12	12	1 AN ACT concerning education.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The School Code is amended by adding Sections
16	16	5 10-22.34d and 34-18.88 as follows:
17	17	6 (105 ILCS 5/10-22.34d new)
18	18	7 Sec. 10-22.34d. School chaplains.
19	19	8 (a) Each school board may employ or accept as a volunteer a
20	20	9 certified chaplain to provide to a school support, services,
21	21	10 and programs for students, staff, and parents as assigned by
22	22	11 the school board. The chaplain shall be selected by and be
23	23	12 responsible to the school board.
24	24	13 (b) Any chaplain employed or accepted as a volunteer under
25	25	14 this Section is not required to be certified by the State Board
26	26	15 of Education.
27	27	16 (c) Nothing in this Section prohibits any school board
28	28	17 from employing or accepting as a volunteer more than one
29	29	18 chaplain for any school.
30	30	19 (d) A school board that employs or accepts as a volunteer a
31	31	20 chaplain under this Section shall ensure that the chaplain
32	32	21 submits to a fingerprint-based criminal history records check
33	33	22 and check of the Statewide Sex Offender Database and Statewide

73	73	3 (e) A school board may not employ or accept as a volunteer
74	74	4 a chaplain who has registered or is required to register under

76	76	6 Murderer and Violent Offender Against Youth Registration Act.
77	77	7 (f) No person shall have a cause of action against a
78	78	8 chaplain employed or accepted as a volunteer under this
79	79	9 Section for any action taken or statement made by the chaplain
80	80	10 in adherence with the provision of support, services, or
81	81	11 programs for students, staff, or parents. However, this
82	82	12 immunity does not apply to any action or statement by a
83	83	13 chaplain that was maliciously, willfully, and deliberately
84	84	14 intended to cause harm or harass or to intimidate those
85	85	15 seeking support, services, or programs.

87	87	17 Sec. 34-18.88. School chaplains.
88	88	18 (a) The board may employ or accept as a volunteer a
89	89	19 certified chaplain to provide to a school support, services,
90	90	20 and programs for students, staff, and parents as assigned by
91	91	21 the board. The chaplain shall be selected by and be
92	92	22 responsible to the board.
93	93	23 (b) Any chaplain employed or accepted as a volunteer under
94	94	24 this Section is not required to be certified by the State Board
