3	11		1 AN ACT concerning transportation.
4	12		2 Be it enacted by the People of the State of Illinois,
5	13		3 represented in the General Assembly:
6	14		4 Section 5. The Illinois Vehicle Code is amended by
7	15		5 changing Section 6-110 as follows:

9	17		7 Sec. 6-110. Licenses issued to drivers.
10	18		8 (a) The Secretary of State shall issue to every qualifying
11	19		9 applicant a driver's license as applied for, which license
12	20		10 shall bear a distinguishing number assigned to the licensee,
13	21		11 the legal name, signature, zip code, date of birth, residence
14	22		12 address, and a brief description of the licensee.
15	23		13 Licenses issued shall also indicate the classification and
16	24		14 the restrictions under Section 6-104 of this Code. The
17	25		15 Secretary may adopt rules to establish informational
18	26		16 restrictions that can be placed on the driver's license
19	27		17 regarding specific conditions of the licensee.
20	28		18 A driver's license issued may, in the discretion of the
21	29		19 Secretary, include a suitable photograph of a type prescribed
22	30		20 by the Secretary.
23	31		21 (a-1) If the licensee is less than 18 years of age, unless
24	32		22 one of the exceptions in subsection (a-2) apply, the license
25	33		23 shall, as a matter of law, be invalid for the operation of any

34	68		1 motor vehicle during the following times:
35	69		2 (A) Between 11:00 p.m. Friday and 6:00 a.m. Saturday;
36	70		3 (B) Between 11:00 p.m. Saturday and 6:00 a.m. on
37	71		4 Sunday; and
38	72		5 (C) Between 10:00 p.m. on Sunday to Thursday,
39	73		6 inclusive, and 6:00 a.m. on the following day.
40	74		7 (a-2) The driver's license of a person under the age of 18
41	75		8 shall not be invalid as described in subsection (a-1) of this
42	76		9 Section if the licensee under the age of 18 was:
43	77		10 (1) accompanied by the licensee's parent or guardian
44	78		11 or other person in custody or control of the minor;
45	79		12 (2) on an errand at the direction of the minor's
46	80		13 parent or guardian, without any detour or stop;
47	81		14 (3) in a motor vehicle involved in interstate travel;
48	82		15 (4) going to or returning home from an employment
49	83		16 activity, without any detour or stop;
50	84		17 (5) involved in an emergency;
51	85		18 (6) going to or returning home from, without any
52	86		19 detour or stop, an official school, religious, or other
53	87		20 recreational activity supervised by adults and sponsored
54	88		21 by a government or governmental agency, a civic
55	89		22 organization, or another similar entity that takes
56	90		23 responsibility for the licensee, without any detour or
57	91		24 stop;
58	92		25 (7) exercising First Amendment rights protected by the
59	93		26 United States Constitution, such as the free exercise of

70	104		1 religion, freedom of speech, and the right of assembly; or
71	105		2 (8) married or had been married or is an emancipated
72	106		3 minor under the Emancipation of Minors Act.
73	107		4 (a-2.5) The driver's license of a person who is 17 years of
74	108		5 age and has been licensed for at least 12 months is not invalid
75	109		6 as described in subsection (a-1) of this Section while the
76	110		7 licensee is participating as an assigned driver in a Safe
77	111		8 Rides program that meets the following criteria:
78	112		9 (1) the program is sponsored by the Boy Scouts of
79	113		10 America or another national public service organization;
80	114		11 and
81	115		12 (2) the sponsoring organization carries liability
82	116		13 insurance covering the program.
83	117		14 (a-3) If a graduated driver's license holder over the age
84	118		15 of 18 committed an offense against traffic regulations
85	119		16 governing the movement of vehicles or any violation of Section
86	120		17 6-107 or Section 12-603.1 of this Code in the 6 months prior to
87	121		18 the graduated driver's license holder's 18th birthday, and was
88	122		19 subsequently convicted of the offense, the provisions of
89	123		20 subsection (a-1) shall continue to apply until such time as a
90	124		21 period of 6 consecutive months has elapsed without an
91	125		22 additional violation and subsequent conviction of an offense
92	126		23 against traffic regulations governing the movement of vehicles
93	127		24 or Section 6-107 or Section 12-603.1 of this Code.
94	128		25 (a-4) If an applicant for a driver's license or

106	140		1 the Secretary of State, the Secretary may require the
107	141		2 applicant to utilize the same residence address and name on
108	142		3 the identification card, driver's license, and instruction
109	143		4 permit records maintained by the Secretary. The Secretary may
110	144		5 promulgate rules to implement this provision.
111	145		6 (a-5) If an applicant for a driver's license is an
112	146		7 employee of the Department of Children and Family Services
113	147		8 with a job title of "Child Protection Specialist Trainee",
114	148		9 "Child Protection Specialist", "Child Protection Advanced
115	149		10 Specialist", "Child Welfare Specialist Trainee", "Child
116	150		11 Welfare Specialist", or "Child Welfare Advanced Specialist" or
117	151		12 a judicial officer or a peace officer, the applicant may elect
118	152		13 to have his or her office or work address listed on the license
119	153		14 instead of the applicant's residence or mailing address. The
120	154		15 Secretary of State shall adopt rules to implement this
121	155		16 subsection (a-5). For the purposes of this subsection (a-5),
122	156		17 "peace officer" means any person who by virtue of his or her
123	157		18 office or public employment is vested by law with a duty to
124	158		19 maintain public order or to make arrests for a violation of any
125	159		20 penal statute of this State, whether that duty extends to all
126	160		21 violations or is limited to specific violations.
127	161		22 (b) Until the Secretary of State establishes a First
128	162		23 Person Consent organ and tissue donor registry under Section
129	163		24 6-117 of this Code, the Secretary of State shall provide a
130	164		25 format on the reverse of each driver's license issued which
131	165		26 the licensee may use to execute a document of gift conforming

142	176		1 to the provisions of the Illinois Anatomical Gift Act. The
143	177		2 format shall allow the licensee to indicate the gift intended,
144	178		3 whether specific organs, any organ, or the entire body, and
145	179		4 shall accommodate the signatures of the donor and 2 witnesses.
146	180		5 The Secretary shall also inform each applicant or licensee of
147	181		6 this format, describe the procedure for its execution, and may
148	182		7 offer the necessary witnesses; provided that in so doing, the
149	183		8 Secretary shall advise the applicant or licensee that he or
150	184		9 she is under no compulsion to execute a document of gift. A
151	185		10 brochure explaining this method of executing an anatomical
152	186		11 gift document shall be given to each applicant or licensee.
153	187		12 The brochure shall advise the applicant or licensee that he or
154	188		13 she is under no compulsion to execute a document of gift, and
155	189		14 that he or she may wish to consult with family, friends, or
156	190		15 clergy before doing so. The Secretary of State may undertake
157	191		16 additional efforts, including education and awareness
158	192		17 activities, to promote organ and tissue donation.
159	193		18 (c) The Secretary of State shall designate on each
160	194		19 driver's license issued a space where the licensee may place a
161	195		20 sticker or decal of the uniform size as the Secretary may
162	196		21 specify, which sticker or decal may indicate in appropriate
163	197		22 language that the owner of the license carries an Emergency
164	198		23 Medical Information Card.
165	199		24 The sticker may be provided by any person, hospital,
166	200		25 school, medical group, or association interested in assisting
167	201		26 in implementing the Emergency Medical Information Card, but

180	214		3 (d) (Blank). The Secretary of State shall designate on
181	215		4 each driver's license issued a space where the licensee may
182	216		5 indicate his blood type and RH factor.
183	217		6 (e) The Secretary of State shall provide that each
184	218		7 original or renewal driver's license issued to a licensee
185	219		8 under 21 years of age shall be of a distinct nature from those
186	220		9 driver's licenses issued to individuals 21 years of age and
187	221		10 older. The color designated for driver's licenses for
188	222		11 licensees under 21 years of age shall be at the discretion of
189	223		12 the Secretary of State.
190	224		13 (e-1) The Secretary shall provide that each driver's
191	225		14 license issued to a person under the age of 21 displays the
192	226		15 date upon which the person becomes 18 years of age and the date
193	227		16 upon which the person becomes 21 years of age.
194	228		17 (e-3) The General Assembly recognizes the need to identify
195	229		18 military veterans living in this State for the purpose of
196	230		19 ensuring that they receive all of the services and benefits to
197	231		20 which they are legally entitled, including health care
198	232		21 healthcare, education assistance, and job placement. To assist
199	233		22 the State in identifying these veterans and delivering these
200	234		23 vital services and benefits, the Secretary of State is
201	235		24 authorized to issue drivers' licenses with the word "veteran"
202	236		25 appearing on the face of the licenses. This authorization is
203	237		26 predicated on the unique status of veterans. The Secretary may

215	249		2 occupation, status, affiliation, hobby, or other unique
216	250		3 characteristics of the license holder which is unrelated to
217	251		4 the purpose of the driver's license.
218	252		5 (e-5) Beginning on or before July 1, 2015, the Secretary
219	253		6 of State shall designate a space on each original or renewal
220	254		7 driver's license where, at the request of the applicant, the
221	255		8 word "veteran" shall be placed. The veteran designation shall
222	256		9 be available to a person identified as a veteran under
223	257		10 subsection (e) of Section 6-106 of this Code who was
224	258		11 discharged or separated under honorable conditions.
225	259		12 (e-7) Upon providing the required documentation, at the
226	260		13 request of the applicant, the driver's license may reflect
227	261		14 Gold Star Family designation. The Secretary shall designate a
228	262		15 space on each original or renewal driver's license for such
229	263		16 designation. This designation shall be available to a person
230	264		17 eligible for Gold Star license plates under subsection (f) of
231	265		18 Section 6-106 of this Code.
232	266		19 (f) The Secretary of State shall inform all Illinois
233	267		20 licensed commercial motor vehicle operators of the
234	268		21 requirements of the Uniform Commercial Driver License Act,
235	269		22 Article V of this Chapter, and shall make provisions to insure
236	270		23 that all drivers, seeking to obtain a commercial driver's
237	271		24 license, be afforded an opportunity prior to April 1, 1992, to
238	272		25 obtain the license. The Secretary is authorized to extend

250	284		1 dates and locations where these commercial driver's tests
251	285		2 shall be conducted. Any applicant, regardless of the current
252	286		3 expiration date of the applicant's driver's license, may be
253	287		4 subject to any assignment by the Secretary. Failure to comply
254	288		5 with the Secretary's assignment may result in the applicant's
255	289		6 forfeiture of an opportunity to receive a commercial driver's
256	290		7 license prior to April 1, 1992.
257	291		8 (g) The Secretary of State shall designate on a driver's
258	292		9 license issued, a space where the licensee may indicate that
259	293		10 he or she has drafted a living will in accordance with the
260	294		11 Illinois Living Will Act or a durable power of attorney for
261	295		12 health care in accordance with the Illinois Power of Attorney
262	296		13 Act.
263	297		14 (g-1) The Secretary of State, in his or her discretion,
264	298		15 may designate on each driver's license issued a space where
265	299		16 the licensee may place a sticker or decal, issued by the
266	300		17 Secretary of State, of uniform size as the Secretary may
267	301		18 specify, that shall indicate in appropriate language that the
268	302		19 owner of the license has renewed his or her driver's license.
269	303		20 (h) A person who acts in good faith in accordance with the
270	304		21 terms of this Section is not liable for damages in any civil
271	305		22 action or subject to prosecution in any criminal proceeding
272	306		23 for his or her act.
273	307		24 (i) The Secretary shall designate a space on each original
274	308		25 or renewal of a driver's license, at the request of the
275	309		26 applicant, for a designation as a Gold Star Family. This
