312 1 AN ACT concerning transportation.
413 2 Be it enacted by the People of the State of Illinois,
514 3 represented in the General Assembly:
615 4 Section 5. The O'Hare Driver Safety Act is amended by
7-5 changing Sections 5, 10, 15, 25, and 30 and by adding Section
8-6 35 as follows:

10-8 Sec. 5. Definitions. As used in this Act:
11-9 "Authority" means the Illinois Toll Highway Authority.
12-10 "Automated traffic safety system" means a device with one
13-11 or more motor vehicle sensors to produce a recorded image of a
14-12 motor vehicle that is stopped or standing on the side of a
15-13 highway or roadway in violation of Section 11-1303 of the
16-14 Illinois Vehicle Code.
17-15 "Department" means the Illinois Department of
18-16 Transportation.
19-17 "Recorded images" has the same meaning given to that term
20-18 under Section 11-208.6 of the Illinois Vehicle Code.
21-19 "State Police" means the Illinois State Police.

33-1 O'Hare International Airport. Except where permitted, a person
34-2 operating a motor vehicle shall not stop or stand the person's
35-3 vehicle on a shoulder of a highway along traffic routes within
36-4 a one-half mile radius of: (1) the eastern entrance to O'Hare
37-5 International Airport; and (2) the intersection of Interstate
38-6 90 and Interstate 294.
39-7 No person who is the lessor of a motor vehicle under a
40-8 written lease agreement shall be liable for an automated
41-9 traffic safety system violation involving such motor vehicle
42-10 during the period of the lease, unless, upon the request of the
43-11 appropriate authority received within 120 days after the
44-12 violation occurred, the lessor provides within 60 days after
45-13 such receipt the name and address of the lessee.
46-14 Upon the provision of information by the lessor under this
47-15 Section, the State Police Authority may issue the violation to
48-16 the lessee of the vehicle in the same manner as it would issue
49-17 a violation to a registered owner of a vehicle, and the lessee
50-18 may be held liable for the violation.
51-19 This Section shall not apply to vehicles that are stopped
52-20 or standing in a restricted area if:
53-21 (1) a person is yielding to an emergency vehicle;
54-22 (2) the vehicle malfunctions;
55-23 (3) a person was directed to stop the person's vehicle
56-24 by a law enforcement officer;
57-25 (4) the vehicle was stolen prior to violation and not
58-26 controlled by the registered owner of the vehicle; or

70-2 Traffic Citation from a police officer at the time of the

78-10 Sec. 15. Installation of automated traffic safety systems;
79-11 enforcement. The State Police Authority shall procure, and
80-12 after procurement, have oversight over install and maintain
81-13 automated traffic safety systems along traffic routes within a
82-14 one-half mile radius of: (1) the eastern entrance to O'Hare
83-15 International Airport; and (2) the intersection of Interstate
84-16 90 and Interstate 294. The Authority and the Department shall
85-17 allow, subject to an expedited review by engineers of the
86-18 Authority and engineers of the Department, the installation of
87-19 automated traffic safety systems upon light poles under their
88-20 jurisdiction. Procurement by the State Police of automated
89-21 traffic safety systems under this Act may be carried out as
90-22 provided in subsection (a) of Section 95 of the Firearm
91-23 Concealed Carry Act.
92-24 A traffic route that is equipped with an automated traffic
93-25 safety system must be posted with signs visible to approaching

105-2 automated traffic safety system and informing drivers that

109-6 Sec. 25. Fines; notice. A person who violates this Act
110-7 shall be subject to a $100 fine for each offense. Proceeds from
111-8 fines shall be deposited into the State Police Law Enforcement
112-9 Administration Fund.
113-10 For each violation of a provision of this Act recorded by
114-11 an automatic traffic safety system, the State Police Authority
115-12 shall issue a written notice of the violation to the
116-13 registered owner of the vehicle as the alleged violator. The
117-14 notice shall be delivered to the registered owner of the
118-15 vehicle, by mail, within 30 days after the Secretary of State
119-16 notifies the State Police Authority of the identity of the
120-17 owner of the vehicle, but in no event later than 90 days after
121-18 the violation.
122-19 The notice shall include:
123-20 (1) the name and address of the registered owner of
124-21 the vehicle;
125-22 (2) the registration number of the motor vehicle
126-23 involved in the violation;
127-24 (3) the violation charged;
128-25 (4) the location where the violation occurred;

139-1 (5) the date and time of the violation;
140-2 (6) a copy of the recorded images;
141-3 (7) the amount of the civil penalty imposed and the
142-4 requirements of any traffic education program imposed and
143-5 the date by which the civil penalty should be paid and the
144-6 traffic education program should be completed;
145-7 (8) a statement that recorded images are evidence of a
146-8 violation of stopping or standing in a restricted area;
147-9 (9) a warning that failure to pay the civil penalty,
148-10 to complete a required traffic education program, or to
149-11 contest liability in a timely manner is an admission of
150-12 liability;
151-13 (10) a statement that the person may elect to proceed
152-14 by:
153-15 (A) paying the fine, completing a required traffic
154-16 education program, or both; or
155-17 (B) challenging the charge in court, by mail, or
156-18 by administrative hearing; and
157-19 (11) a website address, accessible through the
158-20 Internet, where the person may view the recorded images of
159-21 the violation.

162-24 Sec. 30. Rules. The State Police Authority shall adopt

176-3 Sec. 35. Procurement. The State Police, in consultation
177-4 with and subject to the approval of the Chief Procurement
178-5 Officer, may procure a single contract or multiple contracts
179-6 to implement the provisions of this Act. A contract or
180-7 contracts under this Section are not subject to the provisions
181-8 of the Illinois Procurement Code, except for Sections 20-60,
182-9 20-65, 20-70, and 20-160 and Article 50 of that Code, provided
183-10 that the Chief Procurement Officer may, in writing with
184-11 justification, waive any certification required under Article
185-12 50. This exemption shall be repealed one year from the
186-13 effective date of this amendatory Act of the 104th General
