1111 1 AN ACT concerning State government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title. This Act may be cited as the School
1515 5 District Impact Note Act.
1616 6 Section 5. Definitions. As used in this Act:
1717 7 "Impact on education in the State" means the total sum
1818 8 that the State Board estimates school districts in the State
1919 9 will expend to implement a bill and the total number of
2020 10 additional hours that the State Board estimates teachers and
2121 11 school administrators in the State will expend implementing
2222 12 the requirements of a bill.
2323 13 "State Board" means the Illinois State Board of Education.
2424 14 Section 10. Applicability. Every bill that could have a
2525 15 negative impact on the finances of a school district in the
2626 16 State or that could cause a school district to expend
2727 17 additional staffing resources shall have prepared for it by
2828 18 the State Board, before second reading in the house of
2929 19 introduction, a brief explanatory statement or note describing
3030 20 the bill's anticipated impact on education in the State.

6666 1 Note.
6767 2 (a) Upon request of the sponsor of a bill described in
6868 3 Section 10, the State Board shall prepare a written note
6969 4 setting forth the information required by Section 10. The note
7070 5 shall be designated as a School District Impact Note and shall
7171 6 be furnished to the sponsor within 10 calendar days after the
7272 7 request. If, because of the complexity of the bill, additional
7373 8 time is required for preparation of the School District Impact
7474 9 Note, the State Board may so notify the sponsor and request an
7575 10 extension of time not to exceed 5 additional days within which
7676 11 to furnish the School District Impact Note. An extension may
7777 12 not, however, be beyond May 15 following the date of the
7878 13 request.
7979 14 (b) Whenever the sponsor of any bill is of the opinion that
8080 15 no School District Impact Note is necessary, any member of
8181 16 either house may thereafter request that a School District
8282 17 Impact Note be obtained, and in such case, the matter shall be
8383 18 decided by majority vote of those present and voting in the
8484 19 house of which he or she is a member. If the sponsor believes
8585 20 that a School District Impact Note request has been filed in
8686 21 bad faith, the sponsor may ask for a vote to render one or more
8787 22 School District Impact Note requests inapplicable.
8888 23 (c) Whenever a bill is amended on the floor of either house
8989 24 in a manner as to bring it within the description of bills set
9090 25 forth in Section 10, a majority of that house may propose that
9191 26 no action be taken upon the amendment until the sponsor of the

104104 3 Section 20. Content of the School District Impact Note.
105105 4 (a) The School District Impact Note shall be factual,
106106 5 brief, and concise and shall provide as reliable of a
107107 6 statement of the bill's anticipated impact on education in the
108108 7 State as is possible under the circumstances. The School
109109 8 District Impact Note shall include both the immediate
110110 9 financial impact and, if determinable or reasonably
111111 10 foreseeable, the long-range financial impact of the bill, as
112112 11 well as short-term and long-term estimates of additional
113113 12 staffing needs. The School District Impact Note must also
114114 13 state whether the bill will have a disparate impact on the
115115 14 finances or staffing needs of school districts in the State.
116116 15 (b) No comment or opinion shall be included in the School
117117 16 District Impact Note with regard to the merits of the bill for
118118 17 which the School District Impact Note is prepared; however,
119119 18 technical or mechanical defects in the bill may be noted. The
120120 19 School District Impact Note shall be signed by the State
121121 20 Superintendent of Education or his or her designee.
122122 21 Section 25. Participation in hearing. The fact that a
123123 22 School District Impact Note is prepared for any bill shall not
124124 23 preclude or restrict the appearance before any committee of
125125 24 the General Assembly of any State official or employee who

137137 2 Section 30. Confidentiality. The subject matter of bills
138138 3 submitted to the State Board shall be kept in strict
139139 4 confidence by the State Board, and no information relating to
140140 5 the bill or its anticipated impact on education in the State
141141 6 shall be divulged, before the bill's introduction in the
142142 7 General Assembly, by any State official or employee of the
