12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Mental Health and Developmental
15	15	5 Disabilities Administrative Act is amended by changing Section
16	16	6 4 as follows:

18	18	8 Sec. 4. Supervision of facilities and services; quarterly
19	19	9 reports.
20	20	10 (a) To exercise executive and administrative supervision
21	21	11 over all facilities, divisions, programs and services now
22	22	12 existing or hereafter acquired or created under the
23	23	13 jurisdiction of the Department, including, but not limited to,
24	24	14 the following:

89	89	22 (b) Beginning not later than July 1, 1977, the Department
90	90	23 shall cause each of the facilities under its jurisdiction
91	91	24 which provide in-patient care to comply with standards, rules
92	92	25 and regulations of the Department of Public Health prescribed
93	93	26 under Section 6.05 of the Hospital Licensing Act.

104	104	1 (b-5) The Department shall cause each of the facilities
105	105	2 under its jurisdiction that provide in-patient care to comply
106	106	3 with Section 6.25 of the Hospital Licensing Act.
107	107	4 (c) The Department shall issue quarterly electronic
108	108	5 reports to the General Assembly on admissions, deflections,
109	109	6 discharges, bed closures, staff-resident ratios, census,
110	110	7 average length of stay, and any adverse federal certification
111	111	8 or accreditation findings, if any, for each State-operated
112	112	9 facility for the mentally ill and for persons with
113	113	10 developmental disabilities. The quarterly reports shall be
114	114	11 issued by January 1, April 1, July 1, and October 1 of each
115	115	12 year. The quarterly reports shall include the following
116	116	13 information for each facility reflecting the period ending 15
117	117	14 days prior to the submission of the report:
118	118	15 (1) the number of employees;
119	119	16 (2) the number of workplace violence incidents that
120	120	17 occurred, including the number that were a direct assault
121	121	18 on employees by residents and the number that resulted
122	122	19 from staff intervention in a resident altercation or other
123	123	20 form of injurious behavior;
124	124	21 (3) the number of employees impacted in each incident;
125	125	22 and
126	126	23 (4) the number of employee injuries resulting,
127	127	24 descriptions of the nature of the injuries, the number of
128	128	25 employee injuries requiring medical treatment at the
129	129	26 facility, the number of employee injuries requiring

140	140	1 outside medical treatment, and the number of days off work
141	141	2 per injury.
142	142	3 (d) The requirements in subsection (c) do not relieve the
143	143	4 Department from the recordkeeping requirements of the
144	144	5 Occupational Safety and Health Act.
145	145	6 (e) The Department shall:
146	146	7 (1) establish a reasonable procedure for employees to
147	147	8 report work-related assaults and injuries. A procedure is
148	148	9 not reasonable if it would deter or discourage a
149	149	10 reasonable employee from accurately reporting a workplace
150	150	11 assault or injury;
151	151	12 (2) inform each employee:
152	152	13 (A) of the procedure for reporting work-related
153	153	14 assaults and injuries;
154	154	15 (B) of the right to report work-related assaults
155	155	16 and injuries; and
156	156	17 (C) that the Department is prohibited from
157	157	18 discharging or in any manner discriminating against
158	158	19 employees for reporting work-related assaults and
159	159	20 injuries; and
160	160	21 (3) not discharge, discipline, or in any manner
161	161	22 discriminate against any employee for reporting a
162	162	23 work-related assault or injury.
163	163	24 (f) To provide for the safety of mental health care
164	164	25 patients and staff members, no fewer than 2 registered nurses
165	165	26 and no fewer than 2 mental health technicians must be assigned
