1111 1 AN ACT concerning finance.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The State Finance Act is amended by changing
1515 5 Section 6z-27 as follows:
1616 6 (30 ILCS 105/6z-27)
1717 7 Sec. 6z-27. All moneys in the Audit Expense Fund shall be
1818 8 transferred, appropriated and used only for the purposes
1919 9 authorized by, and subject to the limitations and conditions
2020 10 prescribed by, the Illinois State Auditing Act.
2121 11 Within 30 days after July 1, 2025 2024, or as soon
2222 12 thereafter as practical, the State Comptroller shall order
2323 13 transferred and the State Treasurer shall transfer from the
2424 14 following funds moneys in the specified amounts for deposit
2525 15 into the Audit Expense Fund:

502502 3 Notwithstanding any provision of the law to the contrary,
503503 4 the General Assembly hereby authorizes the use of such funds
504504 5 for the purposes set forth in this Section.
505505 6 These provisions do not apply to funds classified by the
506506 7 Comptroller as federal trust funds or State trust funds. The
507507 8 Audit Expense Fund may receive transfers from those trust
508508 9 funds only as directed herein, except where prohibited by the
509509 10 terms of the trust fund agreement. The Auditor General shall
510510 11 notify the trustees of those funds of the estimated cost of the
511511 12 audit to be incurred under the Illinois State Auditing Act for
512512 13 the fund. The trustees of those funds shall direct the State
513513 14 Comptroller and Treasurer to transfer the estimated amount to
514514 15 the Audit Expense Fund.
515515 16 The Auditor General may bill entities that are not subject
516516 17 to the above transfer provisions, including private entities,
517517 18 related organizations and entities whose funds are
518518 19 locally-held, for the cost of audits, studies, and
519519 20 investigations incurred on their behalf. Any revenues received
520520 21 under this provision shall be deposited into the Audit Expense
521521 22 Fund.
522522 23 In the event that moneys on deposit in any fund are
523523 24 unavailable, by reason of deficiency or any other reason
524524 25 preventing their lawful transfer, the State Comptroller shall
525525 26 order transferred and the State Treasurer shall transfer the

536536 1 amount deficient or otherwise unavailable from the General
537537 2 Revenue Fund for deposit into the Audit Expense Fund.
538538 3 On or before December 1, 1992, and each December 1
539539 4 thereafter, the Auditor General shall notify the Governor's
540540 5 Office of Management and Budget (formerly Bureau of the
541541 6 Budget) of the amount estimated to be necessary to pay for
542542 7 audits, studies, and investigations in accordance with the
543543 8 Illinois State Auditing Act during the next succeeding fiscal
544544 9 year for each State fund for which a transfer or reimbursement
545545 10 is anticipated.
546546 11 Beginning with fiscal year 1994 and during each fiscal
547547 12 year thereafter, the Auditor General may direct the State
548548 13 Comptroller and Treasurer to transfer moneys from funds
549549 14 authorized by the General Assembly for that fund. In the event
550550 15 funds, including federal and State trust funds but excluding
551551 16 the General Revenue Fund, are transferred, during fiscal year
552552 17 1994 and during each fiscal year thereafter, in excess of the
553553 18 amount to pay actual costs attributable to audits, studies,
554554 19 and investigations as permitted or required by the Illinois
555555 20 State Auditing Act or specific action of the General Assembly,
556556 21 the Auditor General shall, on September 30, or as soon
557557 22 thereafter as is practicable, direct the State Comptroller and
558558 23 Treasurer to transfer the excess amount back to the fund from
559559 24 which it was originally transferred.
