1212 1 AN ACT concerning local government.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Public Officer Prohibited Activities Act is
1616 5 amended by adding Section 1.4 as follows:
1717 6 (50 ILCS 105/1.4 new)
1818 7 Sec. 1.4. Supervisor or trustee of township with fewer
1919 8 than 2,500 inhabitants; authorization to serve on school
2020 9 board. A supervisor or trustee of a township with fewer than
2121 10 2,500 inhabitants, during the term of office for which the
2222 11 supervisor or trustee is elected, may concurrently serve as a
2323 12 school board member of a school district.
2424 13 Section 10. The Township Code is amended by changing
2525 14 Section 260-5 as follows:

2727 16 Sec. 260-5. Distributions from general fund, generally.
2828 17 (a) To the extent that moneys in the township general fund
2929 18 have not been appropriated for other purposes, the township
3030 19 board may direct that distributions be made from that fund as

6969 1 through 8 that are wholly or partly located within the
7070 2 township or (ii) governmental units as defined in Section
7171 3 1 of the Community Mental Health Act that provide mental
7272 4 health facilities and services (including facilities and
7373 5 services for persons with intellectual disabilities) under
7474 6 that Act within the township, or (iii) both.
7575 7 (2) To community action agencies that serve township
7676 8 residents. "Community action agencies" are defined as in
7777 9 Part A of Title II of the federal Economic Opportunity Act
7878 10 of 1964.
7979 11 (b) Notwithstanding subsection (a), a township board may
8080 12 not direct a distribution to be made from the township's
8181 13 general fund to a school district if a supervisor or trustee of
8282 14 the township is concurrently serving as a school board member
8383 15 for that school district.
