1414 1 AN ACT concerning education.
1515 2 Be it enacted by the People of the State of Illinois,
1616 3 represented in the General Assembly:
1717 4 Section 1. This Act may be referred to as the School
1818 5 Materials and Activities Report for Transparency Law.
1919 6 Section 5. The School Code is amended by adding Sections
2020 7 10-20.88 and 34-18.88 as follows:
2121 8 (105 ILCS 5/10-20.88 new)
2222 9 Sec. 10-20.88. Learning materials and activities report.
2323 10 (a) In this Section:
2424 11 "Activities" includes, but is not limited to, student
2525 12 assemblies, guest lectures, educational events facilitated by
2626 13 a school's administration or staff, or educational events
2727 14 conducted by outside individuals or organizations.
2828 15 "Activities" does not include student presentations.
2929 16 "Learning materials" includes, but is not limited to, any
3030 17 of the following:
3131 18 (1) Instructional material that consists of content
3232 19 that conveys to a student through a medium or a
3333 20 combination of media the essential knowledge, information,
3434 21 and skills pertaining to a subject included in a public
3535 22 school curriculum. In this paragraph (1), "instructional

8888 11 (2) Open education resource instructional material
8989 12 that consists of teaching, learning, and research
9090 13 resources that reside in the public domain or have been
9191 14 released under an intellectual property license and allows
9292 15 for the free use, reuse, modification, and sharing of
9393 16 resources with others. In this paragraph (2), "open
9494 17 education resource instructional material" includes full
9595 18 courses, course materials, modules, textbooks, streaming
9696 19 videos, tests or exams, software, or any other tools,
9797 20 materials, or techniques used to support access to
9898 21 knowledge and also includes State-developed open education
9999 22 resource instructional material.
100100 23 (3) Teaching aids.
101101 24 (4) Any other material for student instruction in
102102 25 which a student has the option to select the material.
103103 26 "Used for student instruction" means assigned, provided,

115115 2 course for which students receive academic credit or (ii) any
116116 3 educational capacity in which participation of the student
117117 4 body is required by the school or in which a majority of the
118118 5 students in a particular grade level participate.
119119 6 (b) By July 15 of each year, the school board of each
120120 7 school district with 300 or more students enrolled during the
121121 8 previous school year shall report for each of the district's
122122 9 schools the following information in a prominent location on
123123 10 the district's website:
124124 11 (1) A list of the learning materials and activities
125125 12 that were used for student instruction during the previous
126126 13 school year. The list of learning materials and activities
127127 14 shall be organized, at a minimum, by grade level and
128128 15 subject area.
129129 16 (2) Any procedures that are in effect at each school
130130 17 for the documentation, review, or approval by the school's
131131 18 administrators, principal, or teachers of the learning
132132 19 materials and activities used for student instruction.
133133 20 (c) Under this Section, a school board is required to
134134 21 report only the information that is necessary to identify the
135135 22 specific learning materials and activities used for student
136136 23 instruction at each school. The information reported must
137137 24 include the title and the author, the name of the
138138 25 organization, or the Internet address, as appropriate,
139139 26 associated with each of the learning materials or activities.

150150 1 Nothing in this Section may be construed to require either of
151151 2 the following:
152152 3 (1) The publication of a digital reproduction of
153153 4 learning materials on a school district's website.
154154 5 (2) A separate listing of the individual components of
155155 6 learning materials produced as a single volume; however,
156156 7 if the volume contains works by multiple authors, the
157157 8 listing shall provide either a table of contents or an
158158 9 Internet address that discloses the discrete works and
159159 10 authors contained within the volume.
160160 11 (d) By May 1 of each year, the State Board of Education
161161 12 shall notify a school district whether the school district is
162162 13 required to comply with this Section.
163163 14 (e) Under this Section, a school district may, but is not
164164 15 required to:
165165 16 (1) update the report and post the updated report on
166166 17 the district's website on an ongoing basis during the
167167 18 school year, provided that the updated report is completed
168168 19 by July 1 following the completion of the school year; and
169169 20 (2) utilize collaborative online document or
170170 21 spreadsheet software that allows multiple authorized users
171171 22 to update or make additions to the report on an ongoing
172172 23 basis, provided that a link to the report is publicly
173173 24 accessible on the district's website.
174174 25 (f) Each school year's report under this Section shall
175175 26 remain publicly available on the school district's website at
