9 | 17 | | 7 Sec. 6-110. Licenses issued to drivers. |
---|
10 | 18 | | 8 (a) The Secretary of State shall issue to every qualifying |
---|
11 | 19 | | 9 applicant a driver's license as applied for, which license |
---|
12 | 20 | | 10 shall bear a distinguishing number assigned to the licensee, |
---|
13 | 21 | | 11 the legal name, signature, zip code, date of birth, residence |
---|
14 | 22 | | 12 address, and a brief description of the licensee. |
---|
15 | 23 | | 13 Licenses issued shall also indicate the classification and |
---|
16 | 24 | | 14 the restrictions under Section 6-104 of this Code. The |
---|
17 | 25 | | 15 Secretary may adopt rules to establish informational |
---|
18 | 26 | | 16 restrictions that can be placed on the driver's license |
---|
19 | 27 | | 17 regarding specific conditions of the licensee. |
---|
20 | 28 | | 18 A driver's license issued may, in the discretion of the |
---|
21 | 29 | | 19 Secretary, include a suitable photograph of a type prescribed |
---|
22 | 30 | | 20 by the Secretary. |
---|
23 | 31 | | 21 (a-1) If the licensee is less than 18 years of age, unless |
---|
24 | 32 | | 22 one of the exceptions in subsection (a-2) apply, the license |
---|
25 | 33 | | 23 shall, as a matter of law, be invalid for the operation of any |
---|

49 | 83 | | 16 activity, without any detour or stop; |

50 | 84 | | 17 (5) involved in an emergency; |

51 | 85 | | 18 (6) going to or returning home from, without any |
---|
52 | 86 | | 19 detour or stop, an official school, religious, or other |
---|
53 | 87 | | 20 recreational activity supervised by adults and sponsored |

58 | 92 | | 25 (7) exercising First Amendment rights protected by the |

59 | 93 | | 26 United States Constitution, such as the free exercise of |

81 | 115 | | 12 (2) the sponsoring organization carries liability |
---|
82 | 116 | | 13 insurance covering the program. |
---|
83 | 117 | | 14 (a-3) If a graduated driver's license holder over the age |
---|
84 | 118 | | 15 of 18 committed an offense against traffic regulations |
---|
85 | 119 | | 16 governing the movement of vehicles or any violation of Section |
---|
86 | 120 | | 17 6-107 or Section 12-603.1 of this Code in the 6 months prior to |
---|
87 | 121 | | 18 the graduated driver's license holder's 18th birthday, and was |
---|
88 | 122 | | 19 subsequently convicted of the offense, the provisions of |
---|
89 | 123 | | 20 subsection (a-1) shall continue to apply until such time as a |
---|
90 | 124 | | 21 period of 6 consecutive months has elapsed without an |
---|
91 | 125 | | 22 additional violation and subsequent conviction of an offense |
---|
92 | 126 | | 23 against traffic regulations governing the movement of vehicles |
---|
93 | 127 | | 24 or Section 6-107 or Section 12-603.1 of this Code. |
---|
94 | 128 | | 25 (a-4) If an applicant for a driver's license or |
---|
95 | 129 | | 26 instruction permit has a current identification card issued by |
---|

119 | 153 | | 14 instead of the applicant's residence or mailing address. The |
---|
120 | 154 | | 15 Secretary of State shall adopt rules to implement this |
---|
121 | 155 | | 16 subsection (a-5). For the purposes of this subsection (a-5), |
---|
122 | 156 | | 17 "peace officer" means any person who by virtue of his or her |
---|
123 | 157 | | 18 office or public employment is vested by law with a duty to |
---|
124 | 158 | | 19 maintain public order or to make arrests for a violation of any |
---|
125 | 159 | | 20 penal statute of this State, whether that duty extends to all |
---|
126 | 160 | | 21 violations or is limited to specific violations. |

127 | 161 | | 22 (b) Until the Secretary of State establishes a First |

130 | 164 | | 25 format on the reverse of each driver's license issued which |
---|

150 | 184 | | 9 she is under no compulsion to execute a document of gift. A |
---|
151 | 185 | | 10 brochure explaining this method of executing an anatomical |
---|
152 | 186 | | 11 gift document shall be given to each applicant or licensee. |
---|
153 | 187 | | 12 The brochure shall advise the applicant or licensee that he or |
---|
154 | 188 | | 13 she is under no compulsion to execute a document of gift, and |
---|
155 | 189 | | 14 that he or she may wish to consult with family, friends, or |
---|
156 | 190 | | 15 clergy before doing so. The Secretary of State may undertake |
---|
157 | 191 | | 16 additional efforts, including education and awareness |
---|
158 | 192 | | 17 activities, to promote organ and tissue donation. |
---|
159 | 193 | | 18 (c) The Secretary of State shall designate on each |
---|
160 | 194 | | 19 driver's license issued a space where the licensee may place a |
---|
161 | 195 | | 20 sticker or decal of the uniform size as the Secretary may |
---|
162 | 196 | | 21 specify, which sticker or decal may indicate in appropriate |
---|
163 | 197 | | 22 language that the owner of the license carries an Emergency |
---|
164 | 198 | | 23 Medical Information Card. |
---|
165 | 199 | | 24 The sticker may be provided by any person, hospital, |
---|
166 | 200 | | 25 school, medical group, or association interested in assisting |
---|
167 | 201 | | 26 in implementing the Emergency Medical Information Card, but |
---|

186 | 220 | | 9 driver's licenses issued to individuals 21 years of age and |

187 | 221 | | 10 older. The color designated for driver's licenses for |
---|
188 | 222 | | 11 licensees under 21 years of age shall be at the discretion of |
---|
189 | 223 | | 12 the Secretary of State. |
---|
190 | 224 | | 13 (e-1) The Secretary shall provide that each driver's |
---|
191 | 225 | | 14 license issued to a person under the age of 21 displays the |
---|
192 | 226 | | 15 date upon which the person becomes 18 years of age and the date |
---|
193 | 227 | | 16 upon which the person becomes 21 years of age. |
---|
194 | 228 | | 17 (e-3) The General Assembly recognizes the need to identify |
---|
195 | 229 | | 18 military veterans living in this State for the purpose of |
---|
196 | 230 | | 19 ensuring that they receive all of the services and benefits to |
---|
197 | 231 | | 20 which they are legally entitled, including health care |
---|
198 | 232 | | 21 healthcare, education assistance, and job placement. To assist |
---|
199 | 233 | | 22 the State in identifying these veterans and delivering these |
---|
200 | 234 | | 23 vital services and benefits, the Secretary of State is |
---|
201 | 235 | | 24 authorized to issue drivers' licenses with the word "veteran" |
---|
202 | 236 | | 25 appearing on the face of the licenses. This authorization is |
---|
203 | 237 | | 26 predicated on the unique status of veterans. The Secretary may |
---|

226 | 260 | | 13 request of the applicant, the driver's license may reflect |
---|
227 | 261 | | 14 Gold Star Family designation. The Secretary shall designate a |
---|
228 | 262 | | 15 space on each original or renewal driver's license for such |
---|
229 | 263 | | 16 designation. This designation shall be available to a person |
---|
230 | 264 | | 17 eligible for Gold Star license plates under subsection (f) of |
---|
231 | 265 | | 18 Section 6-106 of this Code. |
---|
232 | 266 | | 19 (f) The Secretary of State shall inform all Illinois |
---|
233 | 267 | | 20 licensed commercial motor vehicle operators of the |
---|
234 | 268 | | 21 requirements of the Uniform Commercial Driver License Act, |
---|
235 | 269 | | 22 Article V of this Chapter, and shall make provisions to insure |
---|
236 | 270 | | 23 that all drivers, seeking to obtain a commercial driver's |
---|
237 | 271 | | 24 license, be afforded an opportunity prior to April 1, 1992, to |
