Allows each school board to employ or accept as a volunteer a certified chaplain to provide to a school support, services, and programs for students, staff, and parents as assigned by the school board. Sets forth the selection process, certification requirements, and amount of chaplains a school may employ or accept as a volunteer. Requires a chaplain to submit to a fingerprint-based criminal history records check and check of the Statewide Sex Offender Database and the Statewide Murderer and Violent Offender Against Youth Database before the chaplain begins employment or volunteering at a school. Prohibits a chaplain from being employed or accepted as a volunteer if the chaplain is registered or is required to register under the Sex Offender Registration Act or the Murderer and Violent Offender Against Youth Registration Act. Provides that no person shall have a cause of action against a chaplain for any action taken or statement made in adherence with the provision of support, services, or programs for students, staff, or parents. 1212 1 AN ACT concerning education.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The School Code is amended by adding Sections
1616 5 10-22.34d and 34-18.88 as follows:
1717 6 (105 ILCS 5/10-22.34d new)
1818 7 Sec. 10-22.34d. School chaplains.
1919 8 (a) Each school board may employ or accept as a volunteer a
2020 9 certified chaplain to provide to a school support, services,
2121 10 and programs for students, staff, and parents as assigned by
2222 11 the school board. The chaplain shall be selected by and be
2323 12 responsible to the school board.
2424 13 (b) Any chaplain employed or accepted as a volunteer under
2525 14 this Section is not required to be certified by the State Board
2626 15 of Education.
2727 16 (c) Nothing in this Section prohibits any school board
2828 17 from employing or accepting as a volunteer more than one
2929 18 chaplain for any school.
3030 19 (d) A school board that employs or accepts as a volunteer a
3131 20 chaplain under this Section shall ensure that the chaplain
3232 21 submits to a fingerprint-based criminal history records check
3333 22 and check of the Statewide Sex Offender Database and Statewide

7373 3 (e) A school board may not employ or accept as a volunteer
7474 4 a chaplain who has registered or is required to register under
7575 5 the Statewide Sex Offender Registration Act or Statewide
7676 6 Murderer and Violent Offender Against Youth Registration Act.
7777 7 (f) No person shall have a cause of action against a
7878 8 chaplain employed or accepted as a volunteer under this
7979 9 Section for any action taken or statement made by the chaplain
8080 10 in adherence with the provision of support, services, or
8181 11 programs for students, staff, or parents. However, this
8282 12 immunity does not apply to any action or statement by a
8383 13 chaplain that was maliciously, willfully, and deliberately
8484 14 intended to cause harm or harass or to intimidate those
8585 15 seeking support, services, or programs.

8787 17 Sec. 34-18.88. School chaplains.
8888 18 (a) The board may employ or accept as a volunteer a
8989 19 certified chaplain to provide to a school support, services,
9090 20 and programs for students, staff, and parents as assigned by
9191 21 the board. The chaplain shall be selected by and be
9292 22 responsible to the board.
9393 23 (b) Any chaplain employed or accepted as a volunteer under
9494 24 this Section is not required to be certified by the State Board
9595 25 of Education.
