 perpetrator of criminal activity under local regulation,
409409 12 or imposition or threatened imposition of a similar
410410 13 designation.
411411 14 (7) An actual or threatened nuisance action.
412412 15 (8) A mandate or encouragement of the warrantless
413413 16 installation of, or police access to, surveillance
414414 17 equipment, such as cameras, recorders, or other similar
415415 18 devices intended to monitor tenant activity.
416416 19 (9) An actual or threatened restriction on the right
417417 20 to quiet enjoyment, including, but not limited to, the
418418 21 right to have guests.
419419 22 (10) Any other action that has the effect of
420420 23 materially interfering with the landlord's property or a
421421 24 tenant's or applicant's housing, tenancy, or housing
422422 25 opportunity.
423423 26 "Subsidized housing" means any local, State, or federal

434434 1 housing program intended to provide affordable housing or a
435435 2 housing subsidy or rental assistance to low-income or
436436 3 moderate-income persons.
437437 4 "Program" means any voluntary or mandatory initiative
438438 5 operated or endorsed by a local government, a housing
439439 6 authority, or a law enforcement agency.
440440 7 (b) A housing authority may not enact a program,
441441 8 ordinance, resolution, or other regulation that:
442442 9 (1) penalizes landlords or tenants, guests, or others
443443 10 for contact with a law enforcement agency;
444444 11 (2) requires or encourages landlords to evict or
445445 12 penalize tenants or household members for contact with a
446446 13 law enforcement agency, a criminal conviction, or alleged
447447 14 unlawful conduct, including through cooperating agreements
448448 15 with law enforcement agencies;
449449 16 (3) requires or promotes the use of criminal
450450 17 background checks of prospective or current tenants;
451451 18 (4) defines nuisance behavior to include contact with
452452 19 a law enforcement agency;
453453 20 (5) requires tenants to secure certificates of
454454 21 occupancy as a condition of leasing rental housing or
455455 22 turning on utilities;
456456 23 (6) creates or promotes the use of a registry of
457457 24 individual tenants for the purpose of discouraging
458458 25 landlords from renting to those tenants or otherwise
459459 26 excluding such individuals from rental housing within the

470470 1 subject jurisdiction;
471471 2 (7) penalizes tenants, guests, or others for contact
472472 3 made to police or other emergency services; or
473473 4 (8) requires or promotes the use of a lease addendum
474474 5 that penalizes tenants, guests, or others for any of the
475475 6 conditions listed in paragraphs (1) through (7) or is
476476 7 contrary to or inconsistent with requirements under
477477 8 federal law.
478478 9 (c) A program, ordinance, resolution, or other regulation
479479 10 that violates any of the provisions of this Section is void and
480480 11 unenforceable and cannot serve as a basis to pursue an
481481 12 eviction.
482482 13 (d) A resident, tenant, prospective tenant, owner,
483483 14 landlord, occupant, or any other aggrieved party may file an
484484 15 action in circuit court, including for injunctive relief or
485485 16 monetary relief, against a housing authority to enforce the
486486 17 various provisions of this Section, including, without
487487 18 limitation, an order invalidating the subject program,
488488 19 ordinance, resolution, or other regulation to the extent
489489 20 required to bring it into compliance with the requirements of
490490 21 this Section. A person or entity who is the prevailing party in
491491 22 an action under this subsection shall also be entitled to
492492 23 reasonable attorney's fees and costs.
493493 24 (e) A housing authority with a program, ordinance,
494494 25 resolution, or other regulation that violates any of the
495495 26 provisions of this Section shall repeal the program,

507507 2 year after the effective date of this amendatory Act of the
508508 3 103rd General Assembly.
509509 4 (f) A home rule municipality may not have regulations that
510510 5 are inconsistent with this Section. This Section is a
511511 6 limitation under subsection (i) of Section 6 of Article VII of
512512 7 the Illinois Constitution on the concurrent exercise by home
513513 8 rule units of powers and functions exercised by the State.
514514 9 Section 97. Severability. The provisions of this Act are
515515 10 severable under Section 1.31 of the Statute on Statutes.
