11	11	1 AN ACT concerning transportation.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Toll Highway Act is amended by changing
15	15	5 Section 19 as follows:

17	17	7 Sec. 19. Toll rates. The Authority shall fix and revise
18	18	8 from time to time, tolls or charges or rates for the privilege
19	19	9 of using each of the toll highways constructed pursuant to
20	20	10 this Act. Such tolls shall be so fixed and adjusted at rates
21	21	11 calculated to provide the lowest reasonable toll rates that
22	22	12 will provide funds sufficient with other revenues of the
23	23	13 Authority to pay, (a) the cost of the construction of a toll
24	24	14 highway authorized by joint resolution of the General Assembly
25	25	15 pursuant to Section 14.1 and the reconstruction, major repairs
26	26	16 or improvements of toll highways, (b) the cost of maintaining,
27	27	17 repairing, regulating and operating the toll highways
28	28	18 including only the necessary expenses of the Authority, and
29	29	19 (c) the principal of all bonds, interest thereon and all
30	30	20 sinking fund requirements and other requirements provided by
31	31	21 resolutions authorizing the issuance of the bonds as they
32	32	22 shall become due. In fixing the toll rates pursuant to this
33	33	23 Section 19 and Section 10(c) of this Act, the Authority shall

68	68	1 take into account the effect of the provisions of this Section
69	69	2 19 permitting the use of the toll highway system without
70	70	3 payment of the covenants of the Authority contained in the
71	71	4 resolutions and trust indentures authorizing the issuance of
72	72	5 bonds of the Authority. No such provision permitting the use
73	73	6 of the toll highway system without payment of tolls after the
74	74	7 date of this amendatory Act of the 95th General Assembly shall
75	75	8 be applied in a manner that impairs the rights of bondholders
76	76	9 pursuant to any resolution or trust indentures authorizing the
77	77	10 issuance of bonds of the Authority. The use and disposition of
78	78	11 any sinking or reserve fund shall be subject to such
79	79	12 regulation as may be provided in the resolution or trust
80	80	13 indenture authorizing the issuance of the bonds. Subject to
81	81	14 the provisions of any resolution or trust indenture
82	82	15 authorizing the issuance of bonds any moneys in any such
83	83	16 sinking fund in excess of an amount equal to one year's
84	84	17 interest on the bonds then outstanding secured by such sinking
85	85	18 fund may be applied to the purchase or redemption of bonds. All
86	86	19 such bonds so redeemed or purchased shall forthwith be
87	87	20 cancelled and shall not again be issued. No person shall be
88	88	21 permitted to use any toll highway without paying the toll
89	89	22 established under this Section except when on official Toll
90	90	23 Highway Authority business which includes police and other
91	91	24 emergency vehicles. However, any law enforcement agency
92	92	25 vehicle, fire department vehicle, public or private ambulance
93	93	26 service vehicle engaged in the performance of an emergency

104	104	1 service or duty that necessitates the use of the toll highway
105	105	2 system, or other emergency vehicle that is plainly marked
106	106	3 shall not be required to pay a toll to use a toll highway. A
107	107	4 law enforcement, fire protection, or emergency services
108	108	5 officer driving a law enforcement, fire protection, emergency
109	109	6 services agency vehicle, or public or private ambulance
110	110	7 service vehicle engaging in the performance of emergency
111	111	8 services or duties that is not plainly marked must present an
112	112	9 Official Permit Card which the law enforcement, fire
113	113	10 protection, or emergency services officer receives from his or
114	114	11 her law enforcement, fire protection, emergency services
115	115	12 agency, or public or private ambulance service in order to use
116	116	13 a toll highway without paying the toll. A law enforcement,
117	117	14 fire protection, emergency services agency, or public or
118	118	15 private ambulance service engaging in the performance of
119	119	16 emergency services or duties must apply to the Authority to
120	120	17 receive a permit, and the Authority shall adopt rules for the
121	121	18 issuance of a permit, that allows public or private ambulance
122	122	19 service vehicles engaged in the performance of emergency
123	123	20 services or duties that necessitate the use of the toll
124	124	21 highway system and all law enforcement, fire protection, or
125	125	22 emergency services agency vehicles of the law enforcement,
126	126	23 fire protection, or emergency services agency to use any toll
127	127	24 highway without paying the toll established under this
128	128	25 Section. A veteran who is traveling to or from a medical
129	129	26 appointment may use a toll highway without paying the toll if

140	140	1 the veteran has applied for and received from the Authority an
141	141	2 Official Permit Card. The Authority shall adopt rules for the
142	142	3 issuance of a permit that allows a veteran to use any toll
143	143	4 highway without paying the toll established under this Section
144	144	5 while traveling to a medical appointment. The Authority shall
145	145	6 maintain in its office a list of all persons that are
146	146	7 authorized to use any toll highway without charge when on
147	147	8 official business of the Authority and such list shall be open
148	148	9 to the public for inspection. In recognition of the unique
149	149	10 role of public transportation in providing effective
150	150	11 transportation in the Authority's service region, and to give
151	151	12 effect to the exemption set forth in subsection (b) of Section
152	152	13 2.06 of the Regional Transportation Authority Act, the
153	153	14 following vehicles may use any toll highway without paying the
154	154	15 toll: (1) a vehicle owned or operated by the Suburban Bus
155	155	16 Division of the Regional Transportation Authority that is
156	156	17 being used to transport passengers for hire; and (2) any
157	157	18 revenue vehicle that is owned or operated by a Mass Transit
158	158	19 District created under Section 3 of the Local Mass Transit
159	159	20 District Act and running regular scheduled service.
160	160	21 Among other matters, this amendatory Act of 1990 is
161	161	22 intended to clarify and confirm the prior intent of the
162	162	23 General Assembly to allow toll revenues from the toll highway
163	163	24 system to be used to pay a portion of the cost of the
164	164	25 construction of the North-South Toll Highway authorized by
165	165	26 Senate Joint Resolution 122 of the 83rd General Assembly in
