1111 1 AN ACT concerning safety.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Environmental Protection Act is amended by
1515 5 adding Section 22.40c as follows:
1616 6 (415 ILCS 5/22.40c new)
1717 7 Sec. 22.40c. Gas Collection and Control System
1818 8 Requirements. Each owner or operator of a municipal solid
1919 9 waste landfill that meets 40 CFR 60.33c and relevant federal
2020 10 regulatory requirements to install a gas collection and
2121 11 control system must fulfill the following requirements:
2222 12 (1) The owner or operator must, in the case of an
2323 13 active municipal solid waste landfill, operate the gas
2424 14 collection and control system so that gas is collected
2525 15 from each area, cell, or group of cells in the municipal
2626 16 solid waste landfill in which solid waste has been in
2727 17 place for one year or more.
2828 18 (2) The owner or operator must estimate when the
2929 19 landfill will reach the thresholds identified in 40 CFR
3030 20 60.33c and relevant federal regulatory requirements
3131 21 requiring installation of a gas collection and control
3232 22 system, install a gas collection and control system within
3333 23 12 months after that estimated date, and operate the gas
