Requires all law enforcement agencies to establish temporary firearm storage programs. 1111 1 AN ACT concerning local government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the
1515 5 Temporary Firearm Storage Act.
1616 6 Section 5. Definitions. As used in this Act:
1717 7 "Firearm" has the meaning given in Section 1.1 of the
1818 8 Firearm Owners Identification Card Act.
1919 9 "Law enforcement agency" means the Illinois State Police,
2020 10 a sheriff's office, a municipal police department, a public
2121 11 university police department, or a community college police
2222 12 department.
2323 13 "Storage agreement" means an agreement between the owner
2424 14 of a firearm and either (i) a law enforcement agency or (ii) a
2525 15 private entity that established a temporary firearm storage
2626 16 program under Section 20 regarding the storage of a firearm
2727 17 for a specified period of time.
2828 18 "Temporary firearm storage program" means a program
2929 19 established under the Act for safely storing firearms outside
3030 20 the home of the owner of the firearm.
3131 21 Section 10. Temporary firearm storage by law enforcement

6767 1 (a) All law enforcement agencies must establish a
6868 2 temporary firearm storage program. The Illinois State Police
6969 3 must establish a temporary firearm storage program in each
7070 4 troop headquarters.
7171 5 (b) Prior to storage, the owner of a firearm must enter
7272 6 into a storage agreement with the law enforcement agency
7373 7 through which the firearm will be stored. A storage agreement
7474 8 may be created only by the owner of a firearm filling out an
7575 9 application stating (i) that the owner of the firearm is
7676 10 requesting the law enforcement agency to hold the firearm on
7777 11 the owner's behalf, (ii) the length of time the firearm will be
7878 12 held by the law enforcement agency, and (iii) that the owner of
7979 13 the firearm agrees that the firearm shall be turned over to the
8080 14 law enforcement agency if the owner of the firearm does not
8181 15 retrieve the firearm by the agreed upon time.
8282 16 (c) The maximum term for a storage agreement shall be
8383 17 determined by the law enforcement agency. An owner of a
8484 18 firearm may enter into a new storage agreement under
8585 19 subsection (b) to continue to store the firearm under the
8686 20 temporary firearm storage program. A law enforcement agency
8787 21 may not limit the number of times the owner of a firearm may
8888 22 enter into a storage agreement with the law enforcement
8989 23 agency.
9090 24 (d) A law enforcement agency must send notice to the
9191 25 firearm owner before a storage agreement expires. A law
9292 26 enforcement agency shall take possession of the firearm after

104104 2 agency notified the owner of the firearm that the law
105105 3 enforcement agency would take possession of the firearm after
106106 4 the expiration of the storage agreement.
107107 5 Section 15. Advertisement. If a law enforcement agency has
108108 6 a public-facing website, then it must describe its temporary
109109 7 firearm storage program on the website. The description on the
110110 8 website shall include a phone number to call to learn about the
111111 9 program, a digital copy of the form required for using the
112112 10 program, and the requirements for the program.
113113 11 Section 20. Temporary firearm storage by a private entity.
114114 12 (a) An individual or business that has a Federal Firearms
115115 13 License and is certified by the Illinois State Police under
116116 14 the Firearm Dealer License Certification Act may establish a
117117 15 temporary firearm storage program.
118118 16 (b) Prior to storage, the owner of a firearm must enter
119119 17 into a storage agreement with the individual or business. A
120120 18 storage agreement may be created only by the owner of a firearm
121121 19 filling out a form stating (i) that the owner of the firearm is
122122 20 requesting the individual or business to hold the firearm on

138138 2 (c) The maximum term for a storage agreement shall be
139139 3 determined by the individual or business. An owner of a
140140 4 firearm owner may enter into a new storage agreement under
141141 5 subsection (b) to continue to store the firearm under the
142142 6 temporary firearm storage program. An individual or business
143143 7 may not limit the number of times the owner of a firearm may
144144 8 enter into a storage agreement with the individual or
145145 9 business.
146146 10 (d) An individual or business must send notice to the
147147 11 owner of a firearm before a storage agreement expires. An
148148 12 individual or business shall take possession of the firearm
149149 13 after the expiration of the storage agreement if the
150150 14 individual or business notified the owner of the firearm that
151151 15 the individual or business would take possession of the
152152 16 firearm after the expiration of the storage agreement.
153153 17 (e) An individual or business storing a firearm under this
154154 18 Section may not use the firearm for any purpose.
155155 19 Section 25. Warrant requirement. A law enforcement agency
156156 20 may not use a firearm stored under a temporary firearm storage
157157 21 program for any purpose without a warrant.
158158 22 Section 30. Liability. Neither a law enforcement agency
159159 23 nor a private entity that establishes a temporary firearm
