1111 1 AN ACT concerning transportation.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Vehicle Code is amended by
1515 5 changing Section 6-507 as follows:
1616 6 (625 ILCS 5/6-507) (from Ch. 95 1/2, par. 6-507)
1717 7 Sec. 6-507. Commercial Driver's License (CDL) or
1818 8 Commercial Learner's Permit (CLP) required.
1919 9 (a) Except as expressly permitted by this UCDLA, or when
2020 10 driving pursuant to the issuance of a commercial learner's
2121 11 permit and accompanied by the holder of a CDL valid for the
2222 12 vehicle being driven; no person shall drive a commercial motor
2323 13 vehicle on the highways without:
2424 14 (1) a CDL in the driver's possession;
2525 15 (2) having obtained a CLP or CDL;
2626 16 (3) the proper class of CLP or CDL or endorsements or
2727 17 both for the specific vehicle group being operated or for
2828 18 the passengers or type of cargo being transported; or
2929 19 (4) a copy of a medical variance document, if one
3030 20 exists, such as an exemption letter or a skill performance
3131 21 evaluation certificate.
3232 22 (a-5) A CLP or CDL holder whose CLP or CDL is held by this

6868 1 motor vehicle traffic code and who has not been convicted of a
6969 2 disqualifying offense under 49 C.F.R. 383.51 based on this
7070 3 enforcement, may drive a CMV while holding a dated receipt for
7171 4 the CLP or CDL.
7272 5 (b) Except as otherwise provided by this Code, no person
7373 6 may drive a commercial motor vehicle on the highways while
7474 7 such person's driving privilege, license, or permit is:
7575 8 (1) Suspended, revoked, cancelled, or subject to
7676 9 disqualification. Any person convicted of violating this
7777 10 provision or a similar provision of this or any other
7878 11 state shall have their driving privileges revoked under
7979 12 paragraph 12 of subsection (a) of Section 6-205 of this
8080 13 Code.
8181 14 (2) Subject to or in violation of an "out-of-service"
8282 15 order. Any person who has been issued a CLP or CDL and is
8383 16 convicted of violating this provision or a similar
8484 17 provision of any other state shall be disqualified from
8585 18 operating a commercial motor vehicle under subsection (i)
8686 19 of Section 6-514 of this Code.
8787 20 (3) Subject to or in violation of a driver or vehicle
8888 21 "out of service" order while operating a vehicle designed
8989 22 to transport 16 or more passengers, including the driver,
9090 23 or transporting hazardous materials required to be
9191 24 placarded. Any person who has been issued a CLP or CDL and
9292 25 is convicted of violating this provision or a similar
9393 26 provision of this or any other state shall be disqualified

106106 3 (b-3) Except as otherwise provided by this Code, no person
107107 4 may drive a commercial motor vehicle on the highways during a
108108 5 period which the commercial motor vehicle or the motor carrier
109109 6 operation is subject to an "out-of-service" order. Any person
110110 7 who is convicted of violating this provision or a similar
111111 8 provision of any other state shall be disqualified from
112112 9 operating a commercial motor vehicle under subsection (i) of
113113 10 Section 6-514 of this Code.
114114 11 (b-5) Except as otherwise provided by this Code, no person
115115 12 may operate a vehicle designed to transport 16 or more
116116 13 passengers including the driver or hazardous materials of a
117117 14 type or quantity that requires the vehicle to be placarded
118118 15 during a period in which the commercial motor vehicle or the
119119 16 motor carrier operation is subject to an "out-of-service"
120120 17 order. Any person who is convicted of violating this provision
121121 18 or a similar provision of any other state shall be
122122 19 disqualified from operating a commercial motor vehicle under
123123 20 subsection (i) of Section 6-514 of this Code.
124124 21 (c) Pursuant to the options provided to the States by FHWA
125125 22 Docket No. MC-88-8, the driver of any motor vehicle controlled
126126 23 or operated by or for a farmer is waived from the requirements
127127 24 of this Section, when such motor vehicle is being used to
128128 25 transport: agricultural products; implements of husbandry; or
129129 26 farm supplies; to and from a farm, as long as such movement is

140140 1 not over 150 air miles from the originating farm. This waiver
141141 2 does not apply to the driver of any motor vehicle being used in
142142 3 a common or contract carrier type operation. However, for
143143 4 those drivers of any truck-tractor semitrailer combination or
144144 5 combinations registered under subsection (c) of Section 3-815
145145 6 of this Code, this waiver shall apply only when the driver is a
146146 7 farmer or a member of the farmer's family and the driver is 21
147147 8 years of age or more and has successfully completed any tests
148148 9 the Secretary of State deems necessary.
149149 10 In addition, the farmer or a member of the farmer's family
150150 11 who operates a truck-tractor semitrailer combination or
151151 12 combinations pursuant to this waiver shall be granted all of
152152 13 the rights and shall be subject to all of the duties and
153153 14 restrictions with respect to Sections 6-514 and 6-515 of this
154154 15 Code applicable to the driver who possesses a commercial
155155 16 driver's license issued under this Code, except that the
156156 17 driver shall not be subject to any additional duties or
157157 18 restrictions contained in Part 382 of the Federal Motor
158158 19 Carrier Safety Regulations that are not otherwise imposed
159159 20 under Section 6-514 or 6-515 of this Code.
160160 21 For purposes of this subsection (c), a member of the
161161 22 farmer's family is a natural or in-law spouse, child, parent,
162162 23 or sibling.
163163 24 As required under the Code of Federal Regulations 49 CFR
164164 25 390.39, an operator of a covered farm vehicle, as defined
165165 26 under Section 18b-101 of this Code, is exempt from the

176176 1 requirements of this Section. However, for drivers of any
177177 2 truck-tractor semitrailer combination or combinations
178178 3 operating as a covered farm vehicle, the driver must
179179 4 successfully complete any tests the Secretary of State deems
180180 5 necessary. When operating any truck-tractor semitrailer
181181 6 combination as a covered farm vehicle, the exemption applies
182182 7 only to persons age 21 or older, if operating the vehicle in
183183 8 interstate driving, and to persons at least 18 years of age, if
184184 9 operating the vehicle in intrastate driving. The Secretary may
185185 10 adopt rules necessary to implement this Section.
186186 11 (c-5) An employee of a township or road district with a
187187 12 population of less than 10,000 3,000 operating a vehicle
188188 13 within the boundaries of the township or road district for the
189189 14 purpose of removing snow or ice from a roadway by plowing,
190190 15 sanding, or salting is waived from the requirements of this
191191 16 Section when the employee is needed to operate the vehicle
192192 17 because the employee of the township or road district who
193193 18 ordinarily operates the vehicle and who has a commercial
194194 19 driver's license is unable to operate the vehicle or is in need
195195 20 of additional assistance due to a snow emergency.
196196 21 (c-10) A driver of a commercial motor vehicle used
197197 22 primarily in the transportation of propane winter heating fuel
198198 23 or a driver of a motor vehicle used to respond to a pipeline
199199 24 emergency is waived from the requirements of this Section if
200200 25 such requirements would prevent the driver from responding to
201201 26 an emergency condition requiring immediate response as defined
