11 104TH GENERAL ASSEMBLY State of Illinois 2025 and 2026 HB1460 Introduced , by Rep. Norine K. Hammond SYNOPSIS AS INTRODUCED: 305 ILCS 5/5-35 Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that beginning January 1, 2026, for a person who is a resident in a facility licensed under the ID/DD Community Care Act, the Community-Integrated Living Arrangements Licensure and Certification Act, or the MC/DD Act for whom payments are made under the Article throughout a month and who is determined to be eligible for medical assistance, the State shall pay an amount in addition to the minimum monthly personal needs allowance authorized under the Social Security Act so that the person's total monthly personal needs allowance from both State and federal sources equals $90. Provides that beginning January 1, 2027, the personal needs allowance described in the amendatory Act shall increase annually at the same rate as the Social Security cost-of-living adjustment to take effect on January 1 of each year. 1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Public Aid Code is amended by
1515 5 changing Section 5-35 as follows:

1717 7 Sec. 5-35. Personal needs allowance.
1818 8 (a) For a person who is a resident in a facility licensed
1919 9 under the ID/DD Community Care Act, the Community-Integrated
2020 10 Living Arrangements Licensure and Certification Act, the
2121 11 Specialized Mental Health Rehabilitation Act of 2013, or the
2222 12 MC/DD Act for whom payments are made under this Article
2323 13 throughout a month and who is determined to be eligible for
2424 14 medical assistance under this Article, the State shall pay an
2525 15 amount in addition to the minimum monthly personal needs
2626 16 allowance authorized under Section 1902(q) of Title XIX of the
2727 17 Social Security Act (42 U.S.C. 1396a(q)) so that the person's
2828 18 total monthly personal needs allowance from both State and
2929 19 federal sources equals $60.
3030 20 (b) Beginning January 1, 2026, for a person who is a
