11	11	1 AN ACT concerning safety.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Environmental Protection Act is amended by
15	15	5 adding Section 22.40c as follows:
16	16	6 (415 ILCS 5/22.40c new)
17	17	7 Sec. 22.40c. Gas Collection and Control System
18	18	8 Requirements. Each owner or operator of a municipal solid
19	19	9 waste landfill that meets 40 CFR 60.33c and relevant federal
20	20	10 regulatory requirements to install a gas collection and
21	21	11 control system must fulfill the following requirements:
22	22	12 (1) The owner or operator must, in the case of an
23	23	13 active municipal solid waste landfill, operate the gas
24	24	14 collection and control system so that gas is collected
25	25	15 from each area, cell, or group of cells in the municipal
26	26	16 solid waste landfill in which solid waste has been in
27	27	17 place for one year or more.
28	28	18 (2) The owner or operator must estimate when the
29	29	19 landfill will reach the thresholds identified in 40 CFR
30	30	20 60.33c and relevant federal regulatory requirements
31	31	21 requiring installation of a gas collection and control
32	32	22 system, install a gas collection and control system within
33	33	23 12 months after that estimated date, and operate the gas
