311 1 AN ACT concerning State government.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Department of Professional Regulation Law
715 5 of the Civil Administrative Code of Illinois is amended by
816 6 changing Section 2105-17 as follows:
917 7 (20 ILCS 2105/2105-17)
1018 8 Sec. 2105-17. Volunteer license status licenses.
1119 9 (a) For the purposes of this Section:
1220 10 "Health care professional" means a physician licensed
1321 11 under the Medical Practice Act of 1987, a dentist licensed
1422 12 under the Illinois Dental Practice Act, an optometrist
1523 13 licensed under the Illinois Optometric Practice Act of 1987, a
1624 14 physician assistant licensed under the Physician Assistant
1725 15 Practice Act of 1987, and a nurse or advanced practice
1826 16 registered nurse licensed under the Nurse Practice Act. The
1927 17 Department may expand this definition by rule.
2028 18 "Volunteer practice" means the practice of a licensed
2129 19 health care professional for the benefit of an individual or
2230 20 the public and without compensation for the health care
2331 21 services provided.
2432 22 (b) A The Department may grant a volunteer license to a

41-8 (2) agrees to engage only in the volunteer practice of
42-9 his or her health care profession in a free medical
43-10 clinic, as defined in the Good Samaritan Act, or in a
44-11 public health clinic, as defined in Section 6-101 of the
45-12 Local Governmental and Governmental Employees Tort
46-13 Immunities Act, and to not practice for compensation.
75+8 (2) agrees to engage in the volunteer practice of his
76+9 or her health care profession in a free medical clinic, as
77+10 defined in the Good Samaritan Act, or in a public health
78+11 clinic, as defined in Section 6-101 of the Local
79+12 Governmental and Governmental Employees Tort Immunities

4781 14 (c) An application submitted under this Section shall not
4882 15 require payment of a fee. A license in volunteer status may be
4983 16 renewed in the same manner, at the same time, and with the same
5084 17 conditions as an active license, except that a renewal fee
5185 18 shall not be required. A volunteer license shall be granted in
5286 19 accordance with the licensing Act that applies to the health
5387 20 care professional's given health care profession, and the
5488 21 licensure fee shall be set by rule in accordance with
5589 22 subsection (f).
5690 23 (d) A health care professional whose license is in
5791 24 volunteer status may request the Department to change the
58-25 status to active as long as the request is made during the same
59-26 renewal period in which the license was previously active or

70-1 the health care professional renews the license in the same
71-2 manner and at the same time with the same conditions as an
72-3 active license. No health care professional shall hold a
73-4 non-volunteer license in a health care profession and a
74-5 volunteer license in that profession at the same time. In the
75-6 event that the health care professional obtains a volunteer
76-7 license in the profession for which he or she holds a
77-8 non-volunteer license, that non-volunteer license shall
78-9 automatically be placed in inactive status. In the event that
79-10 a health care professional obtains a non-volunteer license in
80-11 the profession for which he or she holds a volunteer license,
81-12 the volunteer license shall be placed in inactive status.
82-13 Practicing on a license in volunteer status that does not meet
83-14 the requirements of subsection (b) an expired volunteer
84-15 license constitutes the unlicensed practice of the health care
85-16 professional's profession.
86-17 (e) Nothing in this Section shall be construed to waive or
87-18 modify any statute, rule, or regulation concerning the
88-19 licensure or practice of any health care profession. A health
89-20 care professional whose license is in volunteer status who
90-21 holds a volunteer license shall be subject to all statutes,
91-22 rules, and regulations governing his or her profession, except
92-23 as provided in this Section. The Department shall waive the
93-24 licensure fee for the first 500 volunteer licenses issued and
94-25 may by rule provide for a fee waiver or fee reduction that
95-26 shall apply to all licenses issued after the initial 500.

104+1 previously active or the license is renewed in the same
105+2 manner, at the same time, and with the same conditions as an
106+3 active license. A health care professional who holds an active
107+4 license that was previously a volunteer license is subject to
108+5 the requirements of the State licensing Act that applies to
109+6 his or her health care profession and the rules adopted under
110+7 the relevant Act. No health care professional shall hold a
111+8 non-volunteer license in a health care profession and a
112+9 volunteer license in that profession at the same time. In the
113+10 event that the health care professional obtains a volunteer
114+11 license in the profession for which he or she holds a
115+12 non-volunteer license, that non-volunteer license shall
116+13 automatically be placed in inactive status. In the event that

106-1 (f) The Department may adopt rules for the administration
107-2 of this Section. shall determine by rule the total number of
108-3 volunteer licenses to be issued. The Department shall file
109-4 proposed rules implementing this Section within 6 months after
110-5 the effective date of this amendatory Act of the 98th General
111-6 Assembly.
