12	12	1 AN ACT concerning local government.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The Public Officer Prohibited Activities Act is
16	16	5 amended by adding Section 1.4 as follows:
17	17	6 (50 ILCS 105/1.4 new)
18	18	7 Sec. 1.4. Supervisor or trustee of township with fewer
19	19	8 than 2,500 inhabitants; authorization to serve on school
20	20	9 board. A supervisor or trustee of a township with fewer than
21	21	10 2,500 inhabitants, during the term of office for which the
22	22	11 supervisor or trustee is elected, may concurrently serve as a
23	23	12 school board member of a school district.
24	24	13 Section 10. The Township Code is amended by changing
25	25	14 Section 260-5 as follows:
26	26	15 (60 ILCS 1/260-5)
27	27	16 Sec. 260-5. Distributions from general fund, generally.
28	28	17 (a) To the extent that moneys in the township general fund
29	29	18 have not been appropriated for other purposes, the township
30	30	19 board may direct that distributions be made from that fund as
31	31	20 follows:

69	69	1 through 8 that are wholly or partly located within the
70	70	2 township or (ii) governmental units as defined in Section
71	71	3 1 of the Community Mental Health Act that provide mental
72	72	4 health facilities and services (including facilities and
73	73	5 services for persons with intellectual disabilities) under
74	74	6 that Act within the township, or (iii) both.
75	75	7 (2) To community action agencies that serve township
76	76	8 residents. "Community action agencies" are defined as in
77	77	9 Part A of Title II of the federal Economic Opportunity Act
78	78	10 of 1964.
79	79	11 (b) Notwithstanding subsection (a), a township board may
80	80	12 not direct a distribution to be made from the township's
81	81	13 general fund to a school district if a supervisor or trustee of
82	82	14 the township is concurrently serving as a school board member
83	83	15 for that school district.
