Increases the penalties by 3 years for a minimum sentence and 10 years for a maximum sentence for the knowing manufacture or delivery or possession with intent to manufacture or deliver 15 grams or more of any substance containing fentanyl, or an analog thereof. Provides that the knowing manufacture or delivery or possession with intent to manufacture or deliver 15 grams or more of any substance containing fentanyl, or an analog thereof of one gram or more but less than 15 grams of any substance containing fentanyl, or an analog thereof is a Class X (rather than a Class 1) felony. Provides that excluding violations of the Act when the controlled substance is fentanyl, any person sentenced to a term of imprisonment with respect to violations of these provisions, controlled substance trafficking, calculated criminal drug conspiracy, criminal drug conspiracy, streetgang criminal drug conspiracy, or delivery of controlled substances to persons under 18 years of age or at truck stops, safety rest areas, or school, when the substance containing the controlled substance contains any amount of fentanyl, 6 (rather than 3) years shall be added to the term of imprisonment imposed by the court, and the maximum sentence for the offense shall be increased by 6 (rather than 3) years. With respect to the offense of controlled substance trafficking, if the substance trafficked contains any amount of fentanyl, a person convicted of controlled substance trafficking shall be sentenced to a term of imprisonment not less than 3 times the minimum term and fined an amount as authorized by this Act, based upon the amount of fentanyl brought or caused to be brought into the State, and not more than 3 times the maximum term of imprisonment and fined 3 times the amount as authorized by this Act, based upon the amount of fentanyl brought or caused to be brought into the State. 1212 1 AN ACT concerning criminal law.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Illinois Controlled Substances Act is
1616 5 amended by changing Sections 401 and 401.1 as follows:
1717 6 (720 ILCS 570/401) (from Ch. 56 1/2, par. 1401)
1818 7 Sec. 401. Manufacture or delivery, or possession with
1919 8 intent to manufacture or deliver, a controlled substance, a
2020 9 counterfeit substance, or controlled substance analog. Except
2121 10 as authorized by this Act, it is unlawful for any person
2222 11 knowingly to manufacture or deliver, or possess with intent to
2323 12 manufacture or deliver, a controlled substance other than
2424 13 methamphetamine and other than bath salts as defined in the
2525 14 Bath Salts Prohibition Act sold or offered for sale in a retail
2626 15 mercantile establishment as defined in Section 16-0.1 of the
2727 16 Criminal Code of 2012, a counterfeit substance, or a
2828 17 controlled substance analog. A violation of this Act with
2929 18 respect to each of the controlled substances listed herein
3030 19 constitutes a single and separate violation of this Act. For
3131 20 purposes of this Section, "controlled substance analog" or
3232 21 "analog" means a substance, other than a controlled substance,

7373 3 controlled substance in Schedule I or II, or that was
7474 4 specifically designed to produce an effect substantially
7575 5 similar to that of a controlled substance in Schedule I or II.
7676 6 Examples of chemical classes in which controlled substance
7777 7 analogs are found include, but are not limited to, the
7878 8 following: phenethylamines, N-substituted piperidines,
7979 9 morphinans, ecgonines, quinazolinones, substituted indoles,
8080 10 and arylcycloalkylamines. For purposes of this Act, a
8181 11 controlled substance analog shall be treated in the same
8282 12 manner as the controlled substance to which it is
8383 13 substantially similar.
8484 14 (a) Any person who violates this Section with respect to
8585 15 the following amounts of controlled or counterfeit substances
8686 16 or controlled substance analogs, notwithstanding any of the
8787 17 provisions of subsections (c), (d), (e), (f), (g) or (h) to the
8888 18 contrary, is guilty of a Class X felony and shall be sentenced
8989 19 to a term of imprisonment as provided in this subsection (a)
9090 20 and fined as provided in subsection (b):
9191 21 (1)(A) not less than 6 years and not more than 30 years
9292 22 with respect to 15 grams or more but less than 100 grams of
9393 23 a substance containing heroin, or an analog thereof;

342342 20 (b-1) Excluding violations of this Act when the controlled

541541 4 (b) A person convicted of controlled substance trafficking
542542 5 shall be sentenced to a term of imprisonment not less than
543543 6 twice the minimum term and fined an amount as authorized by
544544 7 Section 401 of this Act, based upon the amount of controlled or
545545 8 counterfeit substance brought or caused to be brought into
546546 9 this State, and not more than twice the maximum term of
547547 10 imprisonment and fined twice the amount as authorized by
548548 11 Section 401 of this Act, based upon the amount of controlled or
549549 12 counterfeit substance brought or caused to be brought into
550550 13 this State; except if the substance trafficked contains any
551551 14 amount of fentanyl, a person convicted of controlled substance
552552 15 trafficking shall be sentenced to a term of imprisonment not
553553 16 less than 3 times the minimum term and fined an amount as
554554 17 authorized by Section 401 of this Act, based upon the amount of
555555 18 fentanyl brought or caused to be brought into this State, and
556556 19 not more than 3 times the maximum term of imprisonment and
557557 20 fined 3 times the amount as authorized by Section 401 of this
558558 21 Act, based upon the amount of fentanyl brought or caused to be
559559 22 brought into this State.
560560 23 (c) It shall be a Class 2 felony for which a fine not to
561561 24 exceed $100,000 may be imposed for any person to knowingly use
562562 25 a cellular radio telecommunication device in the furtherance
