11	11	1 AN ACT concerning criminal law.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Criminal Code of 2012 is amended by
15	15	5 changing Section 16-3 as follows:
16	16	6 (720 ILCS 5/16-3) (from Ch. 38, par. 16-3)
17	17	7 Sec. 16-3. Theft of labor or services or use of property.
18	18	8 (a) A person commits theft when he or she knowingly
19	19	9 obtains the temporary use of property, labor or services of
20	20	10 another which are available only for hire, by means of threat
21	21	11 or deception or knowing that such use is without the consent of
22	22	12 the person providing the property, labor or services. For the
23	23	13 purposes of this subsection, library material is available for
24	24	14 hire.
25	25	15 (b) A person commits theft when after (1) renting or
26	26	16 leasing a motor vehicle, (2) obtaining a motor vehicle through
27	27	17 a "driveaway" service mode of transportation, (3) renting or
28	28	18 leasing equipment exceeding $500 in value including tools,
29	29	19 construction or industry equipment, and such items as linens,
30	30	20 tableware, tents, tables, chairs and other equipment specially
31	31	21 rented for a party or special event, or (4) renting or leasing
32	32	22 any other type of personal property exceeding $500 in value,
33	33	23 under an agreement in writing which provides for the return of

68	68	1 the vehicle, equipment, or other personal property to a
69	69	2 particular place at a particular time, he or she without good
70	70	3 cause knowingly fails to return the vehicle, equipment, or
71	71	4 other personal property to that place within the time
72	72	5 specified, and is thereafter notified through electronic
73	73	6 means, including email, text, or email and text, or served or
74	74	7 sent a written demand mailed to the last known address, made by
75	75	8 certified mail return receipt requested, to return the
76	76	9 vehicle, equipment, or other personal property within 3 days
77	77	10 from the mailing of the written demand or 24 hours from the
78	78	11 notification through electronic means which includes email,
79	79	12 text, or email and text, and who without good cause knowingly
80	80	13 fails to return the vehicle, equipment, or any other personal
81	81	14 property to any place of business of the lessor within the
82	82	15 return period or places the vehicle, equipment, or any other
83	83	16 personal property for sale during the rental period or
84	84	17 thereafter. The trier of fact may infer evidence that the
85	85	18 person is without good cause if the person signs the agreement
86	86	19 with a name or address other than his or her own.
87	87	20 (c) A person commits theft when he or she borrows from a
88	88	21 library facility library material which has an aggregate value
89	89	22 of $50 or more pursuant to an agreement with or procedure
90	90	23 established by the library facility for the return of such
91	91	24 library material, and knowingly without good cause fails to
92	92	25 return the library material so borrowed in accordance with
93	93	26 such agreement or procedure, and further knowingly without
