18 | 18 | | 8 (a) The The widow's annuity shall be 50% of the amount of |

19 | 19 | | 9 retirement annuity payable to the member on the date of death |

20 | 20 | | 10 while on retirement if an annuitant, or on the date of his |
---|
21 | 21 | | 11 death while in service if an employee, regardless of his age on |
---|
22 | 22 | | 12 such date, or on the date of withdrawal if death occurred after |
---|
23 | 23 | | 13 termination of service under the conditions prescribed in the |
---|
24 | 24 | | 14 preceding Section. |
---|
25 | 25 | | 15 (b) If an eligible widow, regardless of age, has in her |
---|
26 | 26 | | 16 care any unmarried child or children of the member under age 18 |
---|
27 | 27 | | 17 (under age 22 if a full-time student), the widow's annuity |
---|
28 | 28 | | 18 shall be increased in the amount of 5% of the retirement |
---|
29 | 29 | | 19 annuity for each such child, but the combined payments for a |
---|
30 | 30 | | 20 widow and children shall not exceed 66 2/3% of the member's |
---|

78 | 78 | | 11 (d) Except as otherwise provided in this subsection (d), a |
---|
79 | 79 | | 12 widow's annuity payable on account of any covered employee who |
---|
80 | 80 | | 13 has been a covered employee for at least 18 months shall be |
---|
81 | 81 | | 14 reduced by 1/2 of the amount of survivors benefits to which his |
---|
82 | 82 | | 15 beneficiaries are eligible under the provisions of the Federal |
---|
83 | 83 | | 16 Social Security Act, except that (1) the amount of any widow's |
---|
84 | 84 | | 17 annuity payable under this Article shall not be reduced by |
---|
85 | 85 | | 18 reason of any increase under that Act which occurs after the |
---|
86 | 86 | | 19 offset required by this subsection is first applied to that |
---|
87 | 87 | | 20 annuity, and (2) for benefits granted on or after January 1, |
---|
88 | 88 | | 21 1992, the offset under this subsection (d) shall not exceed |
---|
89 | 89 | | 22 50% of the amount of widow's annuity otherwise payable. |
---|
90 | 90 | | 23 Beginning July 1, 2009, the offset under this subsection |
---|
91 | 91 | | 24 (d) shall no longer be applied to any widow's annuity of any |
---|
