11	11	1 AN ACT concerning finance.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The State Finance Act is amended by changing
15	15	5 Section 6z-27 as follows:
16	16	6 (30 ILCS 105/6z-27)
17	17	7 Sec. 6z-27. All moneys in the Audit Expense Fund shall be
18	18	8 transferred, appropriated and used only for the purposes
19	19	9 authorized by, and subject to the limitations and conditions
20	20	10 prescribed by, the Illinois State Auditing Act.
21	21	11 Within 30 days after July 1, 2025 2024, or as soon
22	22	12 thereafter as practical, the State Comptroller shall order
23	23	13 transferred and the State Treasurer shall transfer from the
24	24	14 following funds moneys in the specified amounts for deposit
25	25	15 into the Audit Expense Fund:

502	502	3 Notwithstanding any provision of the law to the contrary,
503	503	4 the General Assembly hereby authorizes the use of such funds
504	504	5 for the purposes set forth in this Section.
505	505	6 These provisions do not apply to funds classified by the
506	506	7 Comptroller as federal trust funds or State trust funds. The
507	507	8 Audit Expense Fund may receive transfers from those trust
508	508	9 funds only as directed herein, except where prohibited by the
509	509	10 terms of the trust fund agreement. The Auditor General shall
510	510	11 notify the trustees of those funds of the estimated cost of the
511	511	12 audit to be incurred under the Illinois State Auditing Act for
512	512	13 the fund. The trustees of those funds shall direct the State
513	513	14 Comptroller and Treasurer to transfer the estimated amount to
514	514	15 the Audit Expense Fund.
515	515	16 The Auditor General may bill entities that are not subject
516	516	17 to the above transfer provisions, including private entities,
517	517	18 related organizations and entities whose funds are
518	518	19 locally-held, for the cost of audits, studies, and
519	519	20 investigations incurred on their behalf. Any revenues received
520	520	21 under this provision shall be deposited into the Audit Expense
521	521	22 Fund.
522	522	23 In the event that moneys on deposit in any fund are
523	523	24 unavailable, by reason of deficiency or any other reason
524	524	25 preventing their lawful transfer, the State Comptroller shall
525	525	26 order transferred and the State Treasurer shall transfer the

536	536	1 amount deficient or otherwise unavailable from the General
537	537	2 Revenue Fund for deposit into the Audit Expense Fund.
538	538	3 On or before December 1, 1992, and each December 1
539	539	4 thereafter, the Auditor General shall notify the Governor's
540	540	5 Office of Management and Budget (formerly Bureau of the
541	541	6 Budget) of the amount estimated to be necessary to pay for
542	542	7 audits, studies, and investigations in accordance with the
543	543	8 Illinois State Auditing Act during the next succeeding fiscal
544	544	9 year for each State fund for which a transfer or reimbursement
545	545	10 is anticipated.
546	546	11 Beginning with fiscal year 1994 and during each fiscal
547	547	12 year thereafter, the Auditor General may direct the State
548	548	13 Comptroller and Treasurer to transfer moneys from funds
549	549	14 authorized by the General Assembly for that fund. In the event
550	550	15 funds, including federal and State trust funds but excluding
551	551	16 the General Revenue Fund, are transferred, during fiscal year
552	552	17 1994 and during each fiscal year thereafter, in excess of the
553	553	18 amount to pay actual costs attributable to audits, studies,
554	554	19 and investigations as permitted or required by the Illinois
555	555	20 State Auditing Act or specific action of the General Assembly,
556	556	21 the Auditor General shall, on September 30, or as soon
557	557	22 thereafter as is practicable, direct the State Comptroller and
558	558	23 Treasurer to transfer the excess amount back to the fund from
559	559	24 which it was originally transferred.
