1212 2 Be it enacted by the People of the State of Illinois,

1414 4 Section 5. The Juvenile Court Act of 1987 is amended by

7878 11 an offense that if committed by an adult would not be an
7979 12 offense classified as a Class 2 felony or higher, an offense
8080 13 under Article 11 of the Criminal Code of 1961 or Criminal Code
8181 14 of 2012, or an offense under Section 12-13, 12-14, 12-14.1,
8282 15 12-15, or 12-16 of the Criminal Code of 1961.
8383 16 (c) If the juvenile law enforcement record was received
8484 17 through a public submission to a statewide student
8585 18 confidential reporting system administered by the Illinois
8686 19 State Police, the record will be maintained for a period of 5
8787 20 years according to all other provisions in this subsection
8888 21 (0.1).
8989 22 (0.15) If a juvenile law enforcement record meets
9090 23 paragraph (a) of subsection (0.1) of this Section, a juvenile
9191 24 law enforcement record created:
9292 25 (1) prior to January 1, 2018, but on or after January
9393 26 1, 2013 shall be automatically expunged prior to January

105105 2 (2) prior to January 1, 2013, but on or after January
106106 3 1, 2000, shall be automatically expunged prior to January

110110 7 Nothing in this subsection (0.15) shall be construed to
111111 8 restrict or modify an individual's right to have the person's
112112 9 juvenile law enforcement records expunged except as otherwise
113113 10 may be provided in this Act.
114114 11 (0.2)(a) Upon dismissal of a petition alleging delinquency
115115 12 or upon a finding of not delinquent, the successful
116116 13 termination of an order of supervision, or the successful
117117 14 termination of an adjudication for an offense which would be a
118118 15 Class B misdemeanor, Class C misdemeanor, or a petty or
119119 16 business offense if committed by an adult, the court shall
120120 17 automatically order the expungement of the juvenile court
121121 18 records and juvenile law enforcement records. The clerk shall
122122 19 deliver a certified copy of the expungement order to the
123123 20 Illinois State Police and the arresting agency. Upon request,
124124 21 the State's Attorney shall furnish the name of the arresting
125125 22 agency. The expungement shall be completed within 60 business
126126 23 days after the receipt of the expungement order.
127127 24 (b) If the chief law enforcement officer of the agency, or
128128 25 the chief law enforcement officer's designee, certifies in

140140 1 investigation involving the commission of a felony, that
141141 2 information, and information identifying the juvenile, may be
142142 3 retained until the statute of limitations for the felony has
143143 4 run. If the chief law enforcement officer of the agency, or the
144144 5 chief law enforcement officer's designee, certifies in writing
145145 6 that certain information is needed with respect to an internal
146146 7 investigation of any law enforcement office, that information
147147 8 and information identifying the juvenile may be retained
148148 9 within an intelligence file until the investigation is
149149 10 terminated or the disciplinary action, including appeals, has
150150 11 been completed, whichever is later. Retention of a portion of
151151 12 a juvenile's law enforcement record does not disqualify the
152152 13 remainder of a juvenile's record from immediate automatic
153153 14 expungement.
154154 15 (0.3)(a) Upon an adjudication of delinquency based on any
155155 16 offense except a disqualified offense, the juvenile court
156156 17 shall automatically order the expungement of the juvenile
157157 18 court and law enforcement records 2 years after the juvenile's
158158 19 case was closed if no delinquency or criminal proceeding is
159159 20 pending and the person has had no subsequent delinquency
160160 21 adjudication or criminal conviction. The clerk shall deliver a
161161 22 certified copy of the expungement order to the Illinois State
162162 23 Police and the arresting agency. Upon request, the State's
163163 24 Attorney shall furnish the name of the arresting agency. The

187187 12 paragraph (1), (2), or (3) of subsection (a) of Section 12-6,
188188 13 subsection (a-3) or (a-5) of Section 12-7.3, paragraph (1) or
189189 14 (2) of subsection (a) of Section 12-7.4, subparagraph (i) of
190190 15 paragraph (1) of subsection (a) of Section 12-9, subparagraph
191191 16 (H) of paragraph (3) of subsection (a) of Section 24-1.6,
192192 17 paragraph (1) of subsection (a) of Section 25-1, or subsection
193193 18 (a-7) of Section 31-1 of the Criminal Code of 2012.
194194 19 (b) If the chief law enforcement officer of the agency, or
195195 20 the chief law enforcement officer's designee, certifies in
196196 21 writing that certain information is needed for a pending
197197 22 investigation involving the commission of a felony, that
198198 23 information, and information identifying the juvenile, may be
199199 24 retained in an intelligence file until the investigation is
200200 25 terminated or for one additional year, whichever is sooner.

213213 2 juvenile's record from immediate automatic expungement.
214214 3 (0.4) Automatic expungement for the purposes of this
215215 4 Section shall not require law enforcement agencies to
216216 5 obliterate or otherwise destroy juvenile law enforcement
217217 6 records that would otherwise need to be automatically expunged
218218 7 under this Act, except after 2 years following the subject
219219 8 arrest for purposes of use in civil litigation against a
220220 9 governmental entity or its law enforcement agency or personnel
221221 10 which created, maintained, or used the records. However, these
222222 11 juvenile law enforcement records shall be considered expunged
223223 12 for all other purposes during this period and the offense,
224224 13 which the records or files concern, shall be treated as if it
225225 14 never occurred as required under Section 5-923.
226226 15 (0.5) Subsection (0.1) or (0.2) of this Section does not
227227 16 apply to violations of traffic, boating, fish and game laws,
228228 17 or county or municipal ordinances.
229229 18 (0.6) Juvenile law enforcement records of a plaintiff who
230230 19 has filed civil litigation against the governmental entity or
231231 20 its law enforcement agency or personnel that created,
232232 21 maintained, or used the records, or juvenile law enforcement
233233 22 records that contain information related to the allegations
234234 23 set forth in the civil litigation may not be expunged until
235235 24 after 2 years have elapsed after the conclusion of the
236236 25 lawsuit, including any appeal.

249249 2 Law Enforcement Officer-Worn Body Camera Act.
250250 3 (1) Whenever a person has been arrested, charged, or
251251 4 adjudicated delinquent for an incident occurring before a
252252 5 person's 18th birthday that if committed by an adult would be
253253 6 an offense, and that person's juvenile law enforcement and
254254 7 juvenile court records are not eligible for automatic
255255 8 expungement under subsection (0.1), (0.2), or (0.3), the
256256 9 person may petition the court at any time at no cost to the
257257 10 person for expungement of juvenile law enforcement records and
258258 11 juvenile court records relating to the incident and, upon
259259 12 termination of all juvenile court proceedings relating to that
260260 13 incident, the court shall order the expungement of all records
261261 14 in the possession of the Illinois State Police, the clerk of
262262 15 the circuit court, and law enforcement agencies relating to
263263 16 the incident, but only in any of the following circumstances:
264264 17 (a) the minor was arrested and no petition for
265265 18 delinquency was filed with the clerk of the circuit court;
266266 19 (a-5) the minor was charged with an offense and the
267267 20 petition or petitions were dismissed without a finding of
268268 21 delinquency;
269269 22 (b) the minor was charged with an offense and was
270270 23 found not delinquent of that offense;
271271 24 (c) the minor was placed under supervision under
272272 25 Section 5-615, and the order of supervision has since been

285285 2 would be a Class B misdemeanor, Class C misdemeanor, or a
286286 3 petty or business offense if committed by an adult.
287287 4 (1.5) At no cost to the person, the Illinois State Police
288288 5 shall allow a person to use the Access and Review process,
289289 6 established in the Illinois State Police, for verifying that
290290 7 the person's juvenile law enforcement records relating to
291291 8 incidents occurring before the person's 18th birthday eligible
292292 9 under this Act have been expunged.

296296 13 (2) Any person whose delinquency adjudications are not
297297 14 eligible for automatic expungement under subsection (0.3) of
298298 15 this Section may petition the court at no cost to the person to

300300 17 incidents occurring before the person's 18th birthday which
301301 18 did not result in proceedings in criminal court and all
302302 19 juvenile court records with respect to any adjudications
303303 20 except those based upon first degree murder or an offense
304304 21 under Article 11 of the Criminal Code of 2012 if the person is
305305 22 required to register under the Sex Offender Registration Act
306306 23 at the time the person petitions the court for expungement;
307307 24 provided that 2 years have elapsed since all juvenile court
308308 25 proceedings relating to the person have been terminated and
309309 26 the person's commitment to the Department of Juvenile Justice

320320 1 under this Act has been terminated.
321321 2 (2.5) If a minor is arrested and no petition for
322322 3 delinquency is filed with the clerk of the circuit court at the
323323 4 time the minor is released from custody, the youth officer, if
324324 5 applicable, or other designated person from the arresting
325325 6 agency, shall notify verbally and in writing to the minor or
326326 7 the minor's parents or guardians that the minor shall have an
327327 8 arrest record and shall provide the minor and the minor's
328328 9 parents or guardians with an expungement information packet,
329329 10 information regarding this State's expungement laws including
330330 11 a petition to expunge juvenile law enforcement and juvenile
331331 12 court records obtained from the clerk of the circuit court.
332332 13 (2.6) If a minor is referred to court, then, at the time of
333333 14 sentencing, dismissal of the case, or successful completion of
334334 15 supervision, the judge shall inform the delinquent minor of
335335 16 the minor's rights regarding expungement and the clerk of the
336336 17 circuit court shall provide an expungement information packet
337337 18 to the minor, written in plain language, including information
338338 19 regarding this State's expungement laws and a petition for
339339 20 expungement, a sample of a completed petition, expungement
340340 21 instructions that shall include information informing the
341341 22 minor that (i) once the case is expunged, it shall be treated
342342 23 as if it never occurred, (ii) the minor shall not be charged a
343343 24 fee to petition for expungement, (iii) once the minor obtains
344344 25 an expungement, the minor may not be required to disclose that
345345 26 the minor had a juvenile law enforcement or juvenile court

474474 12 Nothing in this subsection (0.15) shall be construed to
475475 13 restrict or modify an individual's right to have the person's
476476 14 juvenile law enforcement records expunged except as otherwise
477477 15 may be provided in this Act.
478478 16 (0.2)(a) Upon dismissal of a petition alleging delinquency
479479 17 or upon a finding of not delinquent, the successful
480480 18 termination of an order of supervision, or the successful
481481 19 termination of an adjudication for an offense which would be a
482482 20 Class B misdemeanor, Class C misdemeanor, or a petty or
483483 21 business offense if committed by an adult, the court shall

501501 3 (b) If the chief law enforcement officer of the agency, or
502502 4 the chief law enforcement officer's designee, certifies in
503503 5 writing that certain information is needed for a pending
504504 6 investigation involving the commission of a felony, that
505505 7 information, and information identifying the juvenile, may be
506506 8 retained until the statute of limitations for the felony has
507507 9 run. If the chief law enforcement officer of the agency, or the
508508 10 chief law enforcement officer's designee, certifies in writing
509509 11 that certain information is needed with respect to an internal
510510 12 investigation of any law enforcement office, that information
511511 13 and information identifying the juvenile may be retained
512512 14 within an intelligence file until the investigation is
513513 15 terminated or the disciplinary action, including appeals, has
514514 16 been completed, whichever is later. Retention of a portion of
515515 17 a juvenile's law enforcement record does not disqualify the
516516 18 remainder of a juvenile's record from immediate automatic
517517 19 expungement.
518518 20 (0.3)(a) Upon an adjudication of delinquency based on any
519519 21 offense except a disqualified offense or an attempt to commit
520520 22 a disqualified offense, the juvenile court shall automatically
521521 23 order the expungement of the juvenile court and law
522522 24 enforcement records 2 years after the juvenile's case was
523523 25 closed if no delinquency or criminal proceeding is pending and
524524 26 the person has had no subsequent delinquency adjudication or

535535 1 criminal conviction. On the date that the minor's sentence
536536 2 ends or the date that the court enters an order committing the
537537 3 minor to the Department of Juvenile Justice, the juvenile
538538 4 court judge shall schedule a date to enter the automatic
539539 5 expungement order. The minor must be notified but shall not be
540540 6 required to be present for the scheduled court date when
541541 7 automatic expungement is to be ordered. If the minor is not yet
542542 8 eligible on the originally scheduled date, the court shall
543543 9 schedule a subsequent date to enter the automatic expungement
544544 10 order. The clerk shall deliver a certified copy of the
545545 11 expungement order to the Illinois State Police and the
546546 12 arresting agency. Upon request, the State's Attorney shall
547547 13 furnish the name of the arresting agency. The expungement
548548 14 shall be completed within 60 business days after the receipt
549549 15 of the expungement order. In this subsection (0.3),
550550 16 "disqualified offense" means any of the following offenses:

585585 15 Retention of a portion of a juvenile's juvenile law
586586 16 enforcement record does not disqualify the remainder of a
587587 17 juvenile's record from immediate automatic expungement.
588588 18 (0.4) Automatic expungement for the purposes of this
589589 19 Section shall not require law enforcement agencies to
590590 20 obliterate or otherwise destroy juvenile law enforcement
591591 21 records that would otherwise need to be automatically expunged
592592 22 under this Act, except after 2 years following the subject
593593 23 arrest for purposes of use in civil litigation against a
594594 24 governmental entity or its law enforcement agency or personnel
595595 25 which created, maintained, or used the records. However, these
596596 26 juvenile law enforcement records shall be considered expunged

616616 10 maintained, or used the records, or juvenile law enforcement
617617 11 records that contain information related to the allegations
618618 12 set forth in the civil litigation may not be expunged until
619619 13 after 2 years have elapsed after the conclusion of the
620620 14 lawsuit, including any appeal.
621621 15 (0.7) Officer-worn body camera recordings shall not be
622622 16 automatically expunged except as otherwise authorized by the
623623 17 Law Enforcement Officer-Worn Body Camera Act.
624624 18 (1) Whenever a person has been arrested, charged, or
625625 19 adjudicated delinquent for an incident occurring before a
626626 20 person's 18th birthday that if committed by an adult would be
627627 21 an offense, and that person's juvenile law enforcement and
628628 22 juvenile court records are not eligible for automatic
629629 23 expungement under subsection (0.1), (0.2), or (0.3), the
630630 24 person may petition the court at any time at no cost to the
631631 25 person for expungement of juvenile law enforcement records and
632632 26 juvenile court records relating to the incident and, upon

644644 2 incident, the court shall order the expungement of all records
645645 3 in the possession of the Illinois State Police, the clerk of
646646 4 the circuit court, and law enforcement agencies relating to
647647 5 the incident, but only in any of the following circumstances:
648648 6 (a) the minor was arrested and no petition for
649649 7 delinquency was filed with the clerk of the circuit court;
650650 8 (a-5) the minor was charged with an offense and the
651651 9 petition or petitions were dismissed without a finding of
652652 10 delinquency;
653653 11 (b) the minor was charged with an offense and was
654654 12 found not delinquent of that offense;
655655 13 (c) the minor was placed under supervision under
656656 14 Section 5-615, and the order of supervision has since been
657657 15 successfully terminated; or
658658 16 (d) the minor was adjudicated for an offense which
659659 17 would be a Class B misdemeanor, Class C misdemeanor, or a
660660 18 petty or business offense if committed by an adult.
661661 19 (1.5) At no cost to the person, the Illinois State Police
662662 20 shall allow a person to use the Access and Review process,
663663 21 established in the Illinois State Police, for verifying that
664664 22 the person's juvenile law enforcement records relating to
665665 23 incidents occurring before the person's 18th birthday eligible
666666 24 under this Act have been expunged.

695695 17 (2.5) If a minor is arrested and no petition for
696696 18 delinquency is filed with the clerk of the circuit court at the
697697 19 time the minor is released from custody, the youth officer, if
698698 20 applicable, or other designated person from the arresting
699699 21 agency, shall notify verbally and in writing to the minor or
700700 22 the minor's parents or guardians that the minor shall have an
701701 23 arrest record and shall provide the minor and the minor's
702702 24 parents or guardians with an expungement information packet,

720720 6 circuit court shall provide an expungement information packet
721721 7 to the minor, written in plain language, including information
722722 8 regarding this State's expungement laws and a petition for
723723 9 expungement, a sample of a completed petition, expungement
724724 10 instructions that shall include information informing the
725725 11 minor that (i) once the case is expunged, it shall be treated
726726 12 as if it never occurred, (ii) the minor shall not be charged a
727727 13 fee to petition for expungement, (iii) once the minor obtains
728728 14 an expungement, the minor may not be required to disclose that
729729 15 the minor had a juvenile law enforcement or juvenile court
730730 16 record, and (iv) if petitioning the minor may file the
731731 17 petition on the minor's own or with the assistance of an
732732 18 attorney. The failure of the judge to inform the delinquent
733733 19 minor of the minor's right to petition for expungement as
734734 20 provided by law does not create a substantive right, nor is
735735 21 that failure grounds for: (i) a reversal of an adjudication of
736736 22 delinquency; (ii) a new trial; or (iii) an appeal.
